The scope of work includes removal of existing temporary traffic control elements, approximately 600 square feet of hot mix asphalt pavement work with 6-inch excavation and 6-inch HMA, installation of approximately 330 square feet of concrete sidewalk (4-inch thick), 45 linear feet of curb and gutter, removal of 30 linear feet of asphalt berm, offhaul of 2 K-rail barriers, and installation of detectable warning tiles, all in compliance with Union Pacific Railroad safety, operational, and construction requirements per the Public Highway At-Grade Crossing Agreement. Qualified contractors must possess project management experience, demonstrate comprehensive project understanding and appropriate approach, maintain qualified personnel and relevant team qualifications, and submit responsiveness to RFP requirements with appropriately structured cost proposals submitted on a not-to-exceed basis with separate line-item pricing for mobilization, recycling implementation, traffic control, hot mix asphalt, minor concrete work, asphalt berm removal, K-rail offhaul, and detectable warning tiles. The evaluation criteria are weighted equally at 10 points each (16.7 percent) across six categories: project management experience, project understanding, approach, qualifications of firm and team, responsiveness to RFP requirements, and appropriateness of cost. Contractors must be registered with the California Department of Industrial Relations (DIR) as all vendors bidding on Public Works-Prevailing Wage projects exceeding $15,000 for maintenance and $25,000 for new construction must maintain this registration. Critical deadlines include a mandatory pre-proposal conference and site walkthrough on March 26, 2026 at 2:00 PM via Microsoft Teams teleconference, a question submission deadline of April 3, 2026 at 4:00 PM with responses provided by April 10, 2026, and a proposal submission deadline of 2:00 PM on Tuesday, April 14, 2026 via the City's eProcurement Portal, with contractor selection scheduled for May 5, 2026.
The solicitation does not specify set-aside designations for disadvantaged enterprises or restrictions limiting bidder eligibility based on organizational type; however, all contractors must comply with the City of Hayward's nondiscriminatory employment practices and affirmative action requirements, prevailing wage obligations under California Labor Code Sections 1770-1780, and comprehensive insurance requirements including commercial general liability of $2,000,000 per occurrence and business automobile coverage of $1,000,000 combined single limit, along with additional Union Pacific Railroad-specific insurance requirements of $5,000,000 per occurrence/$10,000,000 aggregate for commercial general liability and $2,000,000 per occurrence/$6,000,000 aggregate for railroad protective liability. Contractors must also obtain and execute a Contractor's Right of Entry (CROE) Agreement with Union Pacific Railroad, submit a non-refundable administrative fee of $1,025.00, complete mandatory Property Access Training, and comply with all UPRR safety standards including required flagging by UPRR-approved flagmen, personal protective equipment compliance with ANSI standards, and comprehensive preconstruction requirements including Construction and Maintenance Agreements, Safety Action Plans, and Emergency Response Plans with a minimum 4-6 weeks review time for UPRR design and construction submittals. Performance and Labor and Materials Bonds are required at not less than 110 percent of the total contract amount, with the contractor responsible for all operating costs including labor, supervision, equipment, insurance, maintenance, and project-specific expenses such as UPRR flagging services provided at prevailing wage rates. No incumbent vendor, current contractor, or specific budget range is identified in the available documentation; however, the contract term is expected to run from award through a City-determined termination date with potential renewal options at the City's discretion.
