About this file

This document is an Amendment to an Original Agreement between Dallas Independent School District and a Service Provider, implemented to ensure compliance with Texas Education Code Section 22A.052 regarding the investigation and reporting of service provider misconduct. The amendment establishes mandatory background check requirements for all service provider employees, subcontractors, agents, and other personnel who may have direct or indirect contact with students prior to service provision. Service providers must notify the District within 24 hours of becoming aware of any allegations of inappropriate interactions with students, including talking, touching, staring, or contributing to a hostile or offensive learning environment. The amendment requires full cooperation with District investigations, provision of requested employee information including social security numbers to facilitate Texas Education Agency (TEA) reporting, and documentation of employment actions taken following substantiated findings. Pending investigation outcomes, service providers must immediately remove and prohibit implicated employees from providing services and entering District property.

The amendment does not address pricing terms, set-asides, or funding sources, as it functions as a compliance and misconduct policy rider to existing service provider agreements rather than a standalone procurement document. The amendment applies to the related Nutritious Snack Foods contract for Dallas ISD Food and Child Nutrition Services, which operates on a one-year term with two optional one-year renewals, not to exceed three years total. The amendment becomes effective upon execution by the District and remains in force unless further modified by written agreement between the parties.
