About this file

This is Amendment 0004 to a Department of Veterans Affairs Request for Proposal (RFP) for the AJP-Upgrade Steam Distribution System project at Alvin C. York VA Medical Center in Murfreesboro, Tennessee. The solicitation number is 36C24926R0017, and the project number is 626A4-22-202.

The amendment extends the proposal due date to May 28, 2026 at 1:00 PM Central Time and provides additional Government responses to Requests for Information. Key RFI responses clarify that the Government has approved lowering Requirement #3 thresholds from $5M to $2M for both replacement of below-grade steam line distribution and personnel managing large-scale hospital steam distribution. The amendment also modifies evaluation factors and incorporates FAR clause 52.222-90 addressing diversity, equity, and inclusion discrimination prohibitions. This is a Lowest Price Technically Acceptable (LPTA) source selection reserved for Service-Disabled Veteran Owned Small Businesses (SDVOSB). Evaluation criteria include three factors: Relevant Construction Experience (10 requirements including prior hospital steam distribution projects valued at $2M minimum and $7M for VA projects), Key Personnel Experience (9 requirements for Project Manager/Site Superintendent qualifications), and Past Performance (5 requirements including submission of two Past Performance Questionnaires with satisfactory or better ratings). Proposals must be submitted via email with separate technical and price sections, consecutively numbered on 8.5x11 inch paper in Times New Roman 11-point font. The Department of Veterans Affairs Network Contracting Office 9 administers the solicitation, with John L. Mccomas serving as Contracting Officer.

RFI Questions and Answers 626A4-22-202 AJP-Upgrade Steam Distribution System

Project Location: Alvin C. York VA Medical Center 3400 Lebanon Road, Murfreesboro, TN 37129-1237

1. Factor 1- Can Requirement #3 threshold be dropped to $2M for replacement of below grade steam line distribution on a VA campus?

Answer: The Government has reviewed the request to lower the threshold for replacement of below-grade steam line distribution on a VA campus. The Government has no issue lowering this requirement from $5M to $2M.

2. Factor 2- Can Requirement #3 threshold be dropped to $2M for Personnel managing large-scale hospital steam distribution?

Answer: The Government has reviewed the request to lower the threshold for personnel managing large-scale hospital steam distribution. The Government has no issue lowering this requirement from $5M to $2M.

3. FAR 52.232-5(b)(2) states that the Contracting Officer may authorize payment for materials not yet incorporated into the work. VAAR 852.232-70(d) similarly notes that the Contracting Officer will consider such payments as part of monthly progress payments. However, we have encountered Contracting Officers who interpret this language to mean payment is optional and choose not to approve payment for uninstalled or stored materials. Can the VA confirm whether payment for uninstalled or stored materials will be authorized on this project? If not, it’s critical that contractors are made aware during bidding so they can account for storage, insurance, and carrying costs in their proposals.

Answer: Payment for uninstalled or stored materials will be considered in accordance with RFO 52.232-5(b)(2) and VAAR 852.232-70(d). These provisions allow, but do not mandate, the Contracting Officer to authorize such payments when it is determined to be in the Government’s interest and when sufficient supporting documentation is provided.

At this time, the VA does not guarantee automatic authorization of payment for stored materials on this project. Contractors should plan their proposals accordingly and include any associated storage, insurance, and carrying costs. Any approval for payment of uninstalled materials will be evaluated after award based on project-specific circumstances, supporting documentation, and the Contracting Officer’s determination of benefit to the Government.

4. Quality Control Manager required to be onsite full time with no other duties or can also be the superintendent?

Answer: Follow the Specifications.

5. CQCS - Is an individual Quality Control Specialists that are required for each trade and for Structural, Civil, and Environmental, etc.?

Answer: Follow the Specifications. Per the specification, a single person may cover multiple QC areas provided they are qualified for each designated discipline and workload permits.

6. Are there any major demolition work elements required that are not listed/depicted in the demolition drawings that need to occur in order for new finishes to be installed. If so, will they by identified on the demolition drawings?

Answer: The demolition work required for this project is defined within the demolition drawings and specifications. At this time, the VA is not aware of any major demolition elements beyond those already depicted. If, during construction, concealed or unforeseen conditions are encountered that require additional demolition, such conditions will be handled in accordance with the contract requirements, including notification, Government review, and direction. The Government will ensure that all demolition work known at the time of solicitation is identified within the contract documents.

7. Is there any clearly defined scope of work that falls under delegated design, requiring the contractor to handle the design and engineering? Delegated design can be challenging for general contractors, as it requires completing design and engineering before bidding to accurately estimate costs. If any items are considered delegated design, please either include them in the construction design package or provide a detailed list here.

Answer: The solicitation and construction documents identify all known delegated design elements required for this project. Contractors are responsible only for those delegated design items expressly stated within the specifications and drawings. The Government does not require additional delegated design beyond what is identified in the contract documents.

If any design responsibilities are delegated to the contractor, they will be explicitly described within the specifications. Contractors are not expected to provide design or engineering beyond the listed delegated design elements.

8. Are there any badging requirements for construction workers? If so, what are they? Will every worker need to be badged or just team leaders/escorts? If the VA takes an unreasonable amount of time to process badges, can temporary daily or weekly badges be used until permanent badges are processed?

Answer: All workers will be required to submit for VA badging, including background checks and fingerprinting. Individuals who do not pass the background investigation will not be permitted on campus. Anyone without a badge must be escorted by an individual who has a valid badge. The contractor shall submit badging information at time of award. The COR will provide the process to the successful offeror.

9. Is the contractor responsible for supplying a Submittal Exchange type website?

Answer: Yes, the contractor is responsible for supplying a Submittal Exchange–type electronic submittal management platform.

10. Will the project schedule need to be cost loaded to match the schedule of Values shown on the Pay Applications?

Answer: Yes, the project schedule must be cost-loaded and must align with the Schedule of Values shown on the pay applications.

11. 01 35 26, 1.9 Inspections states: A Certified Safety Professional (CSP) with specialized knowledge in construction safety or a certified Construction Safety and Health Technician (CSHT) shall randomly conduct a monthly site safety inspection. In lieu of a CSP or CSHT certification will an individual with a 30 hour OSHA certification and experience as an SSHO on construction projects be acceptable?

Answer: Follow the Specifications.

EVALUATION FACTORS

This section describes the evaluation process, proposal preparation, the significant factors and sub-factors and criteria to be used in the evaluation process. This procurement action is a Lowest Price Technically Acceptable (LPTA) source selection process in accordance with Revolutionary Federal Acquisition Regulation Overhaul (RFO) 15.103-2. Proposals will be evaluated for acceptability but not ranked using the non-price factors/sub-factors. To be considered for award, an offeror must have an “acceptable” rating in every non-price factor/sub-factor under consideration.

The Government intends to award a single contract to a qualified Service-Disabled Veteran Owned Small Business (SDVOSB) determined responsible in accordance with the RFO, whose proposal conforms to all the requirements in this solicitation and is further determined to meet or exceed the standards of acceptability at the lowest offered price. The Government intends to evaluate proposals and award a contract without discussions with Offerors. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from both a technical and cost standpoint.

The evaluation of offers submitted in response to this Request for Proposal (RFP) solicitation will be conducted utilizing the LPTA selection process. Utilization of this source selection process may result in not all offers being evaluated. The Contracting Officer (CO) upon receipt of offers, will determine eligibility and compliance with the solicitation requirements. The Vendor Information Pages (SBA DSBS registration) will be checked to ensure that any offeror submitting a proposal to perform the work is both listed and verified. All proposals received will also be checked for active registration in the System for Award Management (SAM). Thereafter, the CO will review all proposals to ensure that the minimum proposal submission requirements have been met. Once these requirements have been met, the CO will select and submit for review to the Technical Evaluation Board (TEB) the technical proposal of the lowest priced offeror for consideration. Initially, TEB will not receive any pricing information, only the technical portion of the offeror’s proposal.

The Government will evaluate the three (3) lowest priced proposals for technical acceptability. If any of these are found technically unacceptable, the next lowest priced proposals will be evaluated, and so on. Once three (3) proposals are found to be technically acceptable, no additional proposals will be evaluated. Therefore, all proposals may not be evaluated. NOTE: If less than three (3) proposals are received, then all proposals will be evaluated for technical acceptability.

Award will be made to the lowest price technically acceptable offer.

Price Analysis will be IAW RFO 15.404-1. If price analysis cannot determine fair and reasonableness, the Government reserves the right to complete further cost analysis IAW RFO 15.404(a)(2).

Offerors shall submit the information described below for Factors 1, 2, and 3 in the same order as they appear in this solicitation document. All information must be complete, accurate, and organized in the order presented. Failure to submit the required information may result in a rating of “Unacceptable” and elimination from further consideration. Award will be made on a Lowest Price Technically Acceptable (LPTA) basis.

Proposals are to be submitted via email to the Sr CS, Jeannette L. Morphew and CS, Jen Jamieson. Offerors shall submit one (1) electronic copy of complete proposal (a. Technical & b.

Price) to the address shown below as well as a complete proposal emailed to the email address shown below.

EMAIL: jeannette.morphew@va.gov and jen.jamieson@va.gov

RFO 52.209-7 Information Regarding Responsibility Matters (b) shall be marked. If not marked, the proposal is technically unacceptable and cannot be considered for award.

Technical and Price sections of an Offeror’s proposal will be evaluated independently. Offeror shall separately submit each section as a separate attachment. All pages containing text shall be consecutively numbered, type-written on 8-1/2x11 inch paper with margins of at least one (1) inch and created using a Times New Roman 11-point font. The submitted package should contain two (2) sections, separately bind: a.) Technical Proposal b.) Price Proposal. Each section must therefore be labeled with the following:

1. Construction Company Name

2. Physical Address of the Company

3. Telephone Number

4. Email address

5. VA Project Number (Project 626A4-22-202)

6. VA Project Name (AJP-Upgrade Steam Distribution System)

7. Solicitation number (36C24926R0017)

The TEB shall evaluate the offeror’s proposal against all non-price factors/sub-factors using “ACCEPTABLE” or “UNACCEPTABLE” ratings based upon the definition in the chart below.
