About this opportunity

The Utah State Board of Education (USBE) is soliciting proposals through Request for Proposals (RFP) USBE-JB26216-RFP to procure a Scholarship Granting Organization (SGO) to administer the Carson Smith Opportunity Scholarship Program under Utah Code 53E-7-401 et seq. and Board Rule R277-626-1 et seq. The SGO will provide comprehensive program administration services including maintaining a web-based electronic application system, processing scholarship applications on a first-come, first-served basis, determining student eligibility based on IDEA disabilities and Utah residency, managing school participation and monitoring, issuing scholarship awards, disbursing funds directly to schools or reimbursing parents, monitoring student enrollment status, and conducting annual reporting to USBE. The contract will be awarded to a single responsive and responsible offeror with the highest evaluation score and will have a five-year term. Proposals are due April 10, 2026, and must be submitted electronically through Utah Public Procurement Place (U3P). Mandatory minimum requirements include 501(c)(3) incorporation documentation, IRS determination letter confirming tax-exempt status, methodology for student eligibility and award determination, scholarship application and award processes, FBI Rapback system enrollment for all employees, performance rating system compliance, quarterly and semi-annual reporting commitments, conflict of interest confirmation, and fiscal soundness documentation such as audited financial statements or performance bonds. The RFP uses a multi-stage evaluation process: Stage 1 assesses nine mandatory minimum requirements on a pass/fail basis; Stage 2 evaluates technical proposals against detailed criteria weighted across Experience & Qualification (15.4% combined weight) and Solution categories (69.3% combined weight) for a total of 650 possible points with a minimum passing threshold of 487.5 points (75%); Stage 3 may include optional presentations with a maximum 50-point value and 75% passing threshold. Key technical scoring elements include the methodology for verifying student eligibility and award allocation (100 points), the scholarship application and award process (100 points), the implementation plan addressing management, marketing, conflict of interest, and data protection (150 points), and the plan for compliance with restricted fund use and financial responsibilities (200 points).

Prospective offerors must be organized and maintained as 501(c)(3) nonprofit organizations and must comply with all standard terms and conditions, including mandatory insurance coverage with minimum limits of $1,000,000 per occurrence for commercial general liability and $1,000,000 per occurrence/$2,000,000 aggregate for Protected Information Liability and Cyber Liability insurance when accessing or storing data. The RFP imposes strict data protection requirements under FERPA and Utah data privacy laws, requiring data to be stored within the United States, secure transmission, strong authentication controls, and notification of data breaches within 24 hours; student data use is restricted to purposes directly related to contract performance. Offerors must demonstrate fiscal soundness through either three years of comparable experience in another state, audited financial statements, or performance bond capability and must disclose any claims of non-performance or breach exceeding $5,000, pending litigation, or criminal convictions within the past five years. Financial restrictions mandate that at least 92 percent of collected program donations be expended on scholarships, with no more than 5 percent for program administration and 3 percent for marketing and fundraising costs; the 2025 donation cap was $5,940,000 with future year caps adjusted by statute. The maximum carry-forward of funds is limited to 40 percent of donations collected during the fiscal year, and excess amounts must be remitted to the State Treasurer; if annual scholarship awards exceed $500,000, the SGO must obtain an independent annual audit and submit CPA-prepared financial reports. No cost proposal is required as part of the RFP submission, and all costs incurred by offerors in preparing proposals, including interview or presentation costs, are the responsibility of the offeror and will not be reimbursed.
