About this opportunity

The Department of Veterans Affairs (VA) is seeking a new lease for the Burlington Community Based Outpatient Clinic (CBOC) located in Burlington, Vermont. The VA intends to award a sole-source lease to Fortieth Burlington, LLC under the General Services Acquisition Manual (GSAM) Part 570.402, which allows non-competitive procurement when alternative locations would result in substantial duplicate costs. The procurement requires approximately 17,147 ABOA/21,017 rentable square feet of medical space within the Burlington city limits, with the space necessary to be available for occupancy by December 31, 2024. Interested parties are invited to submit written statements of capability demonstrating their ability to meet the VA's requirements, with responses due by December 11, 2024, at 4:00 PM EST. The VA will evaluate potential alternate locations based on factors including physical move costs, tenant improvement replication, telecommunications infrastructure, and potential agency operational downtime.

The lease opportunity is not set aside for any specific business category and is classified under NAICS code 531120 for Lessors of Nonresidential Buildings. The proposed lease term is up to 10 years, consisting of a 4-year firm term and a 6-year non-firm term, with no tenant improvements to be performed under the succeeding lease award. The current lease for the clinic, located at 128 Lakeside Ave, expired on August 30, 2023, and the VA requires continued operational continuity for its medical services. While the VA is primarily considering a sole-source award to the current property owner, they remain open to alternative spaces that can meet their operational requirements and provide economic advantages. Respondents should note that submitting a capability statement does not guarantee lease award, and the VA assumes no responsibility to award a lease based on any affirmative responses to this advertisement.

DEPARTMENT OF VETERANS AFFAIRS (VA) ADVERTISEMENT FOR SUCCEEDING LEASE ACTION

The Department of Veterans Affairs (Government) intends to award a succeeding lease to Fortieth Burlington, LLC under the authority of General Services Acquisition Manual (GSAM) Part 570.402. This regulation authorizes use of the sole source lease awards where it is determined that award to any other location would result in substantial duplication of costs to the Government that are not expected to be recovered through competition.

THIS ADVERTISEMENT IS NOT A REQUEST FOR LEASE PROPOSALS- However, any party who believes it can provide a facility that would satisfy the above requirements, is invited to submit a written statement of capability to do so, with evidence to support its claim. Responses received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this advertisement. This advertisement does not obligate the Government to award to any lease contract.

The Department of Veterans Affairs currently occupies clinical and related space at 128 Lakeside Ave, Burlington, VT 05401 in a lease that expired August 30, 2023. To satisfy the VA mission requirements, the current Burlington Community Based Outpatient Clinic (CBOC) must remain operational.

Term: Estimated term is up to 10-years; 4-years firm term, 6-years non-firm term.

Tenant Improvements: No tenant improvements will be performed under the succeeding lease award.

Space Availability: The space must be available for occupancy by December 31, 2024.

Rentable Square Feet: Approximately 17,147 ABOA / 21,017 Rentable Square Feet (RSF) of Medical Space.

Location: To be considered, space must be within the following delineated area:

City Limits of Burlington, VT

The Government will consider alternative space if it is economically advantageous, and that otherwise the Government intends to pursue a sole source acquisition. In making this determination, VA will consider, among other things, the availability of alternate space that potentially can satisfy the Government's requirements as well as all costs likely to be incurred through relocating such as physical move costs, replication of tenant improvements and telecommunications infrastructure, and non-productive agency downtime. VA will consider leased space located in another existing building providing all costs mentioned above can be offset by competition.

Affirmative responses to this advertisement: Interested parties are invited to submit the above notice and evidence via email to Melinda.Sandrson@va.gov no later than December 11, 2024, by 4 PM EST.

RESPONDENTS ARE ADVISED THAT THE VA ASSUMES NO RESPONSIBILITY TO AWARD A LEASE BASED UPON ANY AFFIRMATIVE RESPONSE TO THIS ADVERTISEMENT.
