About this file

This document contains questions and answers related to a Request for Proposals (RFP) issued by the State of Nevada for an Inmate Communications contract. The RFP covers a variety of inmate services and equipment including tablets, kiosks, inmate telephone systems, video visitation, and digital mail scanning. The RFP is being issued through the NASPO ValuePoint cooperative purchasing program, with Nevada as the lead state and the opportunity open to participation from other states. The contract is expected to have a 4-year base term.

The summary of key financial details includes a current commission rate of 20% for inmate music downloads and 15% for secure email purchases, as well as a tiered annual commission payment structure with the incumbent provider. The State has provided historical call volume, revenue, and deposit transaction data to assist vendors in preparing their cost proposals. Vendors will be required to provide their best and final pricing, which will be evaluated and potentially negotiated on a per-state basis as participating addendums are executed.

9SECURUSTECHSubcontractorsIs subcontracting portions of the services allowed so long as the core products (ITS, Tablets, and Digital Mail) are provided directly by the vendor?

Note: Many ?application based? services are added over time and like the App Store on an iPhone, there is an evolving library of services that those using this contract vehicle.

10SECURUSTECHPricing Sheet ModificationsAre respondents allowed to modify the pricing sheet to accommodate more options?
11SECURUSTECHRequested PricingAre the prices requested in the cost proposal considered ?not to exceed? pricing for all states including Nevada?
12SECURUSTECHSubcontractors vs. SubsidiariesAre wholly owned subsidiaries considered subcontractors under section 4.5.1a of the RFP?
13SECURUSTECHContract TermGiven the significant expense necessary to install tablet networks, will the State consider a 4-year base term so vendors can recover installation costs without requiring the state to come out of pocket for network expenses?
14SECURUSTECHEducation ? GED OptionsAre GED prep courses provided by organizations other than Essential Education/Pearson online high school or I-Pathways allowed?
15SECURUSTECHEducation Provider Options (2.1.1.8)Are educational content providers other than HMH, Cengage, Simon and Shuster, Pearson, Wiley, and Random House acceptable?
16SECURUSTECHRating of Media LibrariesHow will the state rate the quality of music, book, and game libraries?
17SECURUSTECHKiosks and Tablets Docking StationsIf tablet with docking stations can complete all tasks required by this RFP by connecting to Docking stations, are physical kiosks required in the housing units?
18SECURUSTECHFinancial OffersCan a vendor submit multiple/alternative offers?
19SECURUSTECHRFP PresentationsWill there be an in-person presentation?
20SECURUSTECHKiosksAttachment B ? Scope of Work: Section 2.2 refers to ?Kiosks? and the entire section appears to be referring to Kiosks in housing units for the incarcerated population, with the exception of 2.2.2, which refers to Deposit Kiosks, AKA Lobby kiosks, or those outside the housing units utilized for accepting cash.

Is it fair to assume that the only requirements for deposit kiosks are contained in 2.2.2, and the remainder of the 2.2 section is referring to the kiosks used by the incarcerated population in the housing units?

21 SECURUSTECH State Network In multiple places in this RFP the State refers to ?utilization of the state network?. One of the largest expenses associated with deployment of tablet technologies is the deployment of network elements and can therefore have a significant impact on end user pricing.

Can the state detail what areas network access is available in what prisons, and at what bandwidth and port levels?

Without this information or detailed site surveys, it will be impossible to understand where cost can be reduced by using the tate network. Alternatively, if this information is not available, would the State consider removing the ability for vendors to use the state network, and noting that all prices are not to exceed prices, and to the extent state network resources are available, the state reserves the right to negotiate end user rates to adjust for the use of these resources? This will mean all vendors are bidding on the same requirement, and will ensure pricing is ?apples to apples?.

23SECURUSTECHAttachment C, Kiosks-Tablets TabLine 17 ? Music Purchase/Download ? Can the cost sheet be modified to allow for varying costs per song/album based upon charges from artists? For example, certain songs are free while other songs are offered at a low rate with other songs and albums offered at a higher rate.
24SECURUSTECHAttachment C, Kiosks-Tablets TabLine 20 ? Law Library Research Access ? There are numerous Law Library providers that provide applications that can be placed on tablets at no cost. Who is responsible for the actual Law Library licensing cost? If licensing is paid for by the vendor, which Law Library provider should be offered?

For example, many Electronic Books are free while other Electronic Books are offered at a low rate with other Electronic Books offered at a higher rate.

For example, certain Podcasts are free while other Podcasts are offered at a low rate with other Podcasts offered at a higher rate 1 Please confirm that the pricing is not to exceed pricing and is negotiated with participating entities.
29SECURUSTECHDeposits and Trust FundingAttachment B ? Scope of Work: Section 2.2.2 Kiosk Deposits: In 2018 there was a separate tab on the pricing sheet for EFT pricing, and since the KIOSK section of this RFP solicitation has requirements for deposits, would the State want to included that tab again?

135KEEFE1Terms and Conditions1)Per the Terms and Conditions, Section XI, Subsection 11.3 - License of Pre-Existing Intellectual Property.

Please clarify what NASPO defines ?tangible media or products? to indicate.

Also, we anticipate that a number of deliverables under the Master Agreement will involve software and/or related intellectual property which is wholly comprised of Contractor?s Intellectual Property created independent of the Master Agreement. These Contractor Intellectual Property deliverables would fall into one of three categories that will determine the type of license offered by Contractor:

(1) software for use by the government client, not sale, licensed pursuant to a term license that runs concurrently with the term of the Master Agreement;

(2) media players and content (i.e., songs, videos, games, etc.) available on said devices that will be made available under a subscription model or rental where the license to use the player and content will run concurrently with the subscription/rental purchased by the inmate/end user; or

(3) media devices and content sold to the inmate/end user where the inmate/end user will receive a perpetual license to use the Contractor Intellectual Property in the device and content.

Therefore, because granting a blanket ?perpetual license? for all Contractor Intellectual Property is not appropriate for all Contractor offerings, will the State consider amending the language in Section 11.3 to grant licenses based on which of the aforementioned categories the Contractor Intellectual Property falls? In all cases, only the right to use the intellectual property is granted, user cannot transfer the right or make derivative product(s).

Please clarify what is meant by ?examples only.?The information provided in the cost sheet is to assist vendors in getting an understanding of the volume in each state if you were to execute a PA in that state.
147ICSOLUTIONSParticipating State Cost SheetsQ&A Row 39 ? The State answered that cost sheets are ?examples only.? In addition, the cost sheets do not contain an exhaustive list of participating states, nor is the State providing any information (equipment lists, call data, etc.) that would be needed to estimate costs, for any states other than Nevada. As such, does the State require that pricing information be submitted for any state(s) other than Nevada?Vendors are submitting one cost. Costs for other states will be negotiated in PA's.
148ICSOLUTIONSData Linked KiosksQ&A Row 105 ? The State answered, "Vendor must allow kiosks to 'talk' to one another." What types of data are the kiosks meant to share with one another? What is the purpose of having them "talk" to each other?“The kiosks must be networked, not standalone”. Networked kiosks have the ability to access a single central database so every kiosk can offer the same services and if allowed any inmate can use any kiosk. If kiosks were standalone (not on a network) each kiosk would be loaded with data independently of another kiosk. That could result in problems with equity like different songs on one versus another and different access where an inmate in building A can only use the kiosk in building A.
149ICSOLUTIONSITS CommissionQ&A Row 108 ? Will the State please clarify whether a commission is expected for ITS revenue? For Nevada yes. Each participating state may have another requirement.

There is no existing hardware for tablets.
152ICSOLUTIONSInvestigative SolutionQ&A Row 121 ? The State answered ?Minimum of 3% of call volume or have agreed upon investigative solution.? Will the State please clarify an ?agreed upon investigative solution?? Does the State mean that investigative software may be proposed instead of a human monitoring solution?Nevada will consider proposals that provide an investigative solution that may reduce but does not completely replace the percentage of calls requiring a human monitoring solution. Based upon investigative tool(s) proposed, percentage will be negotiated during the PA process.
153ICSOLUTIONSDedicated StaffQ&A Row 138 ? Please clarify, specifically for Nevada, how many part- and/or full-time Site Administrators are provided? And how many dispatch technicians are available?Vendors train & collaborate with NDOC personnel whose functions include very limited troubleshooting of vendor onsite equipment. 155ICSOLUTIONSVideo VisitationDoes the State of Nevada have a preference as to whether video visitation is offered on tablets, kiosks, or both?NDOC preference is to supplement in-person visitation with remote video visitation on tablets. Tablets must provide a secure environment that meets any NDOC security and monitoring guidelines and works independently from the NDOC infrastructure. Vendors are encouraged to provide solutions that balances costs to inmates and family along with revenue generated to cover costs related to providing services via tablet.
156ICSOLUTIONSOnsite Video VisitationDoes the State of Nevada intend to offer remote video visitation only, or should offers also include public kiosks to accommodate onsite video visits?
