IOI REHABILITATION PHASES 4 & 5

Pre-Proposal Conference

Meeting Date: May 04, 2022 at 9:30 am Location: USIBWC Nogales Field Office

Please understand that the Pre-Proposal Conference is intended to aid Contractors and ensure that misunderstandings are minimized to provide a better project for all involved. However, the Government is not bound by verbal responses. Contractors shall submit written questions to the Contracting Officer (CO) for official clarification and responses. All written questions and answers received prior to the cutoff date shall be added to this Solicitation as an amendment;

only these written responses bind the Government during performance of this Contract.

Items of Note for Contractors

1. There are multiple ways to access the project via public roadways. Some areas can only be accessed through private property or a right-of-way (ROW).

a. The access points and work are located within multiple properties and ROWs, including City of Nogales, ADOT, Santa Cruz County, and UPRR.

b. Reference the GC Series Sheets in the drawings for maps of the parcel data along the

IOI pipeline.

c. The City of Nogales has a pipeline easement from various property owners for the

IOI that is 50 feet wide as shown in the drawings.

d. Contractor shall decide which routes to utilize for access to the work sites and coordinate with each respective property owner for permission and agreement or construction easement to use their property.

e. Access to some manholes located near or along the slopes of the Potrero Creek may be constrained or limited due to the grades, surrounding vegetation, or riprap.

f. Approved traffic control plans through the City of Nogales, Santa Cruz County, or ADOT, as applicable, is required for work within or adjacent to public street/road rights-of-way and any access points. Section 01.55.26 1.8.

g. Roads and parking areas within or near the pipeline easement shall not be blocked off.

h. The Contractor's activities shall not hinder the normal operations of any adjacent or nearby owners, tenants, occupants, businesses, customers, etc. and shall maintain access at all times to the existing facilities.

2. UPRR ROW

a. Significant part of construction for the IOI is within the UPRR ROW.

b. Work is not permitted until the Contractor has obtained all their necessary rights of entry from UPRR under the Maintenance Agreement that USIBWC is in process of obtaining. This Maintenance Agreement for the project may take up to 180 days past the Contract award.

c. UPRR Contractor Right of Entry (CROE) Agreement is required for submission including their applicable fees, insurance policies, and any proposed work plans.

191BWC22R0005 Page 2 of 6

(1) A separate CROE Agreement is required for the prime contractor and each subcontractor to work within the UPRR ROW. Once USIBWC obtains the maintenance agreement, contractors may proceed with submitting their applications.

d. A separate, individual utility installation application and fee is required for the bypass system for any portion to be installed within UPRR ROW and crossing the tracks.

e. See Section 00.31.43 for additional information regarding work within UPRR ROW.

f. No construction or equipment is permitted within 15 feet of the nearest track centerline.

g. A flagman is required any time equipment comes within 25 feet of the centerline of the tracks. Contractor shall request the services of a flagman directly from UPRR or RailPros, as directed by UPRR. Only flagman from UPRR or a company approved by UPRR shall be used for the construction observation and flagging near the tracks.

h. Contractor is responsible for any shoring system required for the protection of the UP railways and tracks during excavation for pipe or manholes within their ROW Zone A. This includes all reviews and approvals by UPRR prior to installation.

Contractor shall comply with the current Railroad standards and requirements for design and construction of all shoring. See Section 31.40.00 for more details.

i. Track and ground monitoring are required continuously 24/7 per UPRR guidelines when construction is within Zone A.

3. Must maintain continuous access through site to USIBWC employees, UPRR crews and railroad employees, U.S. Customs and Border Patrol, and city/county/state officials. The Contractor must schedule operations and coordinate all work with these entities.

4. Diversion of Water (Section 02.02.00)

a. Diversion of water with Phases 4 & 5 for the IOI rehabilitation is anticipated to be minimal. All other diversion of water will depend on the Contractor's proposed bypass alignment.

b. Contractor shall divert any water to access their work areas within the waterways, if needed.

c. A few IOI manholes are located along drainage structures or waterways, such as the Potrero Creek, as well as their tributaries. The Potrero Creek is continuously flowing and is subject to unexpected flooding or overflows of stormwater and wastewater.

d. Flows within the Potrero Creek can increase suddenly due to standard practice upstream in Mexico of diverting their sanitary sewer overflows to the stormwater in the Wash.

e. These overflows of wastewater mixing with stormwater in the Nogales Wash have resulted in ADEQ classifying both the Nogales Wash and Potrero Creek as Impaired Waters. Contractor shall use caution when handling flows in these streams.

f. Historical data for flows in the Nogales Wash may be found in Section 00.31.19.

5. Bypass Piping

a. Contractor shall determine their own alignment and obtain any landowner agreements or easements for use of the various properties to laydown piping.

Contract drawings only show a potential bypass alignment.

b. Permitting from UPRR:

191BWC22R0005 Page 3 of 6

(1) For bypass system alignment, permit application will likely require UPRR's "Exhibit A: Overhead Pipeline Crossing" for any temporary crossings below the tracks. Note that although this exhibit shows an overhead pipeline structure, bypass pipe(s) crossing under the tracks through an existing UPRR bridge or culvert does not require this type of structure but UPRR still refers to this type of crossing as "overhead".

(2) For bypass system alignment, permit application will likely require UPRR's "Exhibit A: Non-Flammable Liquid Pipeline" for a temporary encroachment at the closest point from the bypass pipeline to the centerline of track.

(3) Bypass piping installed near or through UPRR structures shall not reduce the existing structure’s hydraulic opening greater than 5%.

(4) Maximum allowable duration for installation of temporary bypass piping is 6 months.

(5) See Section 00.31.43 1.10 E. for additional requirements regarding temporary bypass piping alignment installed within UPRR ROW.

c. Bypassing performed during monsoon season will have IOI flows significantly higher than usual because of combined storm flows coming from Mexico.

d. Flows within the IOI can increase suddenly due to standard practice upstream in Mexico of diverting stormwater overflows into the sewer line. O&M at times also diverts stormwater flows from the Nogales Wash into the IOI because of high sewage content found in the stormwater.

6. No work within the waterways, if needed, shall be performed during the monsoon season, which typically occurs between mid-June through September.

7. Although work is not directly adjacent to the international border with Mexico, illegal drug trafficking activities from Mexico could impact the IOI.

a. Contractor shall fully cooperate with the directions of the U.S. Customs and Border

Patrol in the event of a security alert and may be required to stop work for security reasons in the area.

8. Many properties adjacent to work.

a. Contractor is required to notify adjacent entities/landowners/renters/occupants of construction work. See Section 02.01.00 1.13 B.1.

b. Contractor is required to notify adjacent entities/landowners/renters/occupants of seeding. USIBWC has had significant issues with people spraying herbicides to stop the growth of weeds on the areas that are revegetated. See Section 02.01.00 1.13 B.2.

9. Davis Bacon project

a. Applies to all subcontractors.

b. Certified payrolls required for all workers, including truck drivers (unless owner-operator).

c. Owner-operators have special reporting requirements.

d. Federal minimum wage for Contractors of $15/hour applies regardless of wage determination.

10. SF-1413 forms are required for all subcontractors. This includes service providers but not suppliers.

191BWC22R0005 Page 4 of 6

11. Review requirements for Safety and Health Officer. Section 01.35.23 1.12.

12. CPR and first aid required for all employees onsite, including subcontractors. Section

01.35.23 1.19.

13. Prime contract and all subcontractors working onsite during any month shall complete

Form 153 (Monthly Exposure and First Aid Report). Sections 01.35.23.

14. Construction Quality Control Systems Manager must be an engineer and shall have no other duties on the project. Section 01.45.00 1.11.

15. Testing laboratories shall be unaffiliated with the Construction Contractor and with any part of the design of this project (URS/AECOM and Terracon). Section 01.43.26 1.14.

16. All engineering test results shall be signed and sealed by an Arizona professional engineer.
