About this file

This document is an evaluation clause (1352.213-70) for a simplified acquisition procedure solicitation for the National Data Buoy Center (NDBC). The procurement involves purchasing 35 Gill Instruments MaxiMet all-in-one weather sensors for use with the SCOOP system, with a small business set-aside designation. The solicitation is a brand-name requirement due to the sensors' unique performance and compatibility in harsh marine environments, after extensive testing revealed the Gill MaxiMet sensor as the only model meeting NDBC's stringent technical and operational requirements.

The evaluation will consider two primary factors: price and past performance. Price will be assessed for CLINs 0001 (35 weather sensors) and 0002 (option quantity), with evaluation focusing on total price and price reasonableness. Past performance will be evaluated based on the offeror's performance on similar contracts, requiring submission of two to three relevant examples with detailed contact information. Offerors must be registered in the System for Award Management (SAM) to be eligible, and the government will award to the responsible offeror providing the best overall value to the government.

The Government will issue an order resulting from this request for quotation to the responsible offeror whose quotation results in the best value to the Government, considering both price and non-price factors. The following factors will be used to evaluate quotations:

1. Price.

The Government will evaluate offers for award purposes by considering the total price for the CLIN 0001 and 0002(CLIN 0001 – 35 Gill MaxiMet all-in-one weather sensors; CLIN 0002 - option quantity). The Government may determine that an offer is unacceptable if the price is materially unbalanced. Price reasonableness will be evaluated in accordance with FAR 13.106-3(a).

2. Past Performance.

The offeror’s past performance on similar contracts will be evaluated to determine successful performance of requirements, including the quality and timeliness of product delivery, cost control, responsiveness, and overall customer satisfaction. The Government may use information from the references provided as well as other internal or external sources.

a. The offeror shall provide a list of at least two, but no more than three, relevant past performance examples. Each example shall include the following information:
