About this opportunity
The Nevada State Purchasing Division, on behalf of the Business and Industry's Nevada Real Estate Division - Office of the Ombudsman for Common-Interest Communities and Condominium Hotels, is seeking Alternative Dispute Resolution (ADR) mediators to provide mediation services for residential property disputes under NRS Chapter 38. The procurement is a Request for Proposals (RFP #74BAI-S3162) targeting qualified vendors who can conduct fair and objective mediations between Claimants and Respondents, with responsibilities including interpreting covenants, conditions, restrictions, bylaws, and assessment procedures. Mediators must complete sessions within 60 days of claim filing, with individual sessions limited to 3 hours, and be available in relevant geographic locations. The evaluation criteria will assess vendors on Turn Around Time (30%), expertise in mediation services (30%), conformance with RFP terms (20%), expertise and availability of key personnel (10%), and cost (10%). Proposals are due by 2:00 PM PT on April 16, 2025, with questions accepted until March 26, 2025. The resulting contract will be a four-year term, estimated to start August 12, 2025, subject to Board of Examiners approval.
The procurement offers a 5% preference to Nevada-based businesses and applies an inverse preference to out-of-state vendors from states that do not provide reciprocal preferences to Nevada vendors. Contractors must maintain specific insurance coverage, including Workers' Compensation, Employers' Liability, and Professional Liability (Errors and Omissions) with defined minimum limits. The mediators will be compensated at a rate of up to $167 per hour, not exceeding $500 for a standard 3-hour session, with additional hours billable at up to $200 per hour. Costs are typically split equally between parties, though the Division may provide subsidies up to $500 per mediation or $250 per party, depending on legal authorization. Vendors must encrypt data and maintain it within the United States, provide updated resumes for the Division's website, and potentially attend up to 4 hours of annual instruction. While no specific incumbent vendors are mentioned, the contract requires mediators to secure their own meeting locations and be responsible for collecting unsubsidized costs directly from parties involved in the dispute.
