SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

AMENDMENT 0006

Requests for Information

1. Do projects have to be 100% complete or is substantially complete acceptable?

Per Factor 1 Team Experience Submission Requirements – “Projects provided must be completed within the past eight (8) years, as of the issue date of this RFP, to be considered.” Substantially complete projects are acceptable. For the purposes of this solicitation and resulting contract, projects that have completed demobilization, and only have administrative requirements remaining are considered substantially complete and are acceptable to provide as team experience.

2. Section L, Factor 4 Cost Submission Requirements: Several of the submissions requirements for Factor 4 appear to be much more detailed than those specified within prior similar CENAE solicitations and will require significant time and effort by the offeror and major subcontractors. These items include the Major Subcontractor, Direct Material/Bill of Material (BOM), Travel, and Basis of Estimates detail requirements. These requirements, in addition to the proposed project being awarded as a Cost-Plus Fixed Fee type contract, may limit the number of SB Offerors that are able to respond to this solicitation. Respectfully, it is requested that CENAE extend the current proposal deadline to provide SB offers at least 21 calendar days after the date of issuance by CENAE of their final RFI responses in order to provide sufficient time to incorporate all responses and properly respond to this complex solicitation.

Please see update to required response date in Amendment 0006.

3. Reference Drawings C-09, C-10, and C11 showing gate access to each phase work area. Please provide a haul/access route the contractor shall use/take to the phase entry gate for this project.

The haul route will be finalized with DMC facility upon selection of successful Contractor. There are two roads into and out of the workzone. For the purpose of estimating costs, the Government does not expect there to be a difference in distance based on decided route.

4. Section 02000 Temp Electric Service & Line Replacement (1.01/1.02 Phase 01A & 01B Work)- IT states the electrical contractor shall acquire services of an onsite generator mechanic who will be onsite at all times for the duration of the site remediation project. Please advise whether this person is required to follow OSHA 29 CFR

1910.120 HAZWOPER requirements (i.e., 40-hr HAZWOPER certified, etc.).

Task specific training requirements for the project shall be determined by the Contractor and identified in their APP/SSHP using the Task Hazard and Control Sheets at the end of this section. This project is on a CERCLA site and applicable requirements of OSHA 29 CFR 1910.120 must be followed per Section 01 35

29.13 - 3.2 and 3.3. Also refer to EM 385-1-1.

5. The specification says the Contractor shall provide a water treatment system capable of treating water generated during construction dewatering (described in Specification Section 02240 – Dewatering) to the effluent standards required to comply with the intent of the Connecticut General Permit for the Discharge of Groundwater

Remediation Wastewater Directly to Surface Water and any other applicable State and Federal discharge permits, prior to discharge to an on-site storm drain.

BOD Section 6.3 says that under CERCLA, no discharge permit would be required to discharge to a storm drain.

Please clarify if the contractor is required to obtain a permit to discharge treated groundwater to the on-site storm drain.

The Contractor is not required to obtain a permit, but discharge contaminant levels must meet the Connecticut General Permit for Discharge of Groundwater remediation wastewater directly to Surface water.

6. Drawing C-15 references a “regular fill” for use on the Site. However, Section 02300 (Backfill and Grading) does not identify a “regular fill”. Section 02300 does identify a “common fill”. Are the terms for “regular fill” and “common fill” the same and the intent is to use “common fill” where “regular fill” is identified?

“Regular fill” and “common fill” are the same.

7. Can you provide the type and size of the water lines between Buildings “A” and “B”? If not known, can you provide assumptions for the contractors to use for bidding purposes?

The water line is 1.5” between buildings; but there’s also a 4” air, 4” fiber, 2 x 4” electrical and a 4” and 2” spare running between the buildings.

8. There is a reference in the specifications (02245 1.04E) to minimum design requirements being listed in the Drawings. The location of the treatment system and discharge point are shown on the drawings, but we did not see additional design requirements. Are there any requirements outside of what is listed in the specification (i.e. 02245 2.01)?

No, all requirements are included in 02245.

9. Given the significant quantity of information required from both the Prime and potential Subcontractors to support the estimate, please consider extending the bid due date to Wednesday, November 16, 2022, and extending the period for questions to Friday, October 28, 2022, to allow adequate time for a thorough review of the project requirements. We are highly concerned about being able to meet the requirements for the RFP if the due date remains November 7, 2022.

The RFI deadline was extended to 28 October 2022 and proposal deadline extended to 14 November 2022 by Amendment 0005. The required response date is further extended to 02 December 2022 by this amendment.

10. The bid schedule provides quantities for many of the bid items.

A) How is the quantity to be measured for quantities where the unit is Cubic Yard (CY)? i.e., in situ or truck yards?

B) The conversion for CY to tons appears to be 1.45 CY to Tons. Is there any data to support this conversion?

C) For quantities where the unit is based on a duration, (month, day or hour) when does the duration start and end?

D) For the bid items where the unit is days, please confirm whether these are calendar or work days.

E) For the bid items where the unit is months, please confirm that these are based on a full calendar month (i.e. 29, 30, or 31 days).

F) Based on the contract being a Cost Plus Fixed Fee (CPFF), if the actual quantities increase from the estimated quantities, please confirm the increase in cost is fee bearing?

A) CY is in-situ.

B) The conversion used is 1.6 tons/cy, not 1.45 cy/ton, when considering both non-hazardous and RCRA characteristic soil in the calculation. The conversion is based on prior experience in the vicinity.

C) Duration Starts/Ends based on Contractor’s schedule.

D) Days are the number of days that the item requires. This may be calendar days, in the case of required electrical service, or working days, if dewatering only is occurring on working days.

E) Bid items where unit is months are based on the average total days per month which is 30.4 days.

F) Only a change in the contract’s scope may result in an increase in the fee. Offerors shall submit a proposal based on quantities they expect the work to require.

11. Numerous on-site activities need to be performed to gather data for the preparation of various plans prior to general mobilization, i.e., preconstruction soil sampling and analysis, structural condition assessment, topographic survey and preconstruction photo video data collection. Please confirm that the contractor will have site access before full mobilization.

The successful contractor will have site access upon contract execution.

12. With regards to 02000 Temporary Electric Service and Line Replacement:

A) Please provide the electrical service size fed from utility transformer A (Amperage & Voltage).

B) Please provide the electrical service size fed from utility transformer B (Amperage & Voltage).

C) Please provide the electrical feeder size from transformer B service to Panel B (Amperage & Voltage).

D) Please provide the electrical feeder size for Panel A (Amperage & Voltage).

E) Please confirm that the electricity provider to the Durham Manufacturing Company is Eversource Energy and provide the electricity providers' contact information to coordinate electrical project requirements needed to determine bid costs.

F) Can a temporary aboveground electrical service be installed instead of a temporary generator system?

A, B, C, D & E) Exact details of the actual temporary electrical service will be determined in the Temporary Power Work Plan. Reference Section 02000, “Temporary electric service and line replacement” for currently available information.

F) No temporary aboveground electrical service can be installed due to technical issues previously identified.

13. Considering the complexities of this cost reimbursement contract from a pricing standpoint, an upcoming amendment that needs to be provided to modify GW specifications, and Amendment 0005 RFIs that have required us to modify our execution plan, please consider a two-week extension to the current due date.

See response to Question 2.

14. Please provide at least an additional two (2) weeks now for planning, as well as after all questions and answers are addressed and additional information is provided to allow time to evaluate and address impacts from clarifications for this project.

See response to Question 2.

15. Reference Amendment 0003, Q&A 11 – Does the pavement have to be restored in phases? Or can the asphalt pavement be paved in one (1) final stage?

The remediation activities will be broken into phases to ensure that the manufacturing building is able to continue normal operations. Each phase of work will be excavated and fully restored before proceeding to isolate and excavate the next phase, in accordance with Specification Section 01 11 00, Part 1, Para 1.1.

16. Reference 02260-4, 1.08(B) – “The Work will be sequenced so that Phase 01 and Phase 02 are completed separately”. Can Phase 1A and Phase 1B take place concurrently? Please clarify.

In accordance with Section 01 11 00, Para 1.1, the remediation activities will be broken into phases to ensure that the manufacturing building is able to continue normal operations. Temporary site fencing and erosion controls are to be installed around a Phase 1A excavation in the parking area north of the building.

The Phase 1A area would be excavated and fully restored before proceeding to isolate and excavate the Phase 1B area. Subsequently, the Phase 1B area would be excavated and fully restored before proceeding to isolate and excavate the Phase 2 (remaining excavation areas) to install temporary site fence.

17. Phasing – Please clarify exactly which activities from the previous Phase must be 100% complete before the next Phase can begin (i.e., alternatively, which activities of next Phase(s) can begin while completing previous Phase (s)).

See responses to Question 15 and Question 16.

18. Please clarify why the Item 0003 “Temporary Facilities” is six (6) months when the project duration is longer?

See response to Question 59 of Amendment 0005.

19. Reference Amendment 0003, Q&A 32 – Request bid allowance for the unknown ACM, lead paint, and PCB removal. Without a survey, the order of magnitude cannot be determined for fair competitive pricing.

Per Section 02050 1.01B and 1.01C, the Contractor shall conduct an investigative survey for ACM and remove all window caulk, window frames, and glass panes and 1-inch layer of concrete adjacent to the window frames for disposal as TSCA waste. These materials shall be assumed to contain PCBs at concentrations equal to or greater than 50 ppm and shall be disposed of as PCB bulk waste. Offerors should include the cost of the survey into their proposal. The Government will consider a modification for treatment if it is determined to be necessary.

20. Reference Specification Section 02120-5, 1.06(A)(4) – “…allow direct loading of excavated materials”, may the contractor stockpile the excavated material prior to loading for disposal? NOTE: Specification Section 02260-5, 3.02(A)(3) – “Excavated material shall be loaded directly into trucks or placed directly in the excavated material stockpile area.” Please clarify if the contractor can stockpile the material prior to loading trucks?

Per Part 3 – Execution, 3.02 (A) Excavated material can be stockpiled. If the Offer chooses stockpile occurring, Section 02120, part 3 3.01 D.4 addresses how stockpiles must be marked, maintained, etc. Note that the Excavation Plan submittal must include stockpiling, if proposed.

21. Please clarify how many tons of Zero Valent Iron (ZVI) is to be mixed per Cubic Yard of AASHTO #67

Stone or Regular fill. Reference Spec Section 02300, 3.04(E) – States minimum of 10% ZVI aggregate, however, this quantity seems grossly underestimated based on the quantities of backfill required as per drawings. Also, is this 10% mix by weight or volume?

10% is by volume. 0.135 tons of ZVI is to be mixed with each Cubic Yard of AASHTO #67 Stone or Regular fill. The mix should be 10 lbs ZVI/ft3.

22. Drawing C-08 – Verify who does actual gas disconnection and whether work be conducted during the required regular work hours while disconnected.

The Contractor to do disconnect and reconnect. Disconnection/reconnection can be done during regular work. Gas service down time must be limited to less than 1 hour.

23. Electrical – It is our understanding that two separate electrical services feed active DMC facility. Please clarify and provide as-builts/one-lines, etc. to accurately bid this work.

Exact details of the actual temporary electrical service will be determined in the Temporary Power Work Plan. Reference Section 02000, “Temporary electric service and line replacement” for currently available information.

24. On Page 49 of 64 of the solicitation Instructions for Offerors the solicitation states the following:

“NOTE: All pages including, but not limited to, title pages, cover letters, Table of Contents pages, tables, illustrations, blank pages, dividers, and appendices will be counted in the page calculation.”

Does the Government intend to include cover pages, title pages, cover letters, dividers, Table of Contents, and appendices (Teaming Agreements and Letters of Commitments) as part of the page count for the Technical Approach? It is customary with proposals to USACE and other Federal agencies that these pages are excluded from the page count for technical volumes as they do not provide the Government with requested information in Sections L or M for the Technical Approach. Please consider excluding all pages identified above that do not address specific requirements for Volume 1 Factors 1 and 2.

The Government does intend to include the above listed elements as part of the page count for the Technical Approach.

25. Factor 1 Team Experience Submission Requirements states “At least one project shall be provided for the prime Offeror and for any Team Member who is proposed to perform any of the following key work functions:

project management, utility bypass and restoration, excavation along and beneath structural foundations, transportation and disposal and quality control management.”

This requirement appears to state that of the five projects, we must submit projects that individually present experience in each of the key work areas for Team Members and for the Prime Offeror, i.e., if we plan to use an electrician to perform the key work area of electrical power bypass and restoration, we need to include a project specifically from the electrician that is focused on electrical utility bypass and restoration AND if we have a transportation and disposal contractor we need to provide a project specifically on T&D of VOC soils. These projects will likely not present other Section M evaluation factors and will be less relevant than projects from the Prime Offeror showing these key elements as well as other relevant key elements.

Please clarify that the Government is not requiring a Team Experience example from each Team Member performing a single key element and is looking for overall experience of the Prime Contractor and Team Members as necessary to demonstrate overall experience in all of the Key Work Elements.

See response to Question 38 of Amendment 0005.

26. Amendment 0003 states in response to RFI 1: “… Offerors that do not have an approved cost accounting system will submit current audited financials as part of the responsibility determination prior to award.” And then continues with and explanation of requirements for an acceptable cost accounting system.

This response appears to conflict with the requirements of Sections 4 and 5 of the Cost Volume Factor 4 that require disclosure statements, audits, and certifications related to the Offeror’s cost accounting system. Please clarify that, in the event an Offeror’s current cost accounting system is not audited and does not have a Determination of Adequacy from the CFAO, the Offeror can provide a current audited financial statement and an explanation of how the Offeror’s cost accounting system meets the acceptable cost accounting system standards as listed in Amendment 0003 to be responsive to the requirements of Sections 4 and 5.

Confirmed, in the event an Offeror’s current cost accounting system is not audited and does not have a Determination of Adequacy from the CFAO, the Offeror can provide a current audited financial statement and an explanation of how the Offeror’s cost accounting system meets the acceptable cost accounting system standards.

27. Reference the attached solicitation for Durham Ct., can you tell me who do I contact for achieving the determination of adequacy? The RFI response in Amendment #3 didn’t provide me with a POC for me to start the process. We currently have a financial audit for the firm but am unsure if it meets the contract requirements.

Section 4: Determination of Adequacy from the cognizant federal agency official (CFAO) of the Cost Accounting Standards (CAS) Disclosure Statement (see Section 00600 and FAR 52.230-1) from the Prime and/or JV and as required from cost reimbursable subcontractors OR provide the Disclosure Statement OR provide status of the Determination of Adequacy if the Disclosure Statement has already been submitted but the Determination of Adequacy has not yet been issued by the CFAO. In accordance with FAR 30.202-6, award cannot be made until the CFAO has made a written determination that a required Disclosure Statement is adequate unless a waiver is granted by the Procuring Contracting Officer (PCO) that allows a postponement of the determination of adequacy until after award. Even in the event of waiver, the determination of adequacy shall be required as soon as possible after award.

See response to Question 26.

28. Will a mill and overlay be required around the boundary of the pavement patching? The detail on the plans seems to indicate this, but the RFI response in Amendment 3 makes it seem that this will not be necessary.

A mill and overlay will not be required.

29. Section 02300 (Backfill and Grading), 1.05B references the use of a CTDOT approved soil testing laboratory. We are unaware of a CTDOT list of approved testing laboratories. We are familiar with NVLAP and AASHTO accredited laboratories. If the laboratory is NVLAP or AASHTO accredited, will this be sufficient for utilization on the project?

An AASHTO accredited laboratory is acceptable.

30. 02300 Backfill and Grading – 1.05.B states, "Contractor shall retain the services of a Connecticut State Department of Transportation (DOT) approved soils testing laboratory to document conformance of material type and compaction of backfill and paving materials with the Specifications." We have not identified that a CT DOT-approved soil testing laboratory program exists. Please clarify.

See response to Question 29 and Question 36 of Amendment 0005.

31. With regards to Section 01 78 00 Closeout Submittals, Part 1.3 Construction Completion Report, Paragraph 4 states that "Each Construction Completion Report shall include the following: (1) certified statements by the contractors Project Manager, and a Registered Professional Engineer/Connecticut Licensed Site Professional (LSP) that, after review of the project information including the conformed design specifications and drawings, record drawings, contractor quality control documentation, and making additional reasonable inquiries and by the contractor that construction is complete and that the system is functioning properly and as designed; (2) be prepared in accordance with Chapter 2 (Remedial Action Completion) of EPA's Close Out Procedures for NPL Sites guidance (May 2011)."

A) Please confirm this is referring to a Connecticut Licensed Environmental Professional (LEP), not a LSP. Please identify the responsibilities of the LEP to be provided by the Offeror for this contract.

B) Please clarify whether the government provides an LEP during any phases of the work.

Confirmed, this is referring to a Connecticut Licensed Environmental Professional (LEP), not LSP. The Government will not provide a LEP during any phase of the work. Duties are defined in section 01 78 00, Part 1, 1.3 (4).

32. The general instructions for the proposal state: “11X17 pages are acceptable for tables/graphic representations; however, each 11X17 page counts as two pages.” Since the project schedule is a long and detailed CPM schedule requiring presentation as an 11x17 format to meet font requirements and provide the needed level of detail, can the schedule be excluded from the requirement to count each 11x7 page as two pages and have each 11x17 page for the schedule count as one page?

The requirement remains unchanged.

33. RFI responses in Amendment 5 make it seem that post-excavation clearance sampling will not be required outside of the three boring locations identified. Can you please clarify if this was the intent? Will confirmation sampling be required from the base of the excavation prior to backfill?

Confirmation sampling is not required from the base of the excavations prior to backfill. The three samples referenced in the RFI question refer to the pre-excavation confirmation samples, which are required to better delineate Phase 01B.

34. Section 3 10 11 referenced in Amendment 5, #46 does not appear to be present in the 100% specifications, nor has it been provided in an amendment to date. Can you please provide Section 3 10 11.

The answer to the subject question should reference Section 01 50 00 Page 11 (3.10.11): Enclosure and Fencing.

35. It is respectfully requested that an extension be granted to the bid due date no earlier than December 9, 2022. This request for an extension is due to multiple factors that are significantly affecting the time needed to adequately prepare a complete and responsive cost plus fixed fee proposal. Our request for an extension is based on the following reasons:

It is essential to have additional time to both continue and complete the preparation of preliminary proposal designs, continue to engage solicit and vet subcontract quotations for critical design elements (e.g., foundation underpinning, excavation support, dewatering system, water treatment system, temporary power requirements, and utility relocation).

Additional time is needed to address new site details provided in Amendment 5, to obtain new quotes from subcontractors, and to closely evaluate the quotes.

An additional amendment is anticipated, as indicated in Amendment 5. Time will be required to adequately evaluate responses and obtain revised subcontractor quotes after receipt of the amendment.

Additional time to meet the extensive detail required for Volume II – Cost, including the requirement that all estimating detail be provided in Excel per Amendment 0005.

Due to limited subcontractor interest, additional time is needed to expand outreach and evaluate additional subcontractors.

We are very concerned that if the requested amount of time in not granted that we will not be able to submit a proposal. Please note, based on our interactions with suppliers, vendors, and subcontractors there appears to be limited interest in the project due to the complexity associated with the proposal requirements.

See response to Question 2.

SECTION A - SOLICITATION/CONTRACT FORM
