About this file

This document is a Scope of Work (SOW) for the Nevada State Purchasing Division's Alternative Dispute Resolution (ADR) Mediator Panel, involving the Nevada Real Estate Division's Office of the Ombudsman for Common-Interest Communities and Condominium Hotels. The procurement seeks qualified mediators to conduct dispute resolution services for residential property issues under NRS Chapter 38, with a Request for Proposals (RFP #74BAI-S3162) targeting vendors who can mediate conflicts related to homeowner association covenants, conditions, restrictions, bylaws, and assessment procedures. The contract will be a four-year term estimated to start August 12, 2025, with proposals due by 2:00 PM PT on April 16, 2025, and questions accepted until March 26, 2025. Mediators must complete sessions within 60 days of claim filing, with individual mediation sessions limited to 3 hours, and be geographically accessible to dispute parties.

Compensation is structured at up to $167 per hour, not exceeding $500 for a standard 3-hour session, with additional hours billable at up to $200 per hour. The procurement offers a 5% preference to Nevada-based businesses and includes inverse preferences for out-of-state vendors. The Division may provide subsidies up to $500 per mediation or $250 per party, with costs typically split equally between parties. Contractors must maintain specific insurance coverages, encrypt data within the United States, provide updated resumes for the Division's website, and potentially attend up to 4 hours of annual instruction. Mediators are responsible for securing their own meeting locations and collecting unsubsidized costs directly from dispute participants, with evaluation criteria focusing on turn-around time (30%), mediation service expertise (30%), RFP term conformance (20%), key personnel expertise (10%), and cost (10%).
