INSTRUCTIONS TO OFFERORS
PROCEDURES FOR SUBMITTAL OF OFFERS AND PROPOSAL EVALUATION CRITERIA
1. Overview.
• The intent of this solicitation is to issue no more than ten awards to qualified responsive and responsible contractors for this 5-year Construction MATOC for Pittsburgh, Erie, and Butler. Also the government plans to select one contractor from the MATOC pool to provide professional construction services in accordance with the Statement of Work (SOW), Drawings, Specifications, etc. for the UD Emergency Dept Access Renovation project, the seed project for this solicitation, at University Drive Campus VAMC .
• The Government intends to use the “Best Value” tradeoff process source selection approach in accordance with FAR 15.101-1. Award will be made to the responsible offeror whose proposal conforms to the solicitation’s requirements and represents best value to the
Government. The Government reserves the right to award a contract to other than the lowest-priced offeror or other than the most-highly rated offeror. This requirement is being solicited as a tiered approach to SDVOSB, VOSB, HUB ZONE, 8A, and small businesses.
Proposals will be evaluated in that order. SDVOSB is the first tier evaluated and Small
Business is last. If any offers submitted by small business concerns will be evaluated as a group, award priority going to WOSB before other SB concerns that fall into this evaluation tier.
2. Submittal of Proposals.
2.1 Offerors submitting proposals for this project must limit submissions to data essential for evaluation of proposals so that a minimum of time and monies will have been expended in preparing information required herein. However, in order to be effectively and equitably evaluated, the proposals must include information sufficiently detailed to clearly describe the offeror's Technical Ability (Experience, Capability, and Project Controls), Past Performance, and Price, to successfully complete the project.
Innovative, creative, or cost-saving proposals that meet or exceed the requirements should be clearly noted and justified in the proposal.
2.2 Offerors must comply with the detailed instructions for the format and content of the proposal. Proposals that do not comply with the detailed instructions may be rejected.
The Offeror must complete and submitted on a Standard Form 1442. The Offeror must submit a price based on the line items for the seed project. Note: If discussions or negotiations occur, the Government may require additional cost information.
1. Discounts: Prompt payment discounts will not be considered in the evaluation of offers.
2. In the event a minor clerical error has occurred, the Offeror may be given an opportunity to correct the minor error within the constraints of the “clarifications” process or the Contracting Officer determines discussions are required.

Department of Veterans Affairs will evaluate the proposals. SSEB may also include Architect and Engineering firm non-voting members. The identities of the SSEB personnel are confidential, and any attempt by the offerors to contact these individuals is prohibited. The evaluation will be based on the content of the submitted proposal and any subsequent discussions initiated by the Government, as well as information obtained from other sources, e.g., past performance information. Offerors are advised that the technical evaluation and rating of proposals will be conducted in strict confidence in that technical ability and past performance information submitted will be reviewed and rated without knowledge of the price offered. During deliberation, the number and identities of offerors will not be revealed to anyone who is not involved in the evaluation and award process or to other offerors.
3.2 Proposals will be evaluated in accordance with the Evaluation Factors identified below.
Technical Ability and Past Performance are of equal importance, and when combined, are significantly more important than Price.
Evaluation Factor 1 – Technical Ability Evaluation Factor 2 – Past Performance Evaluation Factor 3 – Price
3.3 Offerors will be evaluated in terms of the Offeror’s ability to meet or exceed the project’s requirements as identified in the SOW. This requirement is being solicited as a tiered approach to SDVOSB, VOSB, and small businesses. Proposals will be evaluated in that order. SDVOSB is the bottom tier and Small Business is the top. Proposals demonstrating an ability to exceed specified requirements may be rated higher in those areas than proposals demonstrating only the ability to meet requirements. Offerors are reminded to include their best technical and price terms in their initial offer and not automatically assume that they will have an opportunity to participate in negotiation discussions or be asked to submit a revised offer. In accordance with FAR 15.306(a)(2), if award will be made without conducting discussions, offerors may be given the opportunity to clarify certain aspects of their proposals, e.g., the relevance of an offeror's Past Performance information and adverse Past Performance information to which the offeror has not previously had an opportunity to respond, or to resolve minor clerical errors. The Government intends to make award to a responsible Offeror submitting a conforming proposal without discussions, if deemed to be in the best interest of the Government.
4. Evaluation Factors
4.1 Evaluation Factor 1 – Technical Ability
The sub-factors, listed under Evaluation Factor 1 are of equal importance. An overall rating will be assigned at the Evaluation Factor Level based on all reviewers’ ratings. c) Offeror’s stated capability will be evaluated for managing projects of similar size, dollar value, complexity, conditions, and scope as well as the managing specialty disciplines needed to accomplish the work of this project. These projects do not have to be VA or US Government projects, while those are preferred they are not required.
d) Resumes / Statements of Qualifications for Prime and Sub Contractor Personnel in Key Roles attached will be evaluated to assess the individual skill capabilities and backgrounds as part of the team’s combined capability. The Offeror should clearly identify key personnel proposed for the project, including their trade experience and educational background. All resumes should be complete, including names and job titles for each team member.
e) Offeror’s plan for being able to respond to potentially short notice site visits/proposal meetings (normally within two calendar days but potentially as short as two hours) will be evaluated as an indicator of flexibility and responsiveness.
The Offeror should provide a detailed explanation of how they would respond to short notice meetings, including their approach and capabilities for handling such situations.
f) The named Subcontractors and their history with the Offeror will be evaluated for capability demonstrated: in written references (Exhibit B); by their skill background;
by their ability to work congenially with other Subcontractors; and by the ability for the Prime and Sub Contractor to suitable coordinate their work. The professional working relationship between the Prime and Sub Contractors will be considered.
g) Information concerning Offeror’s scheduling methodology, including steps to produce and meet recovery schedules, when necessary, will be evaluated to determine whether the scheduling capabilities possessed will ensure control of the project schedule throughout the period of performance. The person identified as being responsible for ensuring the schedule is monitored and maintained (ex.
Project Manager) will be evaluated for ability and capability. Offeror’s statements regarding their ability to manage, maintain, and meet project schedules in a challenging supply chain environment will be considered in the capability evaluation.
h) Offeror’s narrative contents detailing project closeout procedures will be evaluated to assess commitment to completing all project requirements in a timely manner, including but not limited to punch lists, training and documentation, Operation and Maintenance Manuals, and as-built drawings.
