About this opportunity
The Berkshire Regional Group Purchasing Program (BRGPP), acting on behalf of 32 participating municipalities in Berkshire County, Massachusetts, is soliciting competitive bids for FY27-08 Pavement Preservation Products under a three-year cooperative purchasing agreement effective July 1, 2026 through June 30, 2029. This procurement seeks pavement preservation materials and services including rubber crack sealing, fiber crack sealing, polymer and crumb rubber modified (PCRM) materials, polymer modified rejuvenating fog seal, spray applied penetrating asphalt rejuvenator, micro-surfacing, and cape seal applications across Northern, Central, and Southern Berkshire County regions. Estimated quantities range from 1,500 to 88,100 units across various measures, with specific allocations for each county region and participating municipality. All bidders must be pre-qualified by the Massachusetts Department of Transportation (MassDOT) for the pavement preservation products category, and field supervisory personnel must hold AASHTO TSP2 crack treatment certification for specialized applications such as fiber crack sealing and PCRM work. All contractors must ensure employees have completed OSHA 10-hour safety certification and comply with Massachusetts prevailing wage requirements pursuant to General Laws Chapter 149, Sections 26-27F and Chapter 30, Section 39M. Bid packages became available March 12, 2026, with questions due March 27, 2026 by 4:00 pm and responses provided by March 30, 2026 by 4:00 pm; bids must be submitted through the OpenGov online procurement portal no later than April 2, 2026 at 1:00 pm, with contractor selection scheduled for April 20, 2026. A mandatory site visit with the Director prior to bid submission is required, and a 5% bid deposit in the form of a bid bond, certified check, or cash is mandatory for all bids.
This procurement does not identify set-asides for disadvantaged enterprises or restrictions limiting participation to specific organizational types; however, bidders must meet MassDOT prequalification requirements for the pavement preservation products category. Successful bidders must execute a labor and materials payment bond equal to 50% of the awarded contract value and provide comprehensive insurance coverage including worker's compensation at statutory limits, employer's liability at $1,000,000, automobile liability at $1,000,000 combined single limit, general liability at $1,000,000 per occurrence with a $3,000,000 aggregate, and excess/umbrella liability at $4,000,000, with BRGPP and participating municipalities named as additional insureds. The estimated contract value for FY27-08 Pavement Preservation Products is $1,748,500.00, with prices to remain firm throughout the three-year contract period and subject to quarterly administrative fees of 1.75% of reported sales. Winning bidders must submit quarterly reports on the OpenGov platform within 21 days of each fiscal quarter end documenting sales and usage across participating municipalities. All bids exclude federal excise taxes and Massachusetts sales tax, and BRGPP and program participants are exempt from these taxes. The contract requires a one-year guarantee on materials with defective products replaced at no cost to participants, and no existing incumbent vendors or current contractors are identified in the procurement documents.
