About this file
This is a Minority and Women-owned Business Enterprise (MWBE) Utilization Plan form required by the New York State Department of Transportation (NYSDOT) for the Road Salt – Strategic Reserves procurement across Regions 1, 3, 5, 7, and 9. The form must be submitted with bids or proposals prior to contract award and requires contractors to provide detailed descriptions of supplies and services to be provided by each certified MWBE subcontractor and supplier, including their names, addresses, contact information, federal identification numbers, and NYS ESD certification status. Contractors must also specify the dollar value of subcontracts, supplies, and services along with intended performance dates for each component. The strategic reserves of road salt must be physically available on or before January 1, 2027, and dedicated exclusively for NYSDOT use, with all deliveries to various NYSDOT locations within designated regions completed by the end of March 2027.
If contractors are unable to fully meet the MBE and WBE goals specified in the contract, they must submit good faith efforts documentation and a request for waiver upon completion of the contract. Submission of the completed MWBE Utilization Plan constitutes the contractor's acknowledgment and agreement to comply with M/WBE requirements under NYS Executive Law, Article 15-A and 5 NYCRR Part 142. Failure to submit complete and accurate information may result in findings of noncompliance, rejection of the bid or proposal, or suspension or termination of the contract. The form requires signatures from the preparer and review by agency personnel, with spaces for utilization plan approval status, contract award date, estimated completion date, contract amount obligated, and notices of deficiency or acceptance.
