About this file

This document is Appendix A, detailing a debris removal contract with specific guidelines for post-event debris management. The appendix outlines two primary debris estimate scenarios: less than 500,000 cubic yards and greater than 500,000 cubic yards. For smaller debris estimates, contractors have 30 days to complete three debris passes, with a first pass completion deadline of 20 days from the Notice to Proceed (NTP). For larger debris estimates, the timeline extends to 90 days with a 40-day first pass completion deadline. The contract requires specific daily minimum hauling capacities that vary based on the debris estimate and the time elapsed since the NTP.

The contract includes financial incentives and penalties to ensure timely performance. Liquidated damages of $10,000 per day will be assessed if the daily minimum required hauling capacity is not met. Conversely, an incentive of $10,000 per day (up to ten days) will be offered if the first pass is completed before the specified First Pass Completion Deadline. The hauling capacity requirements are flexible, with an allowance for the county to adjust the daily minimum in writing, and the operational rate is expected to maintain at least 80% of the specified capacity. The document provides detailed cubic yard requirements for different timeframes: 48 hours, 120 hours, and 240 hours from the Notice to Proceed.

1 The Debris Estimate is the estimate of debris generated from the event prepared by the County's Debris Monitor.

2 Daily Minimum Required Hauling Capacity is the sum of the load capacity of all hauling units. The minimum required capacity is equal to the total capacity of hauling units required to complete three (3) passes within the time allocated in column B and C. A daily average operational rate of 80% must be maintained. Due to changing operational needs as collection efforts progress or unforeseen circumstances, the daily minimum required hauling capacity may be reduced if approved in writing by the County.

*Liquidated damages shall be assessed each day when the daily minimum required capacity is not met ($10,000 per day).

*Incentive shall be offered if first pass is completed before the relevant First Pass Completion Deadline. The incentive is $10,000 per day (maximum of ten (10) days).
