About this file

This is an Excess/Umbrella Liability Insurance Descriptor for rigging services at the Ocean Center, a convention center and arena facility operated by Volusia County, Florida. The County is seeking qualified rigging contractors to provide exclusive rigging services for overhead rigging systems across both facilities, which collectively host approximately 110 events annually. The Convention Center comprises 93,028 square feet with 32-foot ceiling heights and a maximum load-bearing capacity of 3,500 pounds per load point, while the Arena features 45-foot ceiling heights, a permanent rigging grid with varying beam specifications, and a 172-foot-5-inch by 250-foot playing surface. The selected contractor will provide comprehensive rigging services including motor and chain hoist services, truss systems design and installation, rigging hardware supply, lighting and audio rigging, and scenic rigging support. The contractor must also maintain facility equipment including two forklifts, two scissor lifts, and one boom lift with 60-foot working height capability.

The excess liability insurance requirements mandate that contractors obtain an excess liability policy with limits no less than those specified in Figure 1 of the agreement, endorsed with Rigger's Liability coverage for bodily injury and property damage. The policy must provide coverage for damage to property under the contractor's care, custody, and control during loading, unloading, rigging, installation, and disassembly operations, as well as coverage for transportation and storage of property. The policy shall be written on a follow-form basis consistent with primary policies or, if follow-form is unavailable, must expand coverage without creating gaps. The excess liability policy must include a dropdown coverage provision, duty to defend, waiver of subrogation in favor of Volusia County and other required additional insureds, and must be endorsed as primary and non-contributory to any County or third-party insurance coverage.

Text version

Excess/Umbrella Liability. Umbrella or Excess Liability policies may be used to obtain the total limits of liability required in Figure 1. These policies shall be written on a follow-form basis subject to the same terms, definitions, exclusions and conditions as the primary policies. Umbrella policies unable to obtain a follow form basis will be accepted if the coverage provided under the policy expands the coverage and does not create coverage gaps between the primary policy and the umbrella policy. These policies shall contain a dropdown coverage provision as well as a duty to defend. Evidence of such coverage should clearly demonstrate the underlying coverages/policies that are included.

The Contractor shall obtain an excess liability policy in addition to the commercial general liability with a limit of no less than the amount shown in Figure 1. Policy shall be endorsed with Rigger’s Liability to include coverage for Bodily Injury and Property Damage. Policy shall provide coverage for damage to property of others while property is under Contractor’s care, custody, and control for purposes of loading, unloading, rigging, installation, and disassembly of machinery or equipment being moved, erected, hoisted, lifted, or lowered. Policy shall provide for operations incident to a rigging project and include coverage for the transportation and storage of property by Contractor or others on behalf of Contractor.

Policy shall be endorsed to provide a waiver of subrogation in favor of the County and any other party required by this Agreement to be named as an additional insured. Policy shall be endorsed to be primary and non-contributory to any insurance or self-insurance maintained by the County or any other party required by this agreement to be named as an additional insured.
