About this file

This document is a revised addendum to the Caneel Bay Resort Non-Time Critical Removal Action (NTCRA) Work Plan under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) at the Virgin Islands National Park. The key details are:

The project involves removing approximately 13,000 bank cubic yards of contaminated soil and landfill refuse, and 40 cubic yards of contaminated sediment, transporting the material to appropriate disposal facilities, and performing limited site restoration. The contract will use unit-priced items subject to quantity variations, with an established ceiling and notification requirements. A payment bond, performance bond, and liability insurance will be required prior to contract performance. An offer guarantee is also required with proposal submission. The Project Engineer, hired under a separate NPS contract, is responsible for collecting confirmation samples and associated costs. The contractor must notify the Contracting Officer if additional material needs to be removed beyond the anticipated depths. The project has a 390-day completion timeline after the Notice to Proceed is issued. The Transport and Disposal Plan must address site logistics and traffic control to ensure safe passage of equipment and guest shuttles. This is a best value negotiated procurement set-aside for Small Business concerns.

Conduct soil NTCRA under CERCLA at Caneel Bay Resort Virgin Islands NP

Attachment 2a: Revised Addendum to Attachment 1, Caneel Bay Resort NTCRA Work Plan: Soil and Sediment Removal

Section 5.6: the Project Engineer is hired under a separate NPS contract for support services. The Project Engineer is responsible for collecting confirmation samples and sending them for analysis. Project Engineer is also responsible for preservation, transportation, and laboratory analytical costs of confirmatory samples.

Sections 5.3, 5.6.3, and 5.6.4: In addition to the requirements in contract paragraph G.1 and FAR clause 52.236-2, if after excavating to the Anticipated Removal Depths (Figure 4b), refusal (bedrock) or undisturbed soils are not reached and/or solid waste is still present/visible, the contractor must notify the CO in writing. The notice shall include an estimate of the volume of material that would need to be removed to reach refusal or undisturbed soils, an updated schedule to remove the estimated volume, and any other helpful information. The CO will calculate the estimated cost using the unit prices in the contract and considering potential impacts to lump sum CLINs 4 and/or 10. Allow 14 days for NPS to review the notification and execute any modifications establishing new NTE quantities. The Project Engineer will collect confirmation samples when the full extent of authorized soil removal is complete (or bedrock is encountered). The Removal Action Contractor will stand by until confirmation sample results are received and shared by NPS. The Project Engineer will provide a plan for confirmation resampling, if necessary, for NPS to consider in conjunction with the Contractor’s notice.

Section 5.6.5: Removal Action Contractor shall provide the Project Engineer with the necessary and applicable documents within the timeframes listed in Appendix 1, 013100, Section 1.2. The Project Engineer will prepare the Completion Report.

Appendix 1, 013100, Section 1.2(D) (added): On-site removal activities, including delivery to marine shipper from on-island transporter, marine shipping, and mainland transportation and disposal, and delivery of waste manifests to NPS must be completed within 390 days after issuance of the Notice to Proceed. Transmit waste manifests to NPS as soon as they are available from the disposal facility.

Appendix 1, 013100, Section 1.2.B.8.a is revised to read: “The site-specific HASP shall address all aspects of on-site activities in compliance with 29 CFR 1910.120. In addition to meeting the requirements of 29 CFR 1910.120, the HASP shall address all aspects of safety for the contracted work, including but not limited to, as applicable, heavy equipment operation, heat monitoring, injury reporting, HAZMAT storage, PPE, specialized equipment use, etc.”

Appendix 1, 015719-3, Sections 1.3 and 2.4: The Project Engineer will provide dust monitor and gas monitor units that they will use to conduct monitoring.

Appendix 1, 026129, Section 1.2, Submittals, describes the Transport and Disposal (T&D) Plan that is included in the Construction Plan.

a. The T&D plan must include specific site logistics for equipment routes, staging, and coordination at the Landfill area. The Landfill is accessed by a single lane road adjacent to the Bay. The single lane road is also used by a shuttle/taxi that brings day guests to/from Honeymoon Beach from the Resort entrance. Transport and Disposal Plan must adequately address on site coordination to ensure safe passage for guest shuttle and equipment, without disruptions of service. See diagram below from Google Maps identifying single lane road, landfill, and Honeymoon Beach.

b. The transport and disposal plan shall comply with the “Manual on Uniform Traffic Control Devices (MUTCD) for Streets and Highways” (Federal Highway Administration (FHWA), 2012). The plan shall ensure that adequate consideration will be given for the safety and convenience of motorists, pedestrians, and workers during the removal action both within the Site and between the Site and off-Site delivery areas.

c. General Approach. The general traffic controls below are most applicable to work at the Site.

• All traffic at the Site will be routed with traffic control devices and road layouts comparable to those for normal highway situations.

• Traffic movement will be maintained as normal as practical. Preparations for safe traffic control for work and construction vehicles will be made.

• All traffic control devices will be removed immediately when no longer needed.

• Traffic will be channeled by the use of signage, flexible posts, and other lightweight devices that will yield if hit by vehicles.

• Traffic controls or working conditions may be modified to promote worker safety.

Worksites will be carefully monitored under varying conditions of traffic volumes, light, and weather to ensure that traffic control measures are operating effectively, and that all devices used are clearly visible, clean, and in good repair. Work zone accident records will be analyzed periodically.
