10. Bid Evaluation and Awarding

10.1. Information Requested and Not Furnished

The information requested and the manner of submission is essential to permit prompt evaluation of all bids. Accordingly, OIAA reserves the right to declare as non-responsive and reject any bids in which information is requested and is not furnished or when a direct or complete answer is not provided.

10.2. Right to Verify Information

OIAA reserves the right to verify all submitted information, including contacting the referenced clients. All information stated in the bid shall be factual, truthful and shall not be misrepresented in any manner. Any information stated in the bid found to be a misrepresentation of past experiences shall be considered as grounds for disqualification of the bid.

10.3. Evaluation of Bids and Bid Errors

The bidder is liable for all errors or omissions committed by bidder in preparing the bid and for any consequences due to the errors or omissions. Bidders will not be allowed to alter, correct, or amend bid documents after the due date and time of submission.

10.4. Mathematical Corrections on Bids

In the case that the amount listed in the Total Price is not the correct sum of the Unit Price multiplied by the Quantity, the Unit Price amount shall govern and the Total Price will be corrected. An exception to this is if, in the view of the OIAA, the Total Price is clearly and obviously correct, the Unit Price is clearly and obviously incorrect, and the intent of the bidder is clear and obvious, then the Unit Price will be corrected and the Total Price unaltered. In either case, the Project Total amount will be adjusted accordingly.

If the Project Total amount listed is not the correct sum of the Total Price, the Total Price shall govern, and the Project Total will be corrected accordingly.

In the case that the amount listed in the Unit Price of a Bid Alternate identified as “Must Match

Base Bid Unit Price” does not match the Unit Price of the Base Bid, the Base Bid Unit Price amount shall govern, and the Total Price will be corrected along with the Project Total amount accordingly.

10.5. Incorrect Bid Information

If OIAA determines that a bidder has provided incorrect information for consideration in the evaluation process, which the bidder knew or should have known was materially incorrect, that bidder may be deemed non-responsive and the bid may be rejected.

10.6. Prohibition of Alternate Terms and Conditions

Bidders may not submit their own contract terms and conditions in response to this IFB. If a bid contains supplemental terms and conditions, OIAA, at its sole discretion, may determine the bid to be a non-responsive counter offer, and the bid may be rejected.

10.7. Waiver of Minor Administrative Irregularities

OIAA reserves the right, at its sole discretion, to waive minor administrative irregularities contained in any bid submitted for this IFB.

11. Required Licenses

The procedures and time limits outlined in this section are mandatory and are the bidder's/proposer’s sole and exclusive responsibility. Failure to comply with these procedures will result in deeming the bid/proposal non-responsive.

Prime Bidder Licensing and Self-Performance Requirements

The Project will be delivered using the Design-Build method. The Prime Bidder/Proposer shall hold a valid and active California contractor’s license in the classification(s) required to perform the Work, including the following:

• Class A – General Engineering Contractor

• Class B – General Building Contractor

• C-10 – Electrical Contractor

• C-16 – Fire Protection Contractor

The Prime Bidder/Proposer shall self-perform a minimum of thirty-five percent (35%) of the total Project Work, excluding work specifically identified by the Airport as eligible for subcontracting.

Invitation For Bid #2026-IFB-086 - 2027PS001 - Campus-Wide Fire Alarm System Replacement 17

The Prime Bidder/Proposer shall be properly licensed in accordance with the California Business and Professions Code. Failure to possess the required license classification(s) at the time of bid/proposal submission, or failure to maintain the required license(s) throughout the Project, shall result in the Bid/Proposal being deemed non-responsive and subject to rejection, pursuant to California Business and Professions Code Section 7028.15(e).

The Prime Bidder/Proposer shall be responsible for ensuring that all subcontractors performing portions of the Work hold the appropriate and valid California contractor’s license classification for the work they perform.

12. Bid Bond/Proposal Bond

The procedures and time limits outlined in this section are mandatory and are the bidder's/proposer’s sole and exclusive responsibility. Failure to comply with these procedures will result in deeming the bid/proposal non-responsive.

Bid/Proposal Bond:

The bid/proposal must be accompanied either by a check certified by a responsible bank, or a cashier’s check issued by a responsible bank, or a corporate surety bond of a responsible surety company for an amount not less than ten percent (10%) of the amount bid, payable to the order of the Ontario International Airport Authority, as a guarantee that the bidder/proposer to whom the contract is awarded will enter into the proposed contract and furnish the required bonds and as liquidated damages for any loss which may accrue from failure to do so; such payment, however, not to preclude recovery by OIAA or any amount over and above said sum to which OIAA sustains damage by reason of such failure or refusal. No bid will be considered unless accompanied by such check or bond.

If submitting a bond, bidders/proposers must use the bid bond provided herewith.

Bidders/proposers are hereby advised that this bond guaranteeing to OIAA the full 10% penal sum thereof, regardless of the OIAA’s actual damages should the bidder/proposer fail to enter into the contract and furnish the required bonds, will be acceptable. Submission of an incorrect bond may cause the bid to be non-responsive and result in its rejection.

OIAA reserves the right to cash such check and hold the proceeds. The proceeds will become the property of OIAA if the bidder to whom the contract is awarded fails or refuses to execute the contract and bonds within thirty (30) days after the contract is awarded. Otherwise, the check or bond accompanying the successful bid will be returned upon execution of the contract. Bonds and checks accompanying the rejected bids will be returned upon award of the contract.

Note: Proposers are required to submit the original signed and notarized Bid/Proposal Form and Bond to the OIAA within seven (7) working days from bid/proposal submittal to
