About this file

This is an instructional document issued by the Ohio Department of Commerce Division of Industrial Compliance and Labor Bureau of Wage & Hour Administration establishing requirements for certified payroll reports on projects subject to Ohio's Prevailing Wage Law under Ohio Revised Code Chapter 4115. The document provides detailed guidance for general contractors and subcontractors on the Payne Avenue Improvements project in Cleveland, Ohio, regarding mandatory payroll reporting and prevailing wage compliance. The instructions specify that all employees performing physical labor, including corporate officers, partners, and salaried employees, must be reported and paid at the prevailing wage rate, with separate line entries required for employees working multiple classifications. Employers must document employee names, addresses, Social Security numbers, work classifications, hours worked by day and date, straight time and overtime hours, and project gross wages. All hours worked beyond 40 hours per week must be compensated at the appropriate overtime rate calculated as time and one half the base rate listed in the prevailing wage schedule plus fringe benefits at straight time rate.

The certified payroll report heading must include the employer name and address, project name and location with county, contracting public authority information, week ending date, payroll number sequence, page indicator, and project number. Employers may pay the total prevailing wage rate entirely through base rate, through approved fringe benefit plans as listed in the prevailing wage schedule, or through a combination of base rate and approved plan payments. Fringe benefits, which include employer contributions to health insurance, life insurance, retirement plans, bonuses, profit sharing, sick pay, holiday pay, personal leave, vacation, and education or training programs, may be paid on an hourly basis or calculated as a yearly contribution divided by hours actually worked or 2,080, whichever is lesser. While use of the Department's form is not mandatory, all required information must be included in submitted reports, and forms may be obtained from the Ohio Department of Commerce Bureau of Wage & Hour Administration at 6606 Tussing Road, P.O. Box 4009, Reynoldsburg, Ohio 43068, or by calling (614) 644-2239.
