Question 2: May I get a list of plan holders for this project?

BLM Response: We do not keep a plan holders list. However, Interested Vendors List (IVL) was activated for this solicitation. Accordingly, the list should be accessible via Sam.gov. Please click on the following link Interested Vendors List IVL for more information.

Question 3: Regarding Project Management Software Section 01 31 00-8. There have been consolidations and buy outs in the construction project management arena with at least 1- of the products listed being obsolete. My biggest question is the project management software going to be required, and if so, could we have a current list of approved packages? Builder Trend is consistently one of top-rated products and has been on the market for some time.

BLM Response: Project management software to be coordinated upon award. Multiple options are listed in the Specifications. If software is used that is not listed, it must provide the features described in the Specifications section 01 31 00-1.8.B WEB-BASED PROJECT SOFTWARE.

BLM Response: Door General note 16 on AG105 requires the contractor to coordinate with the facility O&M staff for all keyways. Requests for substitutions in hardware will be considered in accordance with provisions of section 01 60 00.

Question 33: Interchangeable Cores are not specified. Advise if Conventional Cylinders are acceptable, or if Interchangeable Cores will be required.

BLM Response: Conventional Cylinders are not acceptable, because that would negate the ability to re-key the doors.

Question 34: Electrical main panels are out at least 52 weeks from the sign off on the submittal package, are you willing to extend the duration of the project from the 320 days allotted.

BLM Response: See response to question no. 9.

Question 35: Who is paying the electrical connection fee to PSREC (Plumas Sierra rural electric co-op) Has this already been paid?

BLM Response: Contractor will pay for all utility connection fees and will coordinate with all utility companies.

Question 36: Who is paying PSREC for the boring, and setting of the transformer on the pad?

BLM Response: Contractor will pay for all utility connection fees and will coordinate with all utility companies.

Question 37: Section F, Deliveries or Performance calls to complete the entire work ready for use not later than 320 calendar days after the date the Contractor receives the notice to proceed. The proposal period of performance is insufficient for several reasons that include long lead procurement challenges the construction industry has faced in the last couple of years. Additionally, this project requires a considerable amount time and effort to process and approve all the necessary front end technical submittals. Given the timeframe required for front end submittals, it’s likely that earthwork, underground, and concrete operations will commence during the wet/cold months which is not ideal. Please consider increasing the base bid period of performance to a minimum of 395 calendar days, not including the phased construction effort.

BLM Response: Period of Performance is revised via amendment 0001.

Question 38: How much contract time will be added to the Base Bid period of performance if the Additive Option to convert the existing Doyle Fire Station building into a Fitness Center, is awarded?

BLM Response: 45 Calendar days will be added.

Question 39 Per Section 01 1000, para 1.4 Phased Construction, the work to convert the existing building (Additive Bid Option 3) is to occur after the completion of the new Fire Station building at which time BLM will move out of the existing Fire Station and into the new facility. How many days of the projects period of performance will BLM require to move out of the existing Fire Station?

BLM Response: Anticipate up to two weeks between commissioning and starting the fitness facility (additive bid option 3) construction (if awarded). A separate NTP will be issued for fitness facility (if awarded) after the move.

Question 40: Please clarify if the basis for project acceptance, with respect the stipulated period of performance is the work under the Base Bid only or if it includes the work under the additive options. Given the liquated damages of $1,393 for each calendar day of delay until the work is completed, the period of performance and acceptance must be thoughtfully considered. The RFP as currently solicited does not accurately reflect the current industry production and global supply chain realities contractors are currently required to operate within, nor does it clearly define the time associated with the phased construction. As a prospective prime contractor, we respectfully request BLM revisit the overall period of performance to include the phased construction and move out period for BLM.

BLM Response: Period of performance is revised to 395 calendar days from NTP and is for Base Bid and Additive Items 01 and 02 (if awarded). If Additive Item 03 is awarded, additional 45 days will be allowed for that work (separate NTP will be issued).

Question 41: If the project’s magnitude of construction estimate of $5M - $10M was prepared prior to April of 2021, it is likely significantly short given the overall inflation costs the market has experienced over the past couple of years. If the project comes in over budget, is funding available to bridge the difference for a contract award?

BLM Response: Answer to this question depends on the difference.

Question 42: Please clarify the minimum contract requirements for the Contractors field management staff relating to the Superintendent, Quality Control Supervisor, and Site Safety Supervisor. RFP Section I, Clauses incorporated by reference includes 52.236-6 Superintendence by the Contractor. Specification section 01 40 00, para 1.6 calls for a Quality Control Supervisor who may perform other duties. We find no specific requirement for an independent Site Safety Supervisor to oversee the project safety program. Will a separate individual be required to fill each of these roles or can they be combined into one “hat” and if so, how many is required.

BLM Response: Individuals can perform dual roles, but the CO needs to know of all roles each representative is taking on. If there is a change in roles mid project, notify CO as soon as possible. Representatives must be qualified to perform in each respective role.

Question 43: Refer to the Masonry Lintel Schedule on Sheet S401 and in particular, Note 6. Please confirm the steel jamb channels and anchors are required at all door and window openings per Sheet S202, Detail 7 or clarify the intent.

BLM Response: Note 6 in the Reinforced Masonry Lintel Schedule on Sheet S-401 is only applicable to Marks L2 and L3.

Question 44: The project site visit was scheduled during a holiday week which made attendance challenging from some contractors. Will the Government consider a second organized site visit?

BLM Response: Government will not conduct a second site visit.

Question 45: Spec Section 22 10 05 calls for Type L, copper plumbing pipe or PEX to be used but the plans Sheet PG001 do not mention PEX. Please clarify if PEX will be allowed to be used on this project.

a. Is PEX tubing allowed in all above slab water lines?

b. May PEX be used below slab?

BLM Response:

a. Yes, PEX is acceptable.

b. No, PEX is not to be used below the slab or below grade. PEX is not to be buried.

Question 46: Specification section 22 07 13 3.2E states to insulate plumbing vet lines. Please verify that the government wants the plumbing vent lines to be insulated.

BLM Response: The specification is correct.

Question 47: Plan sheet PG001 J. calls for ABS pipe and fittings but Specification section 22 25 48 3.2 D7 calls for Pipes and Connections to be constructed of non-ductile materials (cast iron, no-hub, plastic or non-UL listed grooved coupling pipe). Please clarify which material is to be used.

BLM Response: Refer to the specifications section 22 10 05, 1.11, for allowable piping.

Question 48: Specification Section 22 15 13 General-Service Compressed-Air Piping references many different materials in the definitions section 1.1 but only a couple are mentioned in the following spec sections.

a. Please clarify the materials to be used on this project.

b. Is a specific manufacture(s) approved to be used on this project?

BLM Response:

A. Compressed Air Systems:

1. Piping:

b. Steel: ASTM A53-20, Schedule 40 hot-dipped galvanized steel pipe with hot-dipped galvanized Class 150 threaded malleable iron fittings.

2. Valves:

a. Ball Valves: Two-piece bronze, WOG, full port.

3. Accessories:

a. Flexible Piping Connectors: Corrugated stainless steel with stainless steel braid covering, ends to match piping connections.

b. Air Pressure Regulators: Aluminum alloy body, diaphragm type, rated for 250 psig inlet pressure.

c. Air Couplers: 1/4-inch, Style M (industrial) brass air coupler.

d. Air Hose Reels: Low pressure hose reel, with 3/8-inch x 30 foot air hose, ball stop, and Style M (industrial) air coupler.

b. There is no particular manufacturer for the steel piping.

Question 49: Will the government please extend the bid deadline to 08-09-23? Many of our subcontractors and suppliers have requested an extension due to the high volume of work being solicited in this area if they are going to be able to provide pricing for this project.

BLM Response: Bid due date is extended via amendment 01 to 8/2/2023.

Question 50: The Period of Performance is not long enough for review and approval of government required submittals, procurement of long lead materials and equipment and or onsite construction. Can the Period of Performance be extended?

BLM Response: Period of Performance is extended via Amendment 01.

Question 51: Due to the current economic environment and the impacts of inflation, we Proposes a Modified FAR 52.216-4 Economic Price Adjustment-Labor and Material.

In accordance with and supported by Department of Defense Memorandum, Subject: Guidance on Inflation and Economic Price Adjustments, Issued by John M. Tenaglia (Principal Director, Defense Pricing and Contracting), signed, 05.25.2022, we propose an appropriate Economic Price Adjustment Clause (EPA), changing the 10% not to exceed ceiling on the original unit price in 52.216-4(c)(4), to a modified EPA clause: i) allowing for both upward and downward revision of the stated contract price upon the occurrence of the specified contingencies stated in the clause; ii) use the same index to establish the negotiated price and to adjust the negotiated price under the terms of the clause; and 3) incorporate a ceiling and a floor on adjustments that are of the same magnitude. Please advise.

BLM Response: Considered. FAR 52.216-4 (modified or original version) is not applicable to this acquisition.

Question 52: Due to the unknown effects of the COVID-19 pandemic the country is currently facing, contractors are often seeing prime contractors and subcontractors incorporating additional cost in the form of contingency to attempt to manage this unknown risk. As a result, overall pricing may be artificially inflated without being directly tied to an appropriately quantifiable, known risk.

In order to keep bid costs down and within budgets and to better manage and allocate this risk, will the government consider adding provisions or language to the RFP allowing for the potential recovery for cost and schedule impact arising or related to the COVID-19 pandemic and outside the control of the contractor?

The recovery could be via requests for equitable adjustment or issued as a modification to the contract which will allow for negotiated costs and time impacts after award regarding COVID-19 pandemic impact. These modifications would be based upon actual, reasonably incurred costs to ensure the government is only subject to actual impacts instead of unknown impacts in the form of an inflated bid price.

BLM Response: BLM has considered and decided not to make any changes to the current solicitation. Request for Equitable adjustments (REA) are not appropriate for the suggested purpose.

Question 53: Will the government confirm that the inclusion of a FAR 16.203 Economic Price Adjustment type provision or other such similar provision to accommodate cost that may arise due to excused schedule delays or market pricing due to the COVID-19 Pandemic will be afforded to the KTR should this issue be realized? Please advise.

Contractor recognizes that the Economic Price Adjustment provisions under 16.203 should be modified to better accommodate the risks being addressed to include establishing thresholds and limits, and costs associated by delay and associated “ready state” costs contemplated by recent federal legislation.

BLM Response: Economic Price Adjustment related clauses or provisions are not applicable to his acquisition. Please bid accordingly.

Question 54: KTR intends to include the exception listed below with price proposal. Will this exception be acceptable to the government OR will KTR proposal that includes such language be considered non-responsive.

The following exception is provided below for your consideration

BLM Responses: Any exception in your bid package will result in your bid being rejected as non-responsive.

Question 55: Due to the commodity and building materials pricing volatility and supply chain shortages because of the pandemic, is FAR Clause 52.216-4 Economic Price Adjustment-Labor and Material in effect for this project?

BLM Response: No, it is not.

Question 56: Can the Superintendent perform a dual role? For example, can the Superintendent also be the SSHO?

BLM Response: Yes, but the CO needs to know of all roles each representative is taking on. If there is a change in roles mid project, notify CO as soon as possible. Representatives must be qualified to perform in each respective role.

Question 57: Can the QC Manager perform a dual role? E.g. QC/Superintendent or QC/SSHO.

BLM Response: See answer to previous question.

Question 58: Will the government require the contractor provide an onsite office trailer? Or is it at the contractor’s discretion?

BLM Response: Onsite office trailer is provided at Contractor’s discretion. Contractor to supply own means of restrooms as to not disturb existing fire station facilities.

Question 59: Please indicate acceptable laydown/staging areas?

BLM Response: Staging areas will be within the limits of the BLM parcel and will be determined upon award.

Question 60: . Please indicate acceptable haul routes.

BLM Response: Main haul route will be to access the site from the north gate entrance off of Doyle Grade Road. Do not use the Eastern gate off of Doyle Dr.

Question 61: . Will onsite stockpiling be allowed (i.e., surplus/import material)?

BLM Response: Yes, as the limits of the parcel allows and as approved by BLM COR.

Question 62: Please provide any available soils reports (i.e., characterization reports).

BLM Response: The geotechnical report is contained in the Specifications section 00 31 32.

Question 63: Please provide any available boring logs or Geotech reports for the project.

BLM Response: Same as prior question.

Question 64: Will the reuse of any discovered contaminated soil (i.e., below the acceptable environmental action levels) be allowed? (Including within utility trenches).

BLM Response: IF discovered soil is contaminated, notify BLM to determine corrective action with Contracting Officer.

Question 65: It is not clear in the RFP whether CERCLA requirements will be applicable to this project. Please advise.

BLM Response: CERCLA is under EPA, if hazardous materials are found during construction notify the contracting officer/COR asap, however site is not identified as a superfund site. IF Contractor spills during construction, will need to take certain reporting steps and CERCLA may be applicable.

Question 66: Will KTR be required to do confirmation sampling for areas included in the RFP Provided Hazmat report?

BLM Response: Spec section 02 41 19, Hazardous Materials:

1. It is not expected that hazardous materials will be encountered in the work.

Question 67: Will an NPDES permit be required?

BLM Response: Contractor to meet all state permitting requirements.

Question 68: Please advise whether a Storm Water Pollution Prevention Plan will be required for this project.
