About this file
This document is the Supplemental General Conditions (Part C) for a design-build contract administered by the City of Cleveland's Mayor's Office of Capital Projects (MOCAP), Division of Architecture and Site Development (DASD), for the Payne Avenue Improvements project in Ohio. The Supplemental General Conditions amplify and modify the General Conditions to establish contractual requirements for the Contractor's performance of all work, including labor, materials, equipment, and services necessary for project completion. Key responsibilities include submission of a Schedule of Values, construction progress schedule, and list of subcontractors prior to or at the Pre-Construction Meeting; weekly progress meetings at the project site; maintenance of a full-time superintendent; preparation and approval of a Construction Schedule; provision of temporary facilities including power, sanitary facilities, heat, construction offices, and fire protection; and compliance with all safety, environmental, and regulatory requirements. The Contractor must secure performance bonds, provide builder's risk insurance with the City as an additional insured, and maintain all insurance through the guarantee period. Submittals including Shop Drawings, Product Data, and Samples must be submitted to the Architect in PDF format or three opaque copies with the Contractor's approval stamp prior to procurement or installation.
The Contract Amount comprises the Bid Price, Allowances, and Contingency Allowance as approved by the Board of Control, with liquidated damages assessed if Final Acceptance is not achieved by the Scheduled Completion Date at rates ranging from $25 to $1,000 per day depending on the original contract amount. Allowances and Contingency Allowance funds may only be expended upon written authorization via Field Clarification or Change Order from the City. For Changes in the Work performed by the Contractor, the City reimburses actual material costs plus 10% markup, labor costs using prevailing wage rates plus taxes, fringe benefits and 10% overhead and profit, and equipment costs based on the Rental Blue Book or actual invoiced amounts for rented equipment plus 5% markup. Subcontractor work is reimbursed at itemized cost plus 5% for the Contractor's overhead and profit. The Contractor must obtain all necessary permits and governmental fees, provide record drawings in AutoCAD format, and complete a twelve-month Guarantee Period commencing at Final Acceptance during which all defective work must be corrected within ten working days of written notice. Final Acceptance is contingent upon submission of lien releases from all subcontractors and suppliers, consent of surety to final payment, record drawings and specifications, maintenance manuals, warranties, spare parts, and completion of all punch-list items.
