About this file

This is an Excess/Umbrella Liability Insurance Descriptor document issued by the County of Volusia, Florida, for ITB 26-B-37JJ, Rigging Services for Ocean Center. The County seeks a qualified rigging contractor to serve as the exclusive provider of comprehensive rigging services for the Ocean Center's convention center (93,028 square feet with 32-foot ceilings and 3,500-pound load capacity per point) and arena facilities (7,010 fixed seats, 45-foot ceiling height, and permanent rigging grid with W14x90 and W14x99 beams). The scope encompasses motor and chain hoist provision and operation, truss system design and installation, rigging hardware supply, lighting and audio rigging, scenic rigging, and safety equipment provision for approximately 110 events annually. All rigging personnel must hold certifications from ETCP, USITT, or NCCCO. Questions were due March 25, 2026, at 11:59 p.m. EST, with responses required by April 8, 2026, at 3:00 p.m. EST via the County's eProcurement Portal. No pre-solicitation conference was held. The resulting agreement will provide an initial three-year term with two optional one-year renewals, contingent upon mutual written agreement and County Council approval.

The contractor must maintain comprehensive insurance coverage including $1,000,000 Commercial General Liability per occurrence with rigger's liability endorsement, $4,000,000 excess liability, $1,000,000 auto liability combined single limit, $1,000,000 professional liability per incident, and workers' compensation with waiver of subrogation. The excess liability policy shall be written on a follow-form basis, contain a dropdown coverage provision and duty to defend, and provide coverage for bodily injury and property damage during loading, unloading, rigging, installation, and disassembly operations. The policy must be endorsed with a waiver of subrogation in favor of the County and other required additional insureds and shall be primary and non-contributory to any County insurance. Annual price redetermination may be requested based on documented increases in wages, fuel, or materials costs using the Employment Cost Index or Producer Price Index, with full payment on undisputed invoices within twenty business days. The County offers local preference of up to five percent for qualified local businesses. No specific budget amount or award value is disclosed in the available documentation.

Text version

Excess/Umbrella Liability. Umbrella or Excess Liability policies may be used to obtain the total limits of liability required in Figure 1. These policies shall be written on a follow-form basis subject to the same terms, definitions, exclusions and conditions as the primary policies. Umbrella policies unable to obtain a follow form basis will be accepted if the coverage provided under the policy expands the coverage and does not create coverage gaps between the primary policy and the umbrella policy. These policies shall contain a dropdown coverage provision as well as a duty to defend. Evidence of such coverage should clearly demonstrate the underlying coverages/policies that are included.

The Contractor shall obtain an excess liability policy in addition to the commercial general liability with a limit of no less than the amount shown in Figure 1. Policy shall be endorsed with Rigger’s Liability to include coverage for Bodily Injury and Property Damage. Policy shall provide coverage for damage to property of others while property is under Contractor’s care, custody, and control for purposes of loading, unloading, rigging, installation, and disassembly of machinery or equipment being moved, erected, hoisted, lifted, or lowered. Policy shall provide for operations incident to a rigging project and include coverage for the transportation and storage of property by Contractor or others on behalf of Contractor.

Policy shall be endorsed to provide a waiver of subrogation in favor of the County and any other party required by this Agreement to be named as an additional insured. Policy shall be endorsed to be primary and non-contributory to any insurance or self-insurance maintained by the County or any other party required by this agreement to be named as an additional insured.
