About this opportunity
The Utah Division of Purchasing is extending Contract AK26-108 without competitive procurement, with a challenge-period deadline of October 14, 2026, based on a sole-source determination from the original solicitation.
The extension is necessitated by additional time required to complete a Request for Proposal (RFP). The notice invokes the Utah Procurement Code to permit non-competitive award where the original solicitation established that only one source exists for the procurement item. The Conducting Procurement Unit has submitted justification documentation (filed as "Claim of Business Confidentiality") supporting the sole-source basis; the Division of Purchasing will issue a written determination confirming the sole-source finding before award.
The extension requires a contract value increase to cover the extended performance period. The incumbent contractor will continue performance under extended contract terms, ensuring service continuity during the RFP development process.
Other interested vendors may contest the sole-source designation during the public challenge period by submitting documentation demonstrating they can provide comparable, equal, or superior items meeting or exceeding specifications, along with cost comparisons if transitional costs are the non-competitive award basis. All vendors submitting challenges must certify compliance with Utah Code 63G-27 regarding economic boycotts and boycotts of the State of Israel, and must agree not to engage in such boycotts during the contract term.
The source does not identify the specific products or services, contract value, incumbent vendor name, contract term length, or performance location. Additional funding may be provided if the legislature appropriates funds for the scope of work.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that the original solicitation was stating there was only one source for the procurement item. We are now extending this contract until the RFP is completed which necessitates an increase for the additional time. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
