Project Description: The Contractor shall furnish all labor, materials, equipment, project management, supervision, and transportation for construction of a new Sequoia National Forest Supervisor’s office, including but not limited to general construction, site work, site improvements, site utilities, concrete foundations, wood frame, with exterior finishes including aluminum windows, manufactured stone, plaster, fiber cement siding, single ply and composition shingle roofing, civil, mechanical, plumbing, electrical, fire protection, and telecommunication work as shown on the drawings and specifications. All work is to be completed in accordance with the Statement of Work, drawings, specifications and attachments.

SUBMISSION REQUIREMENTS OF BIDS:

All the following documents shall be emailed only to Gregory.Cunningham@usda.gov & Robert.Briney@usda.gov in response to this Invitation for Bid (IFB). Sending your bid to any other individuals may deem the firm ineligible for award. Incomplete bid packages may be determined nonresponsive.

(a) One (1) fully completed and signed Standard Form 1442 with blocks 14 – 20 completed, acknowledgment of all amendments either via entering data in block 19 of the SF1442 OR by completing blocks 15 a, b, and c of the Amendment(s) (SF30’s) and returning with bid.

(b) Five (5) fully completed Pricing Breakdown Sheet (1 each for base, alt 1, alt 2, alt 3, & alt 4.)

CONTRACT TYPE:

• The awarded contract will be a firm fixed price (FFP) contract.

• This solicitation is a Total Small Business Set-Aside per FAR 19.507(c)

PROSPECTIVE CONTRACTORS’ RESPONSIBILITY:

• Purchases shall be made from, and contracts shall be awarded to, responsible prospective contactors only. The presumed winning bidder must be determined as “Responsible” by the Contracting Officer in accordance with FAR Part 9, Contractor Qualifications. To aid in making this determination, bidders shall provide, at bid-opening all documents as required under “Submission Requirements of Bids” above.

• Submitted documents will be reviewed promptly after bid-opening. This information, along with other information obtained from Government systems, such as the OSHA and EPA online inspection history databases will be used to make the Determination of Responsibility. Failure to affirm being within the guidelines below or submit this information may result in a determination of Non-Responsibility and make the bid ineligible for award. The Contracting Officer will obtain additional information as needed and specified in FAR 9.105-1 to make the Determination of Responsibility, to include, but not limited to the Federal Awardee Performance and Integrity Information System (FAPIIS), Excluded Parties List System (EPLS), and Past Performance Information Retrieval System (PPIRS).

SAFETY & ENVIRONMENTAL RECORD AND EXPERIENCE MODIFICATION RATE (EMR):

• To be eligible for consideration and award, the contractor shall have no more than three serious, or one repeat, or one willful OSHA or EPA violation(s) in the past 3 years and have an EMR of equal to or less than 1.0.

• All Bidders shall submit the following information pertaining to their past Safety & Environmental Record and EMR with their bid, on provided certification form.

1. SAFETY & ENVIRONMENTAL RECORD: A self-certification that the bidder has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years.

2. EMR: All bidders shall submit information regarding their current EMR. This information shall be obtained from the bidder’s insurance carrier and be furnished on the insurance carrier’s letterhead. Bidder will also enter the information on provided form.

• Bids are due Thursday, September 10th, 2020 at 10:00 am PDT at the address specified in Block 8 of SF1442.

• Due to the current COVID-19 pandemic, we currently DO NOT accept hand-delivered bids. Follow email only submission instructions on page 6.

• Due to the current COVID-19 pandemic, the Public Bid Opening will not be held in person.

Participants who wish to attend the Bid Opening may do so via telephone. The bid opening will begin promptly on Thursday, September 10th, 2020 at 11:00 am PDT.

however, actual low bidder chosen for award shall be subject to verification and confirmation of required, submitted bid documents.

PRE-BID SITE VISIT:

• Bidders are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of performing construction services. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

• See Provision 52.236-27 for specific information regarding the project pre-bid site visit.

• This pre-bid site visit will be the only opportunity for potential bidders to visit the site.

• All potential bidders, subcontractors, and suppliers are strongly encouraged to attend this pre-bid site visit.

REQUEST FOR INFORMATION (RFI):

• To obtain clarifications and/or additional information concerning the contract requirements, drawings, or specifications, submit a written RFI utilizing the RFI Form included in this IFB, which is to be sent via email ONLY to Gregory.Cunningham@usda.gov. See RFI Form for specifics.

• RFI’s will be responded to as necessary in amendment format which will be posted on beta.SAM.gov. Deadline for submission of RFIs for this IFB is September 1st, 2020 at 3:00PM PDT. No questions will be answered after this date/time unless determined to be in the best interest of the Government as determined by the Contracting Officer. Telephone / verbal request for information, to include during the site visit will not be accepted, returned, or deemed as valid.

PLANS/SPECIFICATIONS/DRAWINGS:

• Drawings and specifications are attached in electronic format to this solicitation. Bidders are responsible for downloading and printing their own bid sets. The USFS will not provide hard copies of the drawings and specifications to any bidder. Contractors are responsible for ensuring that any construction document package used for bidding or construction is complete and up-to-date.

TRAINING:

• All employees of the general contractor and subcontractors shall have the 10-hour OSHA certified construction safety course and/or other relevant competency training, as determined by the COR with input from the ICRA (Infection Control Risk Assessment) team. The General Contractor’s Competent Person/Superintendent shall have completed the 30-hour OSHA certified construction safety course. Documentation of training shall be submitted to the Contracting Officer for review and approval prior to any work being performed. No ID badge (if deemed required) will be issued to an employee who does not provide this documentation. There shall be no exceptions to this requirement.

PREPARATION OF BIDS:

• The Federal Government WILL NOT pay for any costs incurred in preparation and submission of bids.

SYSTEM FOR AWARD MANAGEMENT (SAM):

• Federal Acquisition Regulations require that federal contractors register in the System for Award Management (SAM) database at http://www.sam.gov and enter all mandatory information into the system. Bids shall be deemed non-responsive and rejected if the contractor is not registered and current in SAM prior to bid submission. Bidders are strongly encouraged to ensure they have an active DUNS number and are registered in SAM prior to submitting their bid.

JOINT VENTURES: See 13 C.F.R. § 121.103

(e) Affiliation based on joint ventures: A joint venture is an association of individuals and/or concerns with interests in any degree or proportion consorting to engage in and carry out no more than three specific or limited-purpose business ventures for joint profit over a two year period, for which purpose they combine their efforts, property, money, skill, or knowledge, but not on a continuing or permanent basis for conducting business generally.

This means that a specific joint venture entity generally may not be awarded more than three contracts over a two year period, starting from the date of the award of the first contract, without the partners to the joint venture being deemed affiliated for all purposes. Once a joint venture receives one contract, SBA will determine compliance with the three awards in two years rule for future awards as of the date of initial offer including price.

As such, an individual joint venture may be awarded more than three contracts without SBA finding general affiliation between the joint venture partners where the joint venture had received two or fewer contracts as of the date it submitted one or more additional offers which thereafter result in one or more additional contract awards. The same two (or more) entities may create additional joint ventures, and each new joint venture entity may be awarded up to three contracts in accordance with this section. At some point, however, such a longstanding inter-relationship or contractual dependence between the same joint venture partners will lead to a finding of general affiliation between and among them.

For purposes of this provision and in order to facilitate tracking of the number of contract awards made to a joint venture, a joint venture must be in writing and must do business under its own name, and it may (but need not) be in the form of a separate legal entity, and if it is a separate legal entity it may (but need not) be populated (i.e., have its own separate employees). SBA may also determine that the relationship between a prime contractor and its subcontractor is a joint venture, and that affiliation between the two exists, pursuant to paragraph (e)(4) of this section.

NOTICE TO PROCEED (NTP):

• A notice to proceed shall be issued after award at an estimated date of October 1st, 2020 which will begin the 325 calendar day period of performance. The NTP date and time “to be determined” after award to a successful bidder. Primary factor in determination to issue NTP shall be the Prime Contractor’s submission of, and the Government’s review and approval of both Payment and Performance Bonds, both of which are enforceable legal documents.

• This Invitation For Bid (IFB) is conducted under FAR Part 14 - Sealed Bidding, where firms are bidders and shall submit bids. BRAND NAME OR EQUAL:

• The IFB may include the salient characteristics of the “or equal” aspect for determination of what is equal to any cited brand name. See FAR 52.211-6 for “brand name or equal” information. This is an extremely long, detailed, and comprehensive IFB, including all specifications and drawings. Please note that, wherever a brand name is cited, contractor shall ensure, in any resultant contract, that any equal has the salient characteristics of the brand name.

• Lack of confirmation shall be grounds for Government inspection at any time and Government direction for replacement of materials or equipment by the Contractor at no increase in contract price or time.

WORK DAYS AND HOURS

• Normal work days and hours for this project range from 07:00 AM – 5:00 PM Monday - Friday.

Access to the work site may be restricted to these hours and days. Work during other than normal work days and hours may be required, but days and hours must still be coordinated in advance with the Contracting Officer through the COR.

2.2 STATEMENT OF WORK

United States Forest Service (USFS)

Sequoia National Forest

Project: Sequoia NF SO Construction

1.2 DESCRPTION OF WORK

Furnish all labor, equipment and material to accomplish the Work under this contract, which consists of the construction of a new, approximately 10,816 sf administrative and interagency dispatch office and associated site and off-site improvements on a 2.08 acre site. The building is single story, wood frame, with exterior finishes including aluminum windows, manufactured stone, plaster, fiber cement siding, and composition shingle roofing. Interior finishes include carpet, tile, casework, suspended acoustic and wood panel ceilings, Site improvements include concrete walks, hardwood patios, asphalt paving, landscape planting and irrigation, trash enclosure and fencing.

Project is divided into a base bid and bid alternatives, as described below:

• Base Bid: Construct approximately 2.1 acres of site improvements (earthwork, street improvements, utilities, paving, landscaping) and construct an 8,671 SF single story wood framed office building.

• Add Alternative 1: Construct an additional 1,308 SF of office space on the west end of the office building; furnish and install a 50' radio antenna tower.

• Add Alternative 2: Construct an additional 850 SF of office space on the east end of the office building.

• Add Alternative 3: Furnish and Install an emergency generator system to support portions of the new building, construct a gravel parking lot in the northeast portion of the site, construct two wood decks, and install additional landscape boulders.

• Add Alternative 4A, 4B, 4C: Furnish and install work station furniture and other fixed in place furniture for each separate portion of the new office building (Base bid, Alt 1, and Alt 2).

The Contractor should refer to the SCHEDULE OF ITEMS and project plans and specifications when making estimates of quantities or work.

C.2 PROJECT LOCATIONS

• The Porterville Work Center is located at 480 N. Henrahan, Porterville, California.

C.3 CONTRACT TIME

• Estimated start work date is October 1, 2020. The contract time will be 325 days for the base bid plus 25 days additional for each Add Alternative awarded (Alts 1, 2, and 3 only); up to 400 days total. Contract time includes delays for weather; locating and transporting supplies and materials; and final site cleanup.

C.4 PROJECT SITE CLEAN UP

• Project site cleanup includes the removal and proper disposal of all construction trash, debris, residue, and asphalt and concrete slag off of National Forest Land. Items such as miscellaneous construction materials are considered the property of the Contractor and shall be removed from the project site.

• All spills of petroleum products including leak spots from parked vehicles shall be removed and properly disposed according to all Local, State, and Federal rules, regulations, and laws governing such disposal.

• During the Work the Contractor is required to furnish dumpsters or other trash receptacles and to empty such containers either as they become full or weekly, whichever is more frequent. The Contractor shall not place materials of any kind into private or Government trash bins or dumpsters.

C.5 PRICE RANGE

• The price range of this project is between $5,000,000 and $10,000,000.

C.6 SPECIAL CONDITIONS AFFECTING THE WORK

a. Physical Conditions. The indications of physical conditions on the drawings and in the specifications are the result of site investigations and surveys performed by the Government, and do not guarantee site surface and subsurface conditions. The Contractor is responsible for making his own evaluation of site conditions and shall complete the work through any and all sub-surface conditions, with appropriate construction methods.

b. Weather. Low temperatures at the project site range from temperatures of less than 20 ºF in December and January to lows of 65 ºF in July and August. High temperatures range from 45 ºF in December and January to over 100 ºF in July and August. The annual precipitation at the project site is less than 12 inches per year.

c. Work Hours. Project is within the city limits of Porterville adjacent to residential housing areas.

Work hours are from 7:00 am to 5:00 pm Monday through Friday. Weekend equipment work is not allowed at any time during the Work. Dogs and pets are not allowed on the project site at any time.

d. Safety, Emergency Communications and Evacuation. Contractor is responsible for the safety of the Contractor’s employees including Subcontractors employees, Government employees associated with the project, and any visitors to the site both Government and private.

The Contractor shall submit a project safety plan to the Contracting Officer for review prior to commencement of Work. The project safety plan shall comply with the appropriate California OSHA and Federal OSHA rules and regulations and must include a medical evacuation and emergency communications plan.

e. Traffic Safety. Contractor is responsible for complying with the State of California regulations for working in the right-of-way. This includes but is not limited to furnishing traffic control signs and flag persons.

f. Temporary Site Utilities. Contractor may install temporary site utilities to support work on the project. The installation of temporary utilities is the responsibility of the Contractor and shall be paid for by the Contractor. The Contractor shall provide the Contracting Officer with written

Page | 12 certification that all temporary site utilities have been properly disconnected and the final utility bills are paid in full.

g. Toilets. No toilet or shower facilities are available on site. Contractor shall provide toilet facilities for its employees.

h. Camping. There is no onsite camping at this location.

i. Security. Contractor is responsible for the Contractor’s equipment and building materials supplied to the site. All equipment not equipped with a key lock system shall be secured in such a manner as to make it inoperable to the average person at the end of each working day. All hand tools, ladders and other equipment shall be secured at the end of each working day. On Fridays all construction debris, trash, and refuse shall be properly stored in dumpsters or trash bins or removed from the site.

j. Burning Permits. Contractor is subject to all rules and regulations governing the on site burning of slash and other debris. Contractor shall obtain a burning permit from the jurisdiction having control over burning. The Contractor shall comply with Fire Plan for Construction and Service Contracts included in the Contract.

k. Protection of Resources. Contractor shall thoroughly clean all equipment prior to delivery to the project site to remove weeds, mud, grease and oil buildup from the tires, wheels, tracks, engines and engine compartments, and other surfaces. Spills of petroleum products and other hazardous substances shall be reported, contained, and removed in accordance with all applicable rules, regulations and laws. Contractor shall submit a project spill response plan at the pre-work meeting for review by the Contracting Officer.

C.7 PRE-BID CONFERENCE OR TOURS

• A Pre-Bid Tour will be conducted on August 25th, 2020 at 10 a.m. at the Porterville Work Center, 480 North Henrahan Street in Porterville, CA. Meet at the large unimproved dirt lot on the south end of the Porterville WC, adjacent to the intersection of East Morton Ave and North Henrahan St. Contractors shall notify the Contracting Officer of their intent to attend the pre-bid tour.

NOTICE OF ADDITIVE OR DEDUCTIVE ALTERNATES:

(a) The low offeror and the items to be awarded shall be determined as follows -

(1) Prior to the opening of bids, the Government will determine the amount of funds available for the project.

(2) The low offeror shall be the Offeror that -

(i) Is otherwise eligible for award; and

(ii) Offers the lowest aggregate amount for the first or base bid item, plus or minus (in the order stated in the list of priorities in the bid schedule) those additive or deductive items that provide the most features within the funds determined available.

(3) The Contracting Officer shall evaluate all bids on the basis of the same additive or deductive items.

(i) If adding another item from the bid schedule list of priorities would make the award exceed the available funds for all offerors, the Contracting Officer will skip that item and go to the next item from the bid schedule of priorities; and

(ii) Add that next item if an award may be made that includes that item and is within the available funds.

(b) The Contracting Officer will use the list of priorities in the bid schedule only to determine the low offeror. After determining the low offeror, an award may be made on any combination of items if -

(1) It is in the best interest of the Government;

(2) Funds are available at the time of award; and

(3) The low offeror's price for the combination to be awarded is less than the price offered by any other responsive, responsible offeror.

(c) Example. The amount available is $100,000. Offeror A's base bid and four additives (in the order stated in the list of priorities in the bid Schedule) are $85,000, $10,000, $8,000, $6,000, and $4,000. Offeror B's base bid and four additives are $80,000, $16,000, $9,000, $7,000, and $4,000. Offeror A is the low offeror. The aggregate amount of offeror A's bid for purposes of award would be $99,000, which includes a base bid plus the first and fourth additives. The second and third additives were skipped because each of them would cause the aggregate bid to exceed $100,000.

2.6 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—

(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is

2.8 52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—

(1) To unsuccessful bidders as soon as practicable after the opening of bids; and

(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be 20 percent of the bid price or 3,000,0000, whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
