Water Rights discussion: 02032016 Louis Zamora & Kay Puschel [ kpuschel@tfcanal.com ] Twin Falls Canal Company (TFCC) 208-733-6731
1. TFCC delivers 99% of the water in the county to include both parcels being considered by VA in Buhl.
2. Water Rights are attached to and sold with the land by 1 share per acre.
3. 5 acres would receive 5 shares which equates to 34 gallons/minute, 24/7, constant flow.
4. TFCC does not use AC-FT and TFCC does not measure the water usage.
5. The water season is April 1 – Oct 31st and TFCC turns on the water to “your” head gate at your request, but no sooner than April 1st.
6. Once the water is delivered via canal into the head gate, TFCC no longer owns the water, and the VA would have to work out the usage with either Mr. Hatfield or Seneca Foods so that VA received the 34 gallons/minute, 24/7, constant flow.
7. The head gate is located at the neatest intersection.
8. If at the time of sale the owner chose to withhold water rights, then that decision would have to be approved by the Board of Directors for TFCC – this is frowned upon.
9. Kay Puschel is the POC for transfering the water from the larger parcel to the 5 acre veterans’ cemetery.
a) Provide Kay with a copy of the Deed from the Title Co.
b) As the water rights are being transfered from a larger parcel for use on a smaller parcel with both parcels having used the same water previously, then Kay will only need one (1) day to complete the transfer with a $5.00 fee for a water certificate.
10. TFCC assesses a cost/share each season which is paid once annually. Last year the fee was $26.00/share so the 5 shares would be $130.00 total for one season.
11. Suggestion was made for VA to install a small pond to fill as a reservoir from which to pump into the cemetery irrigation system.
