About this file

This file is a Claim of Business Confidentiality Form established by the Utah State Archives Office of the Government Records Ombudsman for the Salt Lake City School District (SLCSD) related to the East High School Baseball Field Perimeter Landscape/Xeriscape Project. The form enables bidders to submit trade secrets and commercial financial information with confidentiality protection under Utah Code 63G-2-305 and 63G-2-309. Contractors must provide both redacted and non-redacted versions of their proposals, as the SLCSD will not perform redactions on behalf of claimants. The form requires bidders to identify specific pages, paragraphs, and detailed reasons for each confidentiality claim, along with complete claimant information including company name, address, representative contact details, and the governmental entity receiving the submission. A mandatory pre-bid site visit is scheduled for September 4, 2026 at 9:00 A.M., with attendance required for bid eligibility.

The confidentiality claim form serves to protect competitively sensitive information while maintaining public access through redacted versions of proposals. Claimants must submit a concise statement explaining how disclosure could reasonably result in unfair competitive injury, though filing a confidentiality claim does not guarantee protected classification if the government receives a records request. This form is integral to the procurement process as bidders must provide bid security equal to at least 5% of their total bid amount, and the selected contractor will be required to maintain a 100% Performance/Payment bond with liquidated damages of $500.00 per calendar day assessed for project completion delays. Bidders must possess an active S330 or B100 contractor's license and submit current licensure documentation with their bids.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
