About this file
The document is a Question and Answer (Q&A) file for RFP #74BAI-S3162, issued by the Nevada State Purchasing Division on behalf of the Business and Industry's Nevada Real Estate Division - Office of the Ombudsman for Common-Interest Communities and Condominium Hotels. The RFP seeks Alternative Dispute Resolution (ADR) mediators to provide mediation services for residential property disputes under NRS Chapter 38, with proposals due by 2:00 PM PT on April 16, 2025. The contract will be a four-year term, estimated to start August 12, 2025, and requires mediators to complete sessions within 60 days of claim filing, with individual sessions limited to 3 hours. Mediators must be available in relevant geographic locations and conduct fair, objective mediations between Claimants and Respondents, interpreting covenants, conditions, restrictions, bylaws, and assessment procedures.
The mediators will be compensated up to $167 per hour, not exceeding $500 for a standard 3-hour session, with additional hours billable at up to $200 per hour. Costs are typically split equally between parties, with the Division potentially providing subsidies up to $500 per mediation or $250 per party. The procurement offers a 5% preference to Nevada-based businesses and applies an inverse preference to out-of-state vendors. Contractors must maintain specific insurance coverage and encrypt data within the United States. The evaluation criteria will assess vendors on Turn Around Time (30%), expertise in mediation services (30%), conformance with RFP terms (20%), expertise and availability of key personnel (10%), and cost (10%). Mediators are required to secure their own meeting locations and collect unsubsidized costs directly from dispute parties, with the option to conduct mediations virtually or in-person based on participant agreement.

| QUESTION_NBR | CREATED_BY | QUESTION_SUBJECT | QUESTION_TEXT | ANSWER_TEXT |
| 1 | POSITCON21 | Location of services | Are vendors able to provide mediations virtually, or are in-person sessions a requirement? | The decision of whether the Mediation is held in person or virtual will be determined by the participants. If both parties agree to a virtual Mediation, then the Mediation may be held virtually. If one parties requests in person Mediation, it will default to an in person meeting. |
| 2 | BLACKACRE | References | I have only worked with two agencies/clients for my mediation work. Can a third reference be from another source/regarding other professional work such as my work as an attorney? Would multiple references from the same agency/client be sufficient? For example, I could obtain a second reference from the Neighborhood Justice Center, if needed. Will you confirm when a reference is received on my behalf? I was informed that my reference from Neighborhood Justice Center had been completed and I advised them to send it directly to your attention. | A Vendor may submit the documentation they feel will meet the requirements of the RFP. All information provided will be reviewed for consideration by the Evaluation Committee. In this case, if a second reference is available from the same agency, you are welcome to provide it. The point of contact from State Purchasing may confirm if a reference was received on your behalf. |
| 3 | BLACKACRE | Insurance | Should the certificate of insurance be sent directly to your email? Or delivered in a different manner/to another inbox? | A current certificate of insurance should be provided to the point of contact from State Purchasing identified in the RFP. |
| 4 | BLACKACRE | Standard Form Contract | Does the Standard Form Contract need to be filled in/signed and submitted as an attachment? Or is this just informational and the completed contract will be provided if my company is chosen? | During the RFP process a copy of the contract is provided for informational purposes only. |
