191BWC21R0002
Pre-Proposal Conference
Meeting Date: February 23, 2021 at 9:30 am Location: USIBWC Nogales Field Office
Please understand that the Pre-Proposal Conference is intended to aid Contractors and ensure that misunderstandings are minimized to provide a better project for all involved. However, the Government is not bound by verbal responses. Contractors shall submit written questions to the Contracting Officer (CO) for official clarification and responses. All written questions and answers received prior to the cutoff date shall be added to this Solicitation as an amendment;
only these written responses bind the Government during performance of this Contract.
Items of Note for Contractors
1. There are multiple ways to access the project via public roadways. Some areas can only be accessed through private property or a right-of-way (ROW).
a. The access points and work are located within multiple properties and ROWs, including City of Nogales, ADOT, Santa Cruz County, and UPRR.
b. Reference the GC Series Sheets in the drawings for maps of the parcel data along the
Trunkline and IOI pipeline and temporary easements available for each phase.
c. The City of Nogales has a pipeline easement from various property owners for the
Trunkline/IOI that ranges between 40-50 feet wide as shown in the drawings.
d. Contractor shall decide which routes to utilize for access to the work sites and coordinate with each respective property owner for permission if a temporary easement is not shown in the drawings.
e. Access to the Phase 2 Trunkline between Manhole Nos. 1-13 within the existing covered floodway, Morley Tunnel, is restricted. The only entrance into the existing Tunnel is from the Nogales Wash at Manhole No. 13. Coordinate with the U.S.
Customs and Border Patrol for construction access into the tunnel.
f. Access to some manholes located along the slopes of the Nogales Wash and Potrero Creek may be constrained or limited due to the grades, surrounding vegetation, or riprap.
g. USIBWC does not require a traffic control plan for our property, but you will need approved plans through the City of Nogales, Santa Cruz County, or ADOT, as applicable, for work within or adjacent to public street/road rights-of-way and any access points. Section 01.55.00 1.8.
2. Temporary Construction Easements (TCE)
a. There are some temporary construction easements (TCE) available for the project shown in the GC Series Sheets of the drawings. These are the only easements obtained by IBWC for the project.
b. Any additional construction easements required are the responsibility of the Contractor.
191BWC21R0002 Page 2 of 6
c. TCE agreements have specific requirements prior to access and land use that must be adhered to including submitting a work plan to each respective property owner.
d. The Contractor shall maintain access at all times for all owners, tenants, occupants, customers, etc. to the existing facilities
e. Roads and parking areas within or near the TCEs and pipeline easement shall not be blocked off.
f. The Contractor's activities and/or temporary use of property shall not hinder the normal operations of any owners, tenants, businesses, etc.
3. Amendment A00004 issued
a. Additional work for IOI, manhole and wash repairs.
b. New drawings and specifications for this work have been issued.
c. Manhole 86 bank erosion to be stabilized with riprap.
d. Concrete encasement of piping within creek at crossing between Manhole 86-87.
e. Manhole 93 slope erosion repair provides two options to construct.
4. Sequence of Work
a. Phases shall be completed sequentially. Phase I shall be completely constructed before Phase II. If the optional Phase III is awarded for construction, all work for Phase II shall be completely constructed before Phase III may commence.
b. The work for the Manhole 86 riprap, RCP encasement, and Manhole 93 slope repair is critical. This work shall commence at NTP concurrent to or prior to the start of Phase I and shall be prioritized for completion once mobilization is allowed and all required permits and rights of entry for these areas have been approved.
5. UPRR ROW
a. Significant part of construction for the Trunkline and IOI is within the UPRR ROW.
b. Work is not permitted until the Contractor has obtained all their necessary rights of entry from UPRR under the Maintenance Agreement that USIBWC is in process of obtaining. This Maintenance Agreement for the project may take up to 120 days past the Contract award.
c. UPRR Contractor Right of Entry (CROE) Agreement is required for submission including their applicable fees, insurance policies, and any proposed work plans such as for bypass system.
d. A separate CROE Agreement is required for the prime contractor and each subcontractor to work within the UPRR ROW. Once USIBWC obtains maintenance agreement, contractors may proceed with submitting their applications.
e. See Section 00.31.43 for additional information regarding work within UPRR ROW.
f. No construction or equipment is permitted within 15 feet of the nearest track centerline.
g. A flagman is required any time equipment comes within 25 feet of the centerline of the tracks. Contractor shall request the services of a flagman directly from UPRR or RailPros, as directed by UPRR. Only flagman from UPRR or a company approved by UPRR shall be used for the construction observation and flagging near the tracks.
h. Contractor is responsible for any shoring system required for the protection of the UP railways and tracks during excavation for pipe or manholes within their ROW Zone A and Zone B. This includes all reviews and approvals by UPRR prior to installation. Contractor shall comply with the current Railroad standards and
191BWC21R0002 Page 3 of 6 requirements for design and construction of all shoring. See Section 31.40.00 for more details.
i. Track and ground monitoring are required continuously 24/7 per UPRR guidelines when construction is within Zone A.
j. Any additional requirements for UPRR will be provided in the next Amendment.
6. Must maintain continuous access through site to USIBWC employees, UPRR crews and railroad employees, U.S. Customs and Border Patrol, and city/county/state officials. The Contractor must schedule operations and coordinate all work with these entities.
7. Diversion of Water
a. Contractor shall divert water to access their work areas within the waterways.
b. Several Trunkline/IOI manholes are located within drainage structures or waterways, such as the Morley Tunnel, Nogales Wash and Potrero Creek, as well as their tributaries. These are continuously flowing and are subject to unexpected flooding or overflows of stormwater and wastewater.
c. Flows within the Nogales Wash and Potrero Creek can increase suddenly due to standard practice upstream in Mexico of diverting their sanitary sewer overflows to the stormwater in the Wash.
d. These overflows of wastewater mixing with stormwater in the Nogales Wash have resulted in ADEQ classifying both the Nogales Wash and Potrero Creek as Impaired Waters. Contractor shall use caution when handling flows in these streams.
e. Historical data for flows in the Nogales Wash may be found in Section 00.31.19.
8. Bypass Piping
a. Contractor to determine their alignment and obtain any landowner agreements or easements for use of the various properties to laydown piping.
b. Permitting from UPRR:
(1) For bypass system alignment, CROE application will require UPRR's "Exhibit A: Non-Flammable Liquid Pipeline" for any temporary crossings below the tracks and for the temporary encroachment at the closest point from the bypass pipeline to the centerline of track.
(2) Bypass piping installed near or through UPRR structures shall not reduce the existing structure’s hydraulic opening greater than 5%.
(3) Maximum allowable duration for installation of temporary bypass piping is 6 months.
c. Bypassing performed during monsoon season will have IOI flows significantly higher than usual because of combined storm flows coming from Mexico.
d. Flows within the IOI can increase suddenly due to standard practice upstream in Mexico of diverting stormwater overflows into the sewer line. O&M at times also diverts stormwater flows from the Nogales Wash into the IOI because of high sewage content found in the stormwater.
9. No work shall be performed within the tunnel or waterways during the monsoon season, which typically occurs between mid-June through September.
191BWC21R0002 Page 4 of 6
10. A portion of the work is directly adjacent to the international border with Mexico. The Trunkline is periodically used for illegal drug trafficking across the border.
a. Contractor shall fully cooperate with the directions of the U.S. Customs and Border
Patrol in the event of a security alert and may be required to stop work for security reasons in the area.
11. Nogales Wash channel lining and structures adjacent to work shall be protected. This includes keeping soil from falling into concrete channel.
12. Many properties adjacent to work.
a. Contractor is required to notify adjacent entities/landowners/renters/occupants of construction work. See Section 02.01.00 1.13 B.1.
b. Contractor is required to notify adjacent entities/landowners/renters/occupants of seeding. USIBWC has had significant issues with people spraying herbicides to stop the growth of weeds on the areas that are revegetated. See Section 02.01.00 1.13 B.2.
