82. The Wage Determination in Attachment 5 is for highway projects, not construction. The correct wage determination for this type of project has the plumbing wages listed incorrectly as the Local Union Identifier was left blank. The wages for plumbing should match the pipefitting wages, as the Union covers both of these trades. We believe that using the incorrect plumbing wages could be a violation of the National Labor Relations Act.

· The Davis-Bacon Act (DBA) Wage Determination, AL20250087, on Attachment 5 is correct for construction projects such as this one. Highway wage rates are on determination No. AL20250157 (not included in this solicitation). Additionally, the VA does not control the issuance of DBA wage determinations. All concerns with the accuracy of individual wage rates and union coverage should be forwarded to the issuing entity, the Department of Labor.
