AMENDMENT 0003

Requests for Information

1. We currently plan to submit a proposal for the subject contract and are looking for USACE support regarding the requirements specified in Section L, Factor 4 Cost Submission Requirements, d. Section 4 and e. Section 5 (page 53 of 64). We do not have a determination of adequacy from a cognizant federal agency official (CFAO) indicating that our current cost accounting system has been determined to be adequate for cost reimbursement contracts. We did have one for our prior system obtained for a USACE cost-reimbursable contract.

The solicitation Section L, Factor 4, heading Cost Accounting System (page 56 of 64) indicates that the Offeror should coordinate with the Contracting Officer to obtain an accounting system review prior to submitting a proposal.

Please provide additional details of the process and timing to obtain the review from a CFAO.

An approved cost accounting system as outlined in Section L of the subject solicitation is preferred. Offerors that do not have an approved cost accounting system will submit current audited financials as part of the responsibility determination prior to award.

Per DFARS 252.242-7006, an acceptable accounting system will provide reasonable assurance that:

Applicable laws and regulations are complied with;

The accounting system and cost data are reliable;

Risk of misallocations and mischarges are minimized; and Contract allocations and charges are consistent with billing procedures.

The Contractor’s accounting system shall provide for:

(1) A sound internal control environment, accounting framework, and organizational structure;

(2) Proper segregation of direct costs from indirect costs;

(3) Identification and accumulation of direct costs by contract;

(4) A logical and consistent method for the accumulation and allocation of indirect costs to intermediate and final cost objectives;

(5) Accumulation of costs under general ledger control;

(6) Reconciliation of subsidiary cost ledgers and cost objectives to general ledger;

(7) Approval and documentation of adjusting entries;

(8) Management reviews or internal audits of the system to ensure compliance with the Contractor’s established policies, procedures, and accounting practices;

(9) A timekeeping system that identifies employees’ labor by intermediate or final cost objectives;

(10) A labor distribution system that charges direct and indirect labor to the appropriate cost objectives;

(11) Interim (at least monthly) determination of costs charged to a contract through routine posting of books of account;

(12) Exclusion from costs charged to Government contracts of amounts which are not allowable in terms of Federal Acquisition Regulation (FAR) part 31, Contract Cost Principles and Procedures, and other contract provisions;

(13) Identification of costs by contract line item and by units (as if each unit or line item were a separate contract), if required by the contract;

(14) Segregation of preproduction costs from production costs, as applicable;

(15) Cost accounting information, as required—

(i) By contract clauses concerning limitation of cost (FAR 52.232-20), limitation of funds (FAR 52.232-22), or allowable cost and payment (FAR 52.216-7); and

(ii) To readily calculate indirect cost rates from the books of accounts;

(16) Billings that can be reconciled to the cost accounts for both current and cumulative amounts claimed and comply with contract terms;

(17) Adequate, reliable data for use in pricing follow-on acquisitions; and

(18) Accounting practices in accordance with standards promulgated by the Cost Accounting Standards Board, if applicable, otherwise, Generally Accepted Accounting Principles.

2. Plans indicate an above ground LPG tank on the property and a line from the tank to the building but the tank appears to have been removed in current aerial photos. Is the facility now connected to a Natural Gas service?

The above ground LPG tank was removed when DMC connected to the new gas line. There is still an active gas line between the buildings.

3. Eversource specifications are referenced but not provided. Can you please provide the most current technical specifications from Eversource for the electrical and duct bank installation?

Current technical specifications from Eversource are not currently available. They will be made available to the successful offeror.

4. Would you entertain a 2-week extension to the bid date to allow for receipt and review of all RFIs?

See Amendment 0002.

5. Please advise a date/time for an official RFP site visit, which is required to afford key subcontractors to view existing site conditions.

A pre-bid site visit was held on 16 September 2022. At this time, USACE New England does not intend to hold further site visits.

6. Access to the building (inside) for purposes of confirming/shutting off utilities will need to be coordinated with government and Durham Meadows. Please confirm government will allow limited access into the building during planning/construction.

Yes, the Government will facilitate access for the selected contractor to allow development of plans.

7. Please provide Design files in CADD for purposes of takeoffs/design.

The successful offeror will be provided CADD files. Design files are subject to waivers that will be completed for the successful offeror.

8. Bid Schedule – Please confirm which bid item to use for temporary utilities (water, communications, storm drain, gas, etc) other than electric which is covered under Bid Item 7.

These items should be placed in Bid item 3 – Temporary Facilities.

9. Will the large trees removed for Phase 01A excavation require replacement? If so, please clarify what replacement requirements in regard to trees.

Large trees will require replacement. The draft access agreement with property owner is attached to this amendment.

The current draft agreement indicates that any hardwood trees outside of the access boundary that are damaged will be replaced with mature sugar maple trees no less than 10 ft in height. All Trees removed or damaged along the property boundary shall be replaced with mature arborvitae trees at least 8 feet in height and spaced in a manner to provide a visual screen.

10. Have the trees been sampled for contaminants? Can removed trees be mulched for reuse?

Trees have not been sampled for contaminants. Trees can be mulched.

11. Reference C-16, “Restore Pavement” location notes. Is the pavement to be restored to a squared off area (further than the excavation limits)? Or just restored to the neat excavation limit? Please clarify and provide requirements.

Pavement to be restored to neat limits.

12. Reference Drawing C-16, Note 5, “Replace Curb and Bollards where necessary”. Should restoration be to replace all existing to pre-excavation conditions including entry gate and electric gate, etc.? Please clarity and provide requirements.

Restoration should bring the site back to pre-excavation conditions. Any removed or damaged gates, curbs, or bollards will be replaced.

13. Reference Plan Page C-12, “Temporary Shoring and Foundation Underpinning”. Is underpinning mandated to be required for this project in addition to shoring? Please clarify.

Underpinning is not mandated, but the Underpinning Program Work Plan must address building stabilization in a manner acceptable to Government.

14. Reference Drawing C-08. Please specify which utilities (i.e., water, gas, communications, drainage, etc.) must remain active and be temporarily relocated during execution of this project.

All utilities must remain active. The contractor is to determine which utilities must be relocated based on their work plan.

15. Reference Cross Sections on Drawing C-15. Please clarify whether Contractor is required to remove contaminated soil from beneath the existing building foundation, and hence the underpinning requirement?

The contractor is not required to remove contaminated soil from beneath the building. The goal is to remove soil as close as possible to the building foundation without going underneath.

16. QC Representative must be employed by Prime Contractor as per specifications. Please confirm whether the Site Superintendent and SSHO are required to be employed by the Prime Contractor as well.

The Site Superintendent and SSHO do not need to employed by the Prime Contractor.

17. The specification says the Contractor shall utilize sound enclosures for any generators used to power dewatering equipment. If a generator is used, it must be whisper quiet.

Please clarify if the Contractor is to provide a generator to operate the dewatering equipment or if the dewatering equipment can be connected to existing power at the DMC site.

Dewatering equipment cannot be connected to existing power at the DMC site. The contractor is to provide a generator if the contractor determines it is required to operate dewatering equipment.

18. In the Solicitation, it states that the schedule should be completed in Microsoft Project or a similar software, then in the Specs, it requires the use of Primavera P6. Which system is required?

Primavera P6 is required for the construction schedule. The schedule included in response to the solicitation as part of the proposal does not need to be at the same level of detail and can be in MS Project, P6 or any similar project.

19. In Section L, it states "Offeror should assume a Notice to Proceed date of 01 May 2023"; on Page 5, the RPF states "all work must be completed 365 days after notice of award", please clarify.

See FAR 52.211-8 ALT III in Amendment 0003. To allow scheduling for the purposes of proposal preparation, an estimated start date was set at 01 May 2023. Regardless of the actual start date, all work must be completed 365 days after Notice to Proceed.

20. The RFP states: “For Federal Government projects: provide the contract number, contract place of performance, and DUNS number”. As of April 2022, DUNS have been replaced with the UEI. Which identifier should be used?

As noted, DUNS numbers are no longer used in SAM.gov. Please provide the UEI number.

21. The solicitation states, “For non-Federal Government projects and commercial projects: The Offeror shall provide, at a minimum, a NAVFAC/USACE Past Performance Questionnaire (PPQ).” Should CPARS or PPQs be provided for Federal Government projects?

CPARS should be used for Federal Government Projects.

25. Section 01 13 00, Permitter Air Monitoring and Emissions Control Plan, Part 3 Execution, 3.1 General Lists appropriate methods to minimize the generation of dust and odors. None of the methods included the use of foam to control odors. Although in the Basis of Design (AECOM-June 2022), Section 7.2 Dust and Emission Control (Page 7-1), the following language is provided, "The contractor will be required to mitigate odors that are released during excavation of impacted material. Odor suppressant foam has been successfully utilized on similar sites. It is presented in this plan as an option. Odor suppressant foam can provide immediate, localized control of VOC and odor emissions. Foam is a short term remedy and can be actively used to control VOC and odor emissions from active excavations/stockpiles, and during the loading of trucks". Please confirm if the contractor should provide foam pricing to control nuisance odors.

The contractor should determine their approach to odor control. One option is foam, but other methods may be acceptable.

26. Bid Schedule, Bid Item 11, lists a quantity of 1,152 tons of Non-Haz Debris. Please confirm the source and what this volume of debris consists of.

It is assumed that non-hazardous debris will be encountered/generated. No specific source is known at this time.

27. Has the local POTW been contacted to confirm allowable water treatment discharge rates and post treatment POTW acceptance criteria?

There is no local POTW. Contractor is responsible for determining how to address any water treatment discharge.

28. Please confirm that stockpiling of soils will be allowed to facilitate continued excavation production in the event of transportation scheduling issues.

Stockpiling is acceptable, but all air monitoring, health and safety, erosion/sediment control and other applicable standards must be addressed to ensure stockpiling does not cause environmental or Health and Safety issue.

29. A 365 day performance period may be unrealistic, particularly with start of field work not anticipated until May 2023 and given the surgical nature of the majority of excavations limiting overall production. Please consider an 18 month period of performance, wherein excavation of Phase 02 is completed in 2024.

The requirement remains unchanged.

30. Section 01 50 00, Temporary Construction Facilities and Controls, Section 3.6, Traffic Provisions and Traffic Control Plan states that the Contractor shall be responsible for the repair of any damage to roads caused by construction operations. To even the bidding playing field, please indicate what Contractors should include in their pricing costs (Road Bonding, or Road Repair Allowance, and which Bid Item should these costs be included?

Road bonding is not required. Offerors are advised that if they damage a road they will be required to repair this damage. The Government does not expect any road damage.

31. Section 01 50 00, Temporary Construction Facilities and Controls, Section 3.6, Traffic Provisions and Traffic Control Plan states that the Contractor shall be responsible for the repair of any damage to roads caused by construction operations. Please confirm if this statement also includes the pavement areas located on the DMC property that will be used for vehicular access to the areas of excavation. Please consider including an associated area (square feet) that is anticipated to be restored as part of this remedial activity in an attempt to balance the pricing for this effort. Please note that the site visit conducted on 16 September 2022 did not provide an escort to the southern limit of the site to observe the condition of the existing paved areas.

All pavement areas, including those inside the excavation area as well as those only used for vehicular travel, must be left in the same condition as documented in the pre-construction survey. If any pavement areas within DMC are affected by the construction work, the Contractor will be required to repair.

32. Section 02050, Demolition, Section 1.01, Scope of Work identifies that Contractor may encounter ACM, lead paint, and PCBs (contained in window caulk, frames, glass panels, and concrete window casing). Has a hazardous waste survey been performed on the Storage Building to identify other waste streams that will require off-site disposal prior to demolition?

No hazardous waste survey was completed on the Storage Building. Assume the building has ACM, lead paint, and PCBs.

33. Section 02050 Demolition states the contractor shall assume the building is painted in lead-based paint (LBP) and that window caulk, frames, glass panes, and a 1-inch layer of concrete adjacent to the window frames shall be assumed to contain PCBs at concentrations of greater than or equal to 50ppm and shall be disposed of as PCB bulk waste. However, the section also states that the contractor shall perform an ACM survey prior to building demolition. Will the government permit the contractor to perform sampling for LBP and PCBs in building materials in conjunction with the ACM survey? If building materials do not contain LBP and PCBs there may be a cost savings to the government.

Yes, the Government will allow the successful contractor to perform sampling for LBP and PCBS during the ACM survey.
