About this opportunity

The State of Utah Division of Purchasing is soliciting proposals under Solicitation SB26-12 for consultants to develop and manage Job Order Contracting (JOC) construction programs, with proposals due November 20, 2026. The statewide cooperative contract is available to state departments, institutions, political subdivisions, colleges, school districts, counties, cities, and authorized nonprofits, and it may result in multiple awards. No set-aside or local-vendor preference applies. The evaluation gives no preferential treatment to consultants holding existing or prior State of Utah contracts.

Each awarded consultant must supply a complete JOC solution: proprietary software, customized unit price catalogs, a State-approved JOC subcontractor roster, and ongoing technical and procurement support. The software must maintain 99.9% uptime during standard business hours, acknowledge support requests within two business hours, and resolve critical outages within 24 hours. The program must be fully implemented within 60 calendar days of contract execution, and missing that timeline may result in liquidated damages or contract termination. Consultants source and manage subcontractors, collect insurance records, and comply with bonding requirements for job orders over $50,000. Required coverage includes commercial general liability of $1 million per occurrence and $3 million aggregate, and commercial automobile liability of $1 million per occurrence. Contractors employing Utah personnel must register with E-Verify.

The contract term is five years, with pricing guaranteed for one-year periods. Consultants propose a percentage management fee tiered by job order value: $1 to $100,000, $100,001 to $500,000, $500,001 to $1,000,000, and $1,000,001 and over. That fee must be fully inclusive of software licensing, hosting, implementation, and training. Fully burdened hourly rates for Senior Cost Estimator, JOC Program Trainer, Software Developer, and Administrative Support are fixed for 12 months, then may increase annually up to the lower of the Consumer Price Index or 3%. Program usage history shows $2.9 million in spending over the previous five years.

Evaluation allocates 750 technical points (65%) across five categories containing 15 scored criteria. Consultants must score at least 487 technical points to advance to cost evaluation. Cost carries 250 points (35%) under a lowest-price formula. Awards require at least 650 of 1,000 combined points. Mandatory submissions include the Cost Sheet (Attachment C) and Technical Criteria Responses (Attachment D), and pricing must not appear in technical responses. Pricing is public record unless a Claim of Business Confidentiality is filed with a redacted proposal.
