Section M - Evaluation Factors for Award

52.212-2 ADDENDUM

EVALUATION – COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

1. Quotes for this acquisition shall be evaluated utilizing Simplified Acquisition Procedures as outlined in FAR subpart 13.106-2 and FAR subpart 13.5. This acquisition will be awarded to an offeror who is responsive to the RFQ and otherwise determined responsible, conforms to the solicitation requirements; and provides the Lowest Priced Technically Acceptable (LPTA) quote. Award shall be made to the lowest priced technically acceptable quotes meeting or exceeding the acceptability standards for non-cost factors. Quotes are evaluated for acceptability but not ranked using the non-cost factors. The best value to the Government will result from the selection of the technically acceptable quotes with the lowest overall evaluated price. No award shall be made by a Contracting Officer unless the price can be determined as fair and reasonable.

Responsible Offeror: An Offeror may be determined as responsible in accordance with the criteria outlined in FAR Subpart 9.104.

Responsive Offeror: A quotation is determined responsive if it contains all of the elements instructed to be provided under the 52.212-1 Addendum Instructions to Offerors and the conditions of this solicitation.

SAM registration will be reviewed to ensure registration is current and that no exclusions or debarments exist that would otherwise prohibit an award. Offeror’s Representations and Certifications must be updated and current through the offeror’s SAM registration which may be referenced at https://www.sam.gov.

2. Technical Response; The offer’s quote will be evaluated against the requirements within the Solicitation to include the Performance Work Statement (PWS) and all applicable attachments on an Acceptable or Unacceptable basis. Acceptable ratings are defined as those that meet or exceed the specifications and requirements identified in the solicitation. An unacceptable rating means that the quote does not clearly meet the requirements of the solicitation. An unacceptable quote has one or more deficiencies. Each quote's technical approach will be evaluated to determine the offeror's ability to successfully process the required volume of laundry and drycleaning services identified in the PWS. A quote containing items that exceed requirements do not merit additional consideration for award as no tradeoffs will be considered as this is a Lowest Price Technically Acceptable award.

The following rating system shall be applied for Technical Response;

Rating Definition Acceptable Offer clearly meets the minimum requirements of the solicitation.

Unacceptable Offer does not clearly meet the minimum requirements of the solicitation.

3. Past Performance: The Past Performance evaluation will assess the offeror's probability of meeting the solicitation requirements as indicated by that offeror’s record of past performance. Offerors are notified, that in conducting the performance assessment, the Government may use data provided in the offeror’s proposal and data obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems and State Department Watch Lists.

Each offeror will receive a performance confidence assessment rating based on the Offeror’s recent and relevant record of performance in supplying services that meet the contract's requirements. There are three aspects to the past performance evaluation:

(a) Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past 3 years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated further.

(b) Relevancy Assessment. To be relevant, the effort must be of similar in nature of work, size, and complexity. The Government will conduct an evaluation of all recent performance information obtained to determine if it is the same or similar in nature, size, and complexity to the services/products being procured under this solicitation. A relevancy determination of the offeror’s (including joint venture partner(s) and major and critical subcontractor(s)) past performance will be made. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated. The past performance information provided in the proposal and obtained from other sources will be used to establish relevancy of the past performance. There are two levels of relevancy as shown below.

Table 1. Past Performance Relevancy Findings

Finding Description Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

(c) The final aspect of the past performance evaluation is to establish the overall quality of the offeror's past performance. The past performance evaluation performed does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.

In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.

4. Pricing Response: The Government will evaluate proposed prices for reasonableness using price analysis techniques in accordance with FAR 13.106-2 and FAR 52.217-5. The lowest overall price of technically acceptable offers shall be awarded requirement, provided the Offeror is not otherwise excluded. Unbalanced Pricing may be evaluated as applicable, to assess potential performance risk which could result in unreasonably high prices.

5. Options: The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Option to Extend Services will be included in the price evaluation as follow: As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding six months of the offeror’s final period price to the offeror’s total price. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). Offerors are required only to price the 5 Year ordering period. Offerors shall not submit a price for the potential six-month extension of services period. The Government may choose to exercise the Extension of Services at the end of any performance period, utilizing the rates of that performance period.
