About this file
This is a Northern Ireland Fair Employment Practices Disclosure form required by the City of Cleveland, Ohio for the Payne Avenue Improvements project. The disclosure is mandated by Codified Ordinance Sec. 181.36 and must be completed by all contractors and subcontractors holding more than fifty percent (50%) interest in the proposed contract prior to contract award. Contractors must certify their engagement status in Northern Ireland business activities and either confirm non-engagement or demonstrate compliance with fair employment standards. The form provides three disclosure options: confirmation of no business operations in Northern Ireland, disclosure of existing Northern Ireland business engagement, or attestation that the contractor and all identified enterprises are taking lawful and good faith steps to comply with the MacBride Principles for Fair Employment in Northern Ireland.
Failure to submit accurate disclosures carries significant penalties. Any contractor or subcontractor determined to have made a false statement will be declared in default of contract and subject to applicable default remedies. Additionally, contractors failing to cure such a default will be automatically excluded from bidding on any City of Cleveland goods or services for a two-year period. The term "controlling shareholder" is defined as any shareholder owning more than fifty percent (50%) of corporate stock or more than twenty-five percent (25%) if no other shareholder owns a larger share. Contractors may obtain a copy of the MacBride Principles from the Office of the Commissioner of Purchases and Supplies or may submit supporting documentation demonstrating compliance in lieu of checking the applicable certification box.
