About this file
This file is a GRAMA Claim of Business Confidentiality form issued by the Utah State Archives in accordance with Utah Code Section 63G-2-305 and 63G-2-309, designed for use in conjunction with the Utah State Board of Education's Request for Proposals for a Scholarship Granting Organization (Solicitation #USBE-JB26216-RFP). The form allows companies submitting proposals to assert claims of business confidentiality for specific information included in their RFP responses. Companies may designate protected categories including non-public financial statements, specific employee names and contact information, customer or client lists, and other proprietary information. The claim of confidentiality is supported by Utah Code Section 13-24-2's definition of trade secrets and provisions protecting commercial information or non-individual financial information where disclosure could result in unfair competitive injury or impair the government's ability to obtain necessary information in future procurements, provided the submitting company has a greater interest in prohibiting access than the public has in obtaining it.
The form requires the submitting company to provide a concise statement of reasons supporting the claim of business confidentiality, identify the specific information requiring protection through checkboxes corresponding to designated categories, and include authorized signatures with the company name and submission date. This document serves as the mechanism for offerors to protect sensitive competitive and financial information during the five-year contract procurement process for administering Utah's special needs scholarship program, ensuring compliance with state records laws while safeguarding legitimate business interests.
