This amendment answers vendor questions.
This amendment answers the following vendor questions:
1. Must the SDVOSB prime contractor itself hold the applicable New Jersey asbestos-abatement contractor license, or may the required licensed asbestos work be performed by a properly licensed subcontractor under the SDVOSB prime’s management and contract responsibility?
Response: If asbestos abatement services are being performed by a subcontractor, the licensing requirement only applies to the subcontractor.
1. For purposes of the applicable VA/FAR limitations on subcontracting, please confirm the controlling self-performance requirement for this solicitation and whether work performed by a similarly situated SDVOSB subcontractor may be treated differently from work performed by a nonsimilarly situated subcontractor.
Response: See VAAR clause 8 852.219-75 (a)(1) (ii)
(ii) X General construction. In the case of a contract for general construction, the contractor will not pay more than 85% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs as set forth in 852.219-73or VOSBs as set forth in 852.219-74. Any work that a similarly situated VIP-listed subcontractor further subcontracts will count towards the 85% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.
1. Must bonding capacity be demonstrated at proposal submission, or only when a task order exceeding the stated bonding threshold is issued?
Response: Though the contractor’s bonding capacity is not part of the technical evaluation, the offeror’s bonding capacity shall be requested to ensure they have the proper resources to perform task orders up to the maximum thresholds stated in FAR clause 52.216-19 as part of the Determination of Responsibility before an award can be made.
1. Does the two-hour emergency-response requirement apply to every task order throughout both East Orange and Lyons, and may that response capability be satisfied through an identified local subcontractor/team member?
Response: The two-hour emergency response time requirement applies to both locations but does not apply to every task order. The contractor is required to be able to provide all services listed under this contract on an emergency basis.
The emergency response capability may be satisfied through a local subcontractor. The use of subcontractors or asbestos abatement personnel outside of those indicated in the offeror’s proposal shall not be allowed without prior authorization from the CO or the COR after contract award.
All other terms and conditions remain the same
