About this file

This is a Questions and Answers document (Q&A #3) for solicitation 140P8126Q0027, a small business set-aside for hazardous tree trimming and removal services at Boulder Beach in Lake Mead National Recreation Area, issued by the Department of the Interior National Park Service Pacific West Region.

The document clarifies pricing and subcontracting requirements related to optional line items in the contract. The key points are: (1) optional pricing for individual trees in various categories, included in Contract Line Item Numbers (CLINs) 1 through 19, must be aggregated to determine if the total award exceeds the Simplified Acquisition Threshold (SAT) of $350,000; (2) if the initial award amount is at or below $350,000, FAR Clause 52.219-14 (Limitations on Subcontracting) does not apply at award; however, if the exercise of optional line items post-award causes the total contract value to exceed $350,000, the clause becomes applicable and a formal modification will be issued incorporating all required clauses for contracts above the SAT; and (3) the awardee will be required to comply with applicable clauses upon such modification. This clarification addresses the timing and applicability of small business subcontracting restrictions based on whether the contract value threshold is crossed at award or through subsequent option exercises.

Questions & Answers #3 Hazardous Tree Trimming/Removal 140P8126Q0027 Q1: In the SOW on page 12, lines 14 - 19 ask for optional pricing for 1 tree in each category, with an NTE assigned as well. Since these are optional trees, are they included in the lump sum pricing that determines the Simplified Acquisition Threshold of $350,000?

A1: Yes. As outlined in the revised price schedule included with amendment #2, the evaluation of pricing will be determined based on the aggregate amount of CLINs 1 through 19. Should the total award amount exceed the Simplified Acquisition Threshold (SAT) of $350,000, FAR Clause 52.219-14—Limitations on Subcontracting—will be applicable.

Q2: If after award, the optional line items are exercised, and the total value exceeds the SAT of $350,000, will the SBA prime be subject to the +50% performance requirement under FAR 52.219-14?

A2: At this point, FAR Clause 52.219-14—Limitations on Subcontracting—does not apply. However, should the award amount exceed $350,000, the clause would become applicable, as this is a Small Business set-aside and subcontracting restrictions are enforced for contracts or orders above the Simplified Acquisition Threshold.

Should the exercise of contract options post-award result in the total contract value exceeding the Simplified Acquisition Threshold (SAT) of $350,000, a formal modification will be issued at that time to incorporate all required and applicable clauses for contracts above the SAT. The awardee will be required to adhere to the applicable clauses.
