About this file
This document is a Responses to Late Questions/RFI/Clarifications document for Solicitation Number 36C26326B0007, a project to replace the Boiler Plant Brine Tank (Project Number 636A6-22-104). The document addresses several key questions from potential contractors, including equipment specifications, control systems, project tax status, and staffing requirements. Significant details include allowing equivalent equipment to the basis of design tanks and pump schedule, confirming that soft water system controls are not required to be JCI, and verifying the project is not tax-exempt.
A critical clarification is the requirement for distinct personnel roles, specifically that the Superintendent cannot serve as both the Site Safety and Health Officer (SSHO) and Quality Control representative. The specification mandates these as separate, qualified individuals, with the SSHO required to be present on-site during work and having no other duties. A Lead Survey Report was referenced for paint testing, and contractors are directed to consult specific Federal Acquisition Regulation (FAR) sections regarding taxation and project requirements.

Responses to Late Questions/RFI/Clarifications
Question: Are we using step saver, Inc or Culligan tanks for ST - 1 - 2, DT – 1, and BP – 1 & 2?
Answer: Refer to the tank and pump schedule on drawing P601. This equipment was used as the basis of design. Equivalent equipment may be used as long as it follows the “basis of design or equal.”
Question: Are we going to use JCI controls for this project?
Answer: The controls to the soft water system are not on Metasys and therefore are not required to be JCI.
Question: Who is checking the paint to make that there is no lead paint ?
Answer: Please see the attached report.

Question: Is this project tax-exempt? Is so, will a certificate be issued?
Answer: This project is not tax-exempt. See FAR 52.229-12, FAR 52.229-3 and FAR 52.229-11. Also refer to page 36 of the solicitation under “Special Notes regarding FAR 52.229-3: Federal, State and Local Taxes:”
Question: Can our Superintendent serve as the SSHO or the Quality Control representative? If so, which one?
Answer: Per the Scope of Work, the project shall have a dedicated superintendent. Specification Section 01 35 26 paragraph 1.9 C states that competent persons can have collateral duties.
However, this does not apply to the SSHO as Specification Section 01 35 26 paragraph 1.9 C, states the SSHO has to be a separate qualified individual from the Prime Contractor’s Superintendent and/or Quality Control Manager with duties only as the SSHO.
Question: Alternatively, can our Superintendent fulfill both SSHO and Quality Control roles?
Answer: No. The Superintendent and SSHO are required to be two people. Per the Scope of Work the SSHO shall be present on site when work is being performed and have no other duties.
Specification Section 01 35 26 paragraph 1.9 C, states the SSHO has to be a separate qualified individual from the Prime Contractor’s Superintendent and/or Quality Control Manager with duties only as the SSHO.
