About this file

This is a Claim of Business Confidentiality document submitted to the Utah Division of Purchasing by a Conducting Procurement Unit regarding the extension of contract AK26-108. The document pertains to the justification for awarding a contract without engaging in a standard competitive procurement process, based on the determination that only one source exists for the procurement item. The extension is necessary to allow additional time for the Request for Proposal (RFP) process to be completed, which requires a contract value increase to cover the extended period. The claim asserts that the original solicitation identified a single source provider for the required products or services, thereby supporting the non-competitive award methodology.

The document establishes the legal basis under the Utah Procurement Code for proceeding with a non-standard procurement process contingent upon written determination by the Division of Purchasing. The Conducting Procurement Unit has submitted detailed justification documentation in the file section to support its position that competition is not feasible or appropriate in this instance. This approach allows the incumbent contractor to continue performance under the extended contract terms while the RFP development process concludes, thereby ensuring continuity of services and preventing operational gaps during the transition period.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
