About this file
This document contains several forms related to a federal contract opportunity for a Non-Time Critical Removal Action (NTCRA) under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) at the Caneel Bay Resort in the Virgin Islands National Park.
The key details include: The contractor will remove approximately 13,000 bank cubic yards of contaminated soil and landfill refuse, and 40 loose cubic yards of contaminated sediment, transporting it to appropriate disposal facilities on the mainland, and performing limited site restoration. The contract will use unit-priced items subject to the variation in quantity clause. The estimated magnitude of the project is between $5,000,000 and $10,000,000. The contract is set-aside for Small Businesses per FAR 19.5. Proposals are due approximately 30 days after the RFP is posted. The government will award to the offeror whose proposal represents the best value. The contract will require a 100% payment bond, 100% performance bond, and liability insurance prior to performance.

2. price schedule (rev)
| Form 2: Contract Price Schedule. Revised in Amendment 3; changes are in red font. | Solicitation 140P2124R0023 |
| Offerors are required to submit, at minimum, an offer that conforms to the solicitation documents with pricing for base items and all option line items. Failure to do so may render the proposal unacceptable. On lump-sum line items, provide the total price only. If no specific line item exists for a portion of the work, include the costs in a related item. In case of an error in the calculation of extended prices, the unit price governs. In case of an error in summation, the total of the corrected amounts governs. Complete this form and return with other documents described in Section L. |

| FAR 52.219-14 (OCT 2022) (DEVIATION OCT 2022) excerpt: (e) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees that in performance of a contract assigned a North American Industry Classification System (NAICS) code for—(1) Services (except construction). It will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding certain other direct costs and certain work performed outside the United States (see paragraph (e)(1)(i)), to subcontractors that are not similarly situated entities. [...] (i) The following services may be excluded from the 50 percent limitation: (A) Other direct costs, to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service. Examples include airline travel, work performed by a transportation or disposal entity under a contract assigned the environmental remediation NAICS code (562910), cloud computing services, or mass media purchases. (B) Work performed outside the United States on awards made pursuant to the Foreign Assistance Act of 1961, or work performed outside the United States required to be performed by a local contractor. Note that the definition of United States in FAR 2 and 19 is "the 50 States and the District of Columbia." |
| * Similarly situated entity, as used in this clause, means a first-tier subcontractor, including an independent contractor, that— |
(1) Has the same small business program status as that which qualified the prime contractor for the award (e.g., for a small business set-aside contract, any small business concern, without regard to its socioeconomic status); and
(2) Is considered small for the size standard under the North American Industry Classification System (NAICS) code the prime contractor assigned to the subcontract.
