Justification and Approval for Other than Full and Open Competition Justification
1. Contracting Activity:
National Guard Bureau Operational Contracting Division in support of the United States Property and Fiscal Office (USP&FO) for Alaska, Contracting Division, Camp Denali, JBER- Richardson, Alaska 99505.
2. Description of Action: A new competitive firm fixed price construction contract which includes “Brand name only” components listed below, which will be awarded using ARNG MILCON funding.
3. Description of Supplies/Services: Construct a new USPFO building (Project No.
020143) in support of the Alaska National Guard (AKNG) at Joint Base Elmendorf- Richardson, Alaska that includes Best Lock Cores as a brand name component. The door hardware lock cores are required to be utilized on all AKNG facilities in Alaska in order to comply and integrate with the current system utilized by the Alaska Army National Guard (AKARNG) Construction and Facility Management Office (CFMO). The use of a single lock core enables the systematic management of the lock system on the facilities including those belonging to the AKARNG. This single lock core provides for single keying and tracking mechanism on all installation buildings. This will allow for an emergency response master key to work properly in all emergency situations utilized by Joint Base Elmendorf Richardson (JBER) security forces and fire department. This will reduce maintenance costs for the AKARNG over the life-cycle of the building. The current government estimated cost of the brand name component listed for a total of 58 locksets is approximately $2,100.
4. Authority Cited: The statutory authority permitting Other than Full and Open Competition is 10 U.S.C. 2304(c)(1) as implemented by FAR 6.203-1, Only one responsible source and no other supplies or services will satisfy agency requirements– it is likely that award to any other source would result in substantial costs to the Government that will not be recovered through competition.
5. Reason for Authority Cited: In accordance with FAR 6.302-1(c)(1)(ii)(A) Application for brand name descriptions; if only a portion of the acquisition is for a brand-name product or item peculiar to one manufacturer, the justification and approval is to cover only the portion of the acquisition which is brand-name or peculiar to one manufacturer.
Although there are other manufacturers of lock systems that can meet the Government's minimum requirements, it is not in the Government's best interest to award an acquisition to any other brand. Best Lock Cores are used exclusively at all AKARNG facilities and it is in the best interest to maintain consistency of the lock system. Use of other manufacturers would incur additional costs due to additional inventory, incompatibility with existing equipment, and increased training.
6. Efforts to Obtain Competition: The brand-name requirement for this acquisition comprises only a small portion of the overall cost of the facility. The government will compete the construction of the facility as a Small Business Set-Aside. Multiple vendors are capable of suppling the required brand-name specific items. The brand name component represents a very small portion (0.008%) of the overall construction project.
7. Actions to Increase Competition: This document will be posted on FedBizOpps along with the solicitation of the construction contract.
8. Market Research: The existing locks throughout the entire AKARNG are Best Lock Cores. The Locks require the same manufacturer in all facilities throughout the state.
Market research reveals multiple vendors are available to compete on the brand name requirement. Different manufactures would require additional equipment for lock and key cutting, different brand keys, multiple Grand master keys that would drastically increase overhead for lock control. Also, the Best system has the unique “figure 8” style lock core, which other brand keys and cores do not fit.
9. Interested Sources: There are no known alternative systems that are fully compatible with the aforementioned systems based upon lessons learned and expert judgement by the subject matter experts and experience of the Alaska Army National Guard, and National Guard Bureau.
10. Other Facts: The selection of Best Lock Cores has been used on all previous construction contracts accomplished at JBER for the AKARNG. Consistency of the systems is required to:
a. Ensure facility security on the installation
b. Reduce maintenance costs over the life-cycle of the facility
c. Reduce response time in emergency situations
d. Reduce spare parts stock costs for AKARNG
