About this opportunity
The U.S. Army Corps of Engineers New York District (USACE) sought sealed bids for maintenance dredging of the Arthur Kill 35' Reach, New York and New Jersey Channels Federal Navigation Project, with bids due June 4, 2026. The procurement is a firm fixed-price Invitation for Bid with no set-aside.
Place of performance is Staten Island, NY. The contractor must remove approximately 150,000 cubic yards of material from critical shoals to maintain a depth of -35 feet Mean Lower Low Water (MLLW) plus 1 foot allowable overdepth, primarily from silt with sand and clay composition. The work requires mechanical dredging with an environmental clamshell bucket due to State Water Quality Certificate restrictions, along with multiple barges and tugboats for dredging, dewatering, and unloading operations. The contractor must furnish all state-permitted upland placement sites and obtain all necessary federal, state, and local permits for material transportation, transfer, dewatering, processing, and placement within 35 calendar days of notification as apparent low bidder. Work must commence within 5 calendar days of receiving the Notice to Proceed and maintain a minimum integrated production rate of 2,500 cubic yards per calendar day. Basic work must be completed within 39 calendar days; optional work allows one additional day per 2,500 cubic yards exercised. The estimated contract value ranges from $10 million to $25 million. NAICS code is 237990. Davis-Bacon prevailing wage requirements apply. Liquidated damages are $3,230 per calendar day of delay. A bid guarantee of 20 percent of bid price or $3 million, whichever is less, is required. Two bids were received: Dutra Group at $30,590,087 (base $16,977,107; option $13,612,980) and Donjon Marine Co. LLC at $24,703,050 (base $17,199,750; option $7,503,300). Amendments 0001–0004 were issued prior to bid opening, adding environmental sampling data, water quality certifications, and extending the bid date to June 4.
Notice text
The New York District of the U.S. Army Corps of Engineers (USACE) proposes to perform maintenance dredging of portions of the New York and New Jersey Channels, Arthur Kill 35’ Reach, Federal Navigation Project. The dredged material would be processed and subsequently transported to and placed at a contractor furnished, State permitted upland placement site(s). The proposed maintenance dredging would remove approximately 150,000 cubic yards (CY) of selected critical shoals from the Arthur Kill 35’ Reach. Dredging in this channel would be required to a depth of -35 feet Mean Lower Low Water (MLLW) plus 1 foot allowable overdepth. The dredged material is expected to consist primarily of silt, with some sand and clay.
Due to restrictions in the State Water Quality Certificates, the proposed work requires the use of a mechanical dredge with an environmental clamshell bucket. Additionally, multiple barges and tugboats will be needed to perform the work during the dredging, dewatering and unloading operations. The dredged material will be required to meet all federal, state, and approved local criteria required by the government agencies having jurisdiction where the placement site is located. All necessary permits required for the dredged material placement will be provided by the contractor to the government.
The apparent low bidder shall, within 35 calendar days from the date the apparent low bidder is notified of being such, provide copies of all required permits and approvals for transportation, transfer, dewatering, processing, and final placement of dredged material, and shall submit evidence of such permits and approvals to the government. Bidders should consult the specifications for all submittal requirements.
Once the contract is awarded, the contractor will be required to commence work within five (5) calendar days after the date of receipt of the notice to proceed and maintain an integrated production rate of at least 2,500 cubic yards per calendar day for the dredging, transportation, transfer, dewatering, processing, and final placement of the material. The presence of dredging equipment in the channel will impact ship traffic, and it is necessary to maintain this production rate while minimizing the duration of this impact.
Plans and specifications for the subject project are expected to be available in April of 2026, with bid opening in May 2026. It is the intention of the government to award in June/July 2026 and the proposed work is anticipated to take place between October and December 2026.
The magnitude is estimated to cost between $10,000,000 and $25,000,000.
Liquidated damages of $3,230.00 per calendar day of delay will be assessed to the contractor until all work under the contract is accepted as complete.
This is an unrestricted procurement.
