About this file
This is Amendment 001 to Solicitation 36C25626R0067 for the Michael E. DeBakey VA Medical Center (MEDVAMC) in Houston, Texas. The amendment extends the proposal receipt deadline from June 4, 2026 to June 11, 2026 at 11:00 AM CDT. The amendment adds Federal Acquisition Regulation (FAR) 52.222-90, "Addressing DEI Discrimination by Federal Contractors," effective April 2026, which prohibits contractors and subcontractors from engaging in racially discriminatory diversity, equity, and inclusion (DEI) activities. Compliance with this clause is material to the Government's payment decisions, and contractors must include this requirement in all subcontracts at any tier. The amendment also provides updated Department of Labor wage rate determinations dated May 18, 2026, which contractors must follow, and includes a site visit sign-in sheet for the project.
The underlying solicitation is a Firm-Fixed Price Request for Proposals restricted to Service-Disabled Veteran-Owned Small Businesses (SDVOSB) under Public Law 109-461, with a requirement that at least 15 percent of personnel costs be spent on the contractor's own employees or other eligible SDVOSB concerns. The contract covers replacement and upgrade of the overhead paging system across all campus buildings at MEDVAMC, including general construction, demolition, architectural work, asbestos abatement, electrical, and telecommunications components. The contract period is 730 calendar days from Notice to Proceed. A bid bond is required with the proposal submission, and performance and payment bonds will be required from the selected contractor. The solicitation was issued April 28, 2026, with construction drawings dated July 21, 2025, establishing the applicable codes and standards for bidders.

(a) Definitions. As used in this clause— Program participation means membership or participation in, or access or admission to: training, mentoring, or leadership development programs; educational opportunities; clubs; associations; or similar opportunities that are sponsored or established by the contractor or subcontractor.
Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.
(b) In connection with the performance of work under this contract, the Contractor agrees as follows:
(1) The Contractor will not engage in any racially discriminatory DEI activities;
(2) The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause;
(3) In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts;

(6) The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4).
(c) The Contractor must include the substance of this clause, including this paragraph (c), in subcontracts at any tier, including those for commercial products and commercial services, except those where the place of delivery or performance is outside the United States.
(End of clause)
Clarifications for 580-25-101 Replace/Upgrade Overhead Paging:
1. Question: Please clarify if a superintendent can be a dual hat to cover the requirements of SSHO?
Answer: No, per specifications, “The Prime Contractor shall provide a minimum of one “Full-Time” SSHO at each project site, for each shift (with no other duties) that holds as current, a professional safety certification with at least 3 years of dedicated construction safety related experience.”
1. Question: If no to the question above, will the SSHO need to be full-time for this project?
Answer: Yes
1. Question: Please clarify if a superintendent can be a dual hat to cover the requirements of QA/QC?
Answer: Yes, the superintendent may also serve as the QA/QC manager, provided they can fulfill all Quality Control requirements identified in Section 01 45 00 – Quality Control and maintain continuous onsite oversight of both construction operations and QC activities throughout duration.
1. Question: If no to the question above, will the QA/QC need to be full time for this project?
Answer: Please refer to question 3.
1. Question: Can a superintendent be a triple hat to cover the requirements of SSHO and QA/QC?
Answer: No, please refer to question 1 & 3.
1. Question: Please confirm the issued drawing set, dated 07.21.2025 is the latest and complete set.
Answer: 07.21.025 is the latest complete set.
1. Question: Please confirm bidders will be held to TIL guidelines at the time the drawings were issued.
Answer: Yes. Bidders shall comply with the VA Technical Information Library (TIL), codes, standards, and design criteria in effect at the time the construction documents were issued, unless otherwise directed by the VA through an official amendment, clarification, or change during the solicitation period.
1. Question: Past Performance: If we have a PPQ, requested for another opportunity, that is less than 12 months old, can we use it within our proposal? Or will a new PPQ need to be requested?
Answer: PPQs are not required to be submitted with your proposal. Should you choose to submit one, the page(s) will count towards your page limit.
1. Question: Is the use of temporary plastic wall panels (such as Edgeguard panels) acceptable?
Answer: Yes, temporary plastic wall panel systems such as Edgeguard panels may be utilized, provided they comply with VA Infection Control Risk Assessment (ICRA) requirements, maintain required containment integrity, and are approved by VA Safety and Infection Control prior to installation. Contractor shall coordinate all temporary barrier methods with COR and VA safety staff before use.
1. Question: Who is responsible for the terminal clean of the project area, especially the more sensitive areas such as Operating or Cath Lab?
Answer: The contractor shall be responsible for final cleaning and restoration of all affected work areas upon completion of construction work. In sensitive patient care areas, such as operating rooms, Cath labs, and similar procedure spaces, terminal cleaning will be coordinated by VA (EMS) Environmental Management Service.
1. Question: Please clarify which areas may have work ongoing during daytime hours, and which must be nights only?
Answer: Work hours and allowable access shall be coordinated with the COR, VA Safety, Infection Control, and affected clinical services prior to commencement of work in each area. Non-patient care and administrative areas may generally be worked during normal daytime areas. Work impacting patient care operations or lab research will most likely require after-hours or night work to minimize disruption to hospital operations. The contractor shall coordinate all phase work activities, shutdowns, noise-producing activities, and above-ceiling work with the COR in advance.
1. Question: Please confirm order of precedence for the contract documents. Does SOW prevail over the specifications and construction drawings?

Answer: Contractor shall temporarily support existing speakers above the ceiling structure (secured to building structure/supports, not resting on ceiling tile) while work is being performed. New speakers shall be installed in the existing speaker locations wherever possible. Existing speakers shall remain operational until the new system has been fully installed, tested, and accepted. Do not permanently remove existing speakers or leave locations without speaker coverage prior to successful commissioning of the new system.
Speakers will not be "stored" above ceilings. The speakers will be temporarily supported to structure or ceiling where possible while new system is being installed. This is so the existing speakers remain functional during the construction. The existing system shall not be demolished or turned off until new system is installed, tested, and approved.
1. Question: Can you verify areas that need to use containment carts?
Answer: Use of containment carts shall be required in areas identified by the VA Infection Control Risk Assessment (ICRA) process and as directed by VA Safety and Infection Control personnel. At a minimum, containment carts shall be utilized for above-ceiling work, dust generating activities, and work occurring within or adjacent to occupied patient areas. Contractor shall coordinate all containment requirements with the COR and VA Safety prior to commencing work in each area.
1. Question: Please confirm paging system wiring may be run in the above ceiling space?
