SECTION SF 30 - BLOCK 14 CONTINUATION PAGE
The following have been added by full text:
AMENDMENT 0005
Requests For Information
1. For PPQ, the solicitation states: ”Completed PPQs shall be submitted with the proposal in an envelope sealed by the client.” Please revise for electronic submission.
See revised Factor 3 Past Performance Submission Requirements. Offerors shall include a completed PPQ electronically in Volume I of the proposal.
2. On page 54 of the RFP states “Provide a Table of Contents showing each file submitted as part of the Cost Volume with a short description of the contents of the file. Hyperlink each of these entries in the Table of Contents to the respective files.” However, on page 48, the RFP states “use of hyperlinks in proposals is prohibited.” Please advised on how to proceed with the Table of Contents for Volume 2/Factor 4.
See revised Table of Contents instruction. Requirement for hyperlink is removed.
3. Please verify that this is a Davis-Bacon Act (DBA) wage contract due to the nature of the scopes of work to complete this project. In addition, please provide the Davis-Bacon Wages/rates which should be used on this contract.
This contract is subject to Service Contract Act WD # 2015-4125. It is not subject to a Davis-Bacon Wage Determination.
4. Drawing C-9, includes images of (1) rectangle and (2) squares in the western half of the Phase 1A excavation area, in the existing paved road. Are these to be considered possible underground structures that will need to be removed during excavation activities, or otherwise provide information on these anomalies?
These covers are former extraction and monitoring wells which will be removed and not replaced.
5. Drawing C-9, identifies that a possible dry well exists in the Phase-1A excavation area. Please confirm if this dry well will have to be restored?
The dry well will not be restored.
6. Drawing C-13, indicates 2 rectangular structures not labeled on the drawing? Does USACE know what these structure are? If an underground concrete vault exists at this location, are there any as-builts of the structure that can be provided to the contractors?
This is the bulkhead entrance for the basement area below the compressor room. The foundation at this location consists of a continuous reinforced concrete wall footing with a bottom of concrete located 4’ bgs.
There are no as-builts available of the structure.
7. Please indicate if the Contractor is restricted to the earth retainage types and procedures as provided in the
Basis of Design Report for the DMC Study Area Soil Remediation Design, AECOM, Revised Final September 2016, Updated June 2022, Section 6.1. If so, please revisit and clarify the entirety of Section 6.1.
The Basis of Design is provided for background information and is not the governing document. The Contractor is not restricted to the earth retainage types and procedures provided in the BOD report.
8. The spec says to provide characterization data collected by the contractor to date. Please clarify if the contractor is to collect pre-characterization data and excavation limit sample data prior to submitting the TEP.
The Contractor shall compile all pre-construction plans into one document (the TEP) prior to the start of site work. The TEP shall be updated to incorporate pre-characterization data following approval of the preconstruction plans, so that all plans and data are available in one document.
9. Please clarify which mechanical/electrical/information systems layout drawings are required. The drawings provided with the solicitation show existing utilities.
The Contractor shall conduct a utility survey that identifies all utilities, and temporarily relocate utilities during excavation activities. Temporary Utility Plan shall be submitted prior to the start of excavation activity.
10. Section 01 41 00, 1.6, B.4 says to submit analytical results two business days prior to continuing excavation. Table 01 41 00-1 shows that only 3 confirmation samples are required for the Phase 01B excavation area. Confirmation samples aren’t required for the Phase 01A or Phase 2 areas. Section 5.4 of the BOD says that a small number of sample locations needed prior to excavation to confirm the excavation limits.
Confirmation samples are required at the 3 locations shown on C-13. Samples are required from the following depths to bound the contamination.
CB-1: 3-4 ft bgs
CB-2: 0-4, 4-9 ft bgs
CB-3: 6-7 ft. bgs
Confirmation sampling results must be reviewed to determine whether a change to the extent of the excavation is required. The Contractor shall complete the sampling prior to excavation.
11. Please provide well construction details for the existing monitoring wells to be abandoned.
Well construction logs are included in Appendix A, Section V, of the 100% Design Specification Appendices.
12. Please provide well construction details for existing wells to be replaced: OW-3-08 and OW-8R-08.
Well construction logs are included in Appendix A, Section V, of the 100% Design Specification Appendices.
13. Please clarify if the three borings to be completed to confirm excavation limits to the east of boring E7, north of EA-3-09, and west of EA-5 correspond to borings CB-1, CB-2, and CB-3 as shown on drawing C-13.
Correct, they do correspond.
14. Based on data collected during pre-design investigations, approximately 1,000 cy of RCRA characteristic waste was estimated and is to be used for bidding; however, the contractor is responsible for characterizing the soil for off-site disposal. The sample locations used to develop the 1,000 cy estimate, as identified in the BOD, are shown on Figures 4-1 and 4-2 of the BODR.
Based on data collected during pre-design investigations, approximately 1,000 cy of RCRA characteristic waste was estimated and is to be used for proposal purposes; however, the contractor is responsible for characterizing the soil for off-site disposal. The sample locations used to develop the 1,000 cy estimate, as identified in the BOD, are shown on Figures 4-1 and 4-2 of the BODR.
15. Please clarify the volume of RCRA characteristic waste to be removed from the Northwest Corner Area and the volume to be removed from the WS-20 area.
Please see response to Question 14.
16. The text says to mix ZVI with backfill at a 10%:90% ratio. Please clarify if the 10% of ZVI is based on weight or volume of the backfill.
The ZVI is based on volume.
17. Are there any formal Data Validation (i.e. Tier 1, Tier IIA, etc.) requirements?
Typically, formal Data Validation requirements are determined when developing the QAPP. Based on discussions with the USACE chemists, it is assumed that a stage/level 2B validation will likely be required for some data and a stage/level 4 validation will likely be required for around 10% of the data.
18. Please provide specifications for concrete duct banks.
This is an Eversource requirement. The Contractor shall coordinate with and obtain current details from Eversource.
19. Sec. 01 41 00, 1.6, Table 01 41 00-1 – The table references drawing C-13 for locations of confirmation samples. This is for the Phase 01B excavation. Please confirm that these are the only excavation confirmation samples required.
The confirmation samples are required as shown on the plan to bound the excavation.
20. The text says to following, “For each area, the design drawings will specify the top elevation for the ZVI backfill based on the estimated shallowest seasonal low water table elevation for each area”.
Drawing C-12 shows two areas (Areas A and B) in Phase 01A to be excavated down to bedrock but it is unclear what the elevation of bedrock is.
Drawings C-13 and C-14 clearly show the elevation of bedrock in Areas C and D.
Drawing C-16, Note 1, shows the elevations for each area to backfill to with ZVI.
Because Drawing C-12 does not clearly show the elevation of bedrock in Areas A and B, the volume of backfill containing ZVI cannot be calculated. Please provide the elevation of bedrock in Areas A and B which will allow calculation of the volume of backfill containing ZVI.
The elevation contours within Areas A and B on Drawing C-12 are the estimated bedrock surface. See Note 3 on that drawing.
21. Section L, Factor 4: Given the complex and detailed requirements for submission, please provide a template for or example of the required cost detail.
A template is provided as an attachment to this amendment for reference only; it is not required to be used.
The use of this template does not relieve any of the requirements specified within Sections L and M.
22. I understand that we’re to provide a 480V, 3 Phase generator for the property while we’re excavating but I do not see the total anticipated load. Can you please provide the anticipated power load?
The Government anticipates a power load requiring a 2,000 amp generator.
23. Drawings show temporary rerouting of electrical but no rerouting plan for storm, communications, water, gas, etc. piping. Please provide requirements for all other temporary utility rerouting.
The drawings (C-02, C-03, and C-04) state that the Contractor shall conduct a utility survey that identifies all utilities, temporarily relocate utilities during excavation activities, and must submit a Temporary Utility Plan for review by the Engineer prior to the start of excavation activity. Please refer to Specification Section 01 11 00, Part 1.14 Protection and Relocation of Existing Structures and Utilities.
24. Confirm responsible party for installation/O&M/removal of security/safety guarding on doors/garage/bays, etc. abutting excavation areas for Phases 01A and 01B. If Contractor is responsible, please provide minimum requirements.
The Contractor is responsible. See Section 24 of EM 385-1-1 and NFTA 241, both referenced in Section 01 50 00 of the specification.
25. Bid Schedule – Please confirm that interim milestones can be established for Bid Items where phasing for 01A, 01B, and 02 apply.
Confirmed. As this is a cost-plus contract, monthly billing based on actual expenditures is expected.
26. Can the government provide the most recent analytical data for low-flow groundwater sampling for the on-site monitoring wells, including well numbers OW-3-08 and OW-8R-08.
The most recent data available for these wells was collected in 2008 and is included in Appendix A (pdf p.
259) of the Specification, as well as in the attached file.
27. Reference Drawing C-15, “Cross Section A-A Profile”, “Excavation Shoring Designed, Installed and removed by Contractor”. Please clarify whether Contractor can slope excavations to existing instead of shoring?
Shoring is required as indicated in Plans.
28. Temporary Electric Service and Line Replacement indicates that a temporary generator system (480V, 3
ph) shall be provided to power the buildings. This section also indicates that the electrical contractor shall be responsible for acquiring the utility bills to determine the loads required for the temporary generator system. To facilitate sizing of the temporary generator for the response to the solicitation, please provide a copy of an electric utility bill for the plant. Or please provide the kilowatt rating and frequency necessary for the temporary generator system.
See response to Question 22.
29. The solicitation documents provide ground water sampling results from 2008. Are there any more recent groundwater sampling results available that can be provided?
Results from 2008 are the most recent sampling results.
30. Section 01 41 00 (Quality Assurance Project Plan/Sampling and Analysis Plan), Part 1.6 indicates
Confirmation Sampling is required at locations CB-1, CB-2, and CB-3 as shown on Drawing C-13. Please confirm that these are the only confirmation soil sampling locations required as part of the scope of work.
See response to Question 10.
31. Can you provide construction specifications or as-built drawings for the two monitoring wells that are to be reinstalled after remediation? Wells OW-3-08 and OW-8R-08.
See response to Question 26.
32. Are there any RCRA waste codes associated with the soils/wastes to be transported off-site for this project?
If yes, which waste codes should contractors expect and please provide any historical data associated with these waste codes to assist in pricing them.
Only RCRA characteristic waste is expected; no listed waste is expected.
33. Regarding Additional Information, Subcontracts, Page 54 of 64 of the Solicitation states, “Major Subcontracts (10% or greater of the prime contractor’s total contract value). If there are major subcontractors (those whose total cost for all CLINs is expected to be 10% or greater of the prime contractor’s total contract value), provide cost information from the subcontractor equivalent to that of the Prime Offeror. Segregate the subcontractor cost information by CLIN.”
For subcontracts identified as a Major Subcontract and that will provide labor and/or material but the resulting contract with the subcontractor will be firm fixed price, please confirm that their quotes can be provided in lieu of their detailed cost breakdown as required of the prime offeror?
If there are major subcontractors, cost information from those subcontractors is to be submitted equivalent to that of the prime. Quotes may be submitted for non-major subcontractors.
34. Please advise if a Certified Safety Professional (CSP) is acceptable to prepare and implement the APP in lieu of a Certified Industrial Hygienist (CIH).
Per EM 385-1-1, Section 1 01.A.12: “The APP shall be developed and signed by Qualified Person (QP) and then signed. The Contractor shall be responsible for documenting the QPs’ credentials.”
Per Section 33.C.01: “The Safety and Health Manager (SHM) is responsible for developing, maintaining, and overseeing implementation of the Site Safey and Health Plan (SSHP). Per the same reference the SHM must meet the qualifications stated in this section. This section also states that “The SHM, dependent upon the contaminant-related hazards on the project, shall be a Certified Industrial Hygienist (CIH), Certified Safety Professional (CSP) or Certified Health Physicist (CHP).”
35. Are there site/schedule-based restrictions that would prevent consideration of an in-situ alternative?
See response to Question 1 of Amendment 0001.
36. 01 33 00 Submittal Procedures, Part 3.7.2 Testing Laboratories, states, "All testing laboratories must be validated by the USACE Material Testing Center (MTC) for the tests to be performed." Please confirm this requirement.
Confirmed. A list of validated MTC laboratories can be found here:
https://mtc.erdc.dren.mil/searchvalidation.aspx. MTC laboratory validation is required for geotechnical samples. A NELAP (National Environmental Laboratory Accreditation Program) certification is required for the analysis of the Chemistry samples.
37. Please identify on Section B – Bid Schedule which items are firm fixed price and which items are cost plus fix fee.
All items are cost plus fix fee.
38. In Section L.3, Factor 1—Team Experience Submission Requirements (RFP Page 51).
A) Please clarify what is needed to meet the requirements per the second paragraph in this section, i.e., the first sentence indicates that: "At least one project shall be provided for the prime Offeror and any team member who is proposed to perform any of the following key work functions: project management, utility bypass and restoration, excavation along and beneath structural foundations, transportation and disposal, and quality control management."
So, if we propose a team member that will provide T&D for example, the instructions imply that we must provide a project from them for T&D. However, that project will be solely reflective of T&D and will not depict the depth/breadth of the overall SOW for this project and will not address the evaluation criteria presented in Section M.
As a result, this project will not show high levels of relevancy for the project SOW, leading to a significantly lower score for this factor.
B) Additionally, the next sentence in that paragraph indicates: "The Offeror may utilize experience of another Team member that will perform major or critical aspects of the requirement to demonstrate experience under this evaluation factor." Can you clarify the "shall" versus "may" requirements within this paragraph's instructions?
C) Moreover, the fourth paragraph under this section indicates: "If an Offeror is utilizing information of Team Members, then the projects submitted must include relevant work similar to the work performed by the Team Member for this requirement." If we are NOT planning to utilize information of team members to support this factor, can we simply show the prime Offeror's experience in performing each of the key work functions. For example, as the prime, we will manage utility bypass and restoration and self-perform parts of that work but will use an electrician (as a subcontractor) to support electrical aspects of this work. Therefore, we are assuming that we can use a project to convey the prime Offeror's work for utility bypass and restoration (along with other elements of work to convey project diversity/complexity) and not need to provide a project for our subcontracted electrician that will be focused on electrical work and not address the various Section M criteria. Please confirm.
A) Your interpretation is correct, although up to five different projects may be submitted to show team experience. As described in Section M, Factor 1 - one overall rating is provided for the entirety of this factor.
B) Refer to NOTE under D. FACTORS of Section M.
C) Your interpretation is correct.
39. Volume 1, Factor 2 Technical Approach Project Submission Requirements require a proposed project schedule in a tabular format and a comprehensive schedule. Can the comprehensive schedule be provided in an appendix and be excluded from the page limitation?
The comprehensive schedule and the proposed project schedule are the same. They cannot be excluded from the page limitation.
40. In Section L, Instructions, Conditions and Notices to Bidders, Part (2) General Requirements, Paragraph 5 states "NOTE: All pages including, but not limited to, title pages, cover letters, Table of Contents pages, tables, illustrations, blank pages, dividers, and appendices will be counted in the page calculation. Pages that exceed the above noted page limitations will be removed, not read, and not evaluated. Past Performance Evaluations are excluded from the page count. Agreements or letters of commitment submitted for Factor 1, 2 or 3 will not be counted toward the page limit but should be included as an appendix to Volume I. 11X17 pages are acceptable for tables/graphic representations; however, each 11X17 page counts as two pages." Please confirm that appendices will not be included in the page limit.
Appendices containing agreements or letters of commitment submitted for Factor 1,2 or 3 will not be counted toward the page limit.
41. Please confirm that all areas associated with Phases 1A, 1B, and 2 are available to the contractor for the duration of the work.
Contractor will have access to all excavation areas for the duration of the work.
42. Page 52 of 64 of the Solicitation states, "Completed PPQs shall be submitted with the proposal in an envelope sealed by the client." However, this is an electronic submittal. Please clarify.
See response to Question 1.
43. Since the DUNS number has been replaced by the UEI, should the Offeror modify the official PPQ [Form PPQ -0 (9/30/11)], which still requires the DUNS number, to provide the UEI?
See response to Question 20 in Amendment 0003.
44. Page 53 of 64 of the Solicitation – Additional Information, requires submittal of Excel spreadsheets to present the detailed estimate. If the contractor utilizes a standard estimating software other than Excel, is it acceptable to submit detailed cost information output from the software in PDF format as part of the Basis of Estimate and transfer the data to the top-level spreadsheet into Excel organized by cost element which will then support the proposed unit price?
The Government will not review any data not submitted in Excel.
45. Can the hazardous waste leave Continental United States? Some Chlorinated VOC hits are ~3,500 ppm, and this would exceed many U.S. facility air permits.
Yes, it is acceptable for waste to leave Continental United States, provided that the Contractor adheres to all applicable State and Federal laws.
46. On the Access Agreement Plan provided with Amendment 0003 there is a yellow line shown that is indicated as "Access Area Boundary."
A) Please confirm that the contractor has access to and use of the entire area within the Access Area Boundary for the duration of the work.
B) Please confirm whether temporary fence and erosion control measures around the Access Area Boundary will be required.
C) Please confirm that portions of the Access Area disturbed by the contractor are to be restored in-kind upon completion of the work.
D) Please confirm that vehicle and equipment access to the Access Area is available at the southwest and southeast corners of the Access Area Boundary for the duration of the work.
A) The Contractor has access to the entire area referred to as the Access Area Boundary, although the Contractor should review the consent agreement for additional details.
B) Temporary fencing will be required. Locations are to be determined by the Contractor based on guidance of section 3 10 11 in the 100% specifications section. Erosion and sediment controls should be consistent with the specifications. See section 3.3.4, 3.4.4 and 1.7, among others.
C) See Fran Korn Consent Agreement attachment to Amendment 0003.
D) Confirmed, access to the Korn property is along the Southern and eastern edges of the property.
47. Reference Amendment 0003, Drawing Number 1, identifying “Access area Boundary”. Is the temporary fencing required to go around this area? If so, please provide temporary fencing requirements for “Access area Boundary” for each Phase. Can the Contractor access this area from the Northwest corner of this “Access area Boundary”?
See response to Question 46.
48. Reference Amendment 0003, Q&A 2 – Are there particular gas line companies certified to remove and relocate the gas utilities on this property? If so, please supply gas utility companies.
There are not particular gas line companies. Refer to state and local regulations.
49. Reference Amendment 0003, Q&A 10 – Confirm what payment Bid Item is for the T&D of the trees/brush.
Is the removal included in the government-furnished non-hazardous debris quantity?
T&D of trees/brush is included in CLIN 0005 Demolition (see Bullet 2 – Clean and dispose of existing trees and brush). Trees and brush are not included in the government-furnished non-hazardous debris quantity.
50. Reference Amendment 0003, Q&A 9 – Clarify whether trees/brush inside access boundary will require replacement. Please define “along” property boundary.
See Fran Korn Consent Agreement attachment to Amendment 0003 for tree/brush replacement details.
Along refers to the line of trees along the southern boundary of the Korn property.
51. Phasing – Must the phasing be accomplished in sequential order (i.e., 01A followed by 01B followed by 02), or can Contractor determine alternate approach?
The Contractor can determine the order of excavation.
52. Reference Spec Section 012200 (CLIN 0015) -Does this payment Bid Item also include the actual ex situ mixing of the ZVI aggregate, or is this under another Bid Item?
See Section 01 22 00 Measurement and Payment, Item O. “All costs for labor, equipment, and materials required to amend soils with Zero Valent Iron per Specification Section 02300 ‘Backfill and Grading’.”
53. Specifications PART 1 – GENERAL Section 1.01 SCOPE OF WORK B. and Section 1.06 PERFORMANCE REQUIREMENTS A. General Requirements 4. Both indicate that the “…contractor shall conduct a pre-characterize program to pre-characterize soil in place prior to excavation… to allow direct loading of excavated materials.” However, PART 1 – GENERAL C. Excavated Material Handling and Storage 4. States that “…excavated material stockpiles, if used, shall be covered and secured as required in this section…” and “…the Contractor has the option of drumming excavated material for off-site disposal.” Please clarify if on-site stockpiling of excavated soils is permitted or if direct load is required?
See response to Question 28 in Amendment 0003.
54. Solicitation Section L, Factor 4, Cost Accounting System (page 56 of 64) indicates that Offeror should coordinate with the Contracting Officer to obtain an accounting system review prior to submitting a proposal.
Please clarify if all subcontractors/vendors are required to have approved accounting system.
See response to Question 1 of Amendment 0003.
55. Reference Amendment 0003 Q36 – Please clarify where on a map the government will provide access to adjacent Francis Early Korn property.
See Fran Korn Consent Agreement and 215 Main Street Access Requirements attachment to Amendment 0003.
56. Section L, Factor 2 - Technical Approach Submission Requirements (page 51 of 64) states "The Offeror shall submit a narrative proposal to demonstrate its understanding of the work described by the Performance Work Statement (PWS)." Where a PWS has not been provided, please clarify whether Specification Section 01 11 00 Summary of Work, Part 1, Section 1.1 Work Covered by Contract Documents is intended to be the PWS.
See revised Section L, Factor 2 Technical Approach Submission Requirements.
57. Please confirm that this project is exempt from the 6.25% CT sales tax for transportation of impacted material.
It is the Contractor’s responsibility to determine tax liability for materials. The Contractor may provide a tax exempt form in accordance with the Contractor’s legal or accounting personnel’s standards and guidance to the Contracting Officer to review and sign.
58. Section L, Factor 4, Direct Labor, a): Please provide clarification regarding the level of detail expected/required for “time-phased breakout of the direct labor hours by labor category”. Is a monthly breakout acceptable?
Yes, a monthly breakout is acceptable.
59. Please clarify the discrepancy in quantities related to the duration provided in the bid form for the following bid items.
A) Bid Item 3 – Temporary Facilities has a quantity of 6 months. If the contractor's field duration is different, can the quantity be adjusted on the bid form?
B) Bid Item 4 – Air Monitoring and Health & Safety has a quantity of 4 months. If the contractor's field duration is different, can the quantity be adjusted on the bid form?
C) Bid Item 7 - Temporary Electric Services has a quantity of 222 days. If the contractor's field duration is different, can the quantity be adjusted on the bid form?
D) Bid Item 8 – Dewatering has a quantity of 99 days. If the contractor's field duration is different than this, can the quantity be adjusted on the bid form?
E) Bid Item 9 – Water Treatment operations has a quantity of 99 days. If the contractor's field duration is different, can the quantity be adjusted on the bid form?
F) Bid Item 19 – Option – Excavation Standby Time has a quantity of 12 hours. If the actual quantity is different, will the actual hours be compensated?
Contractors shall use the estimated quantities in the bid schedule to develop their estimate for the purposes of the proposal to allow comparison between Contractors. If the Contractor believes that a bid item is shorter or longer than what is required on the bid sheet then their schedule and technical scope should reflect that. If actual quantity differs, actuals will be compensated.
60. Drawing C-15, Cross Sections references cross sections for the Phase-01A and the Phase-01B area. Will a cross section be provided in a future Addendum for the Phase-02 Area? Please confirm that backfill materials will only consist of regular fill and regular fill with Zero Valent Iron Aggregate) at this location.
Cross sections were included only in areas where the excavations and backfill near the building were most complex and within those Phase 01A and 01B Areas, where ZVI placement was specified. In areas where the excavation is being backfilled with common fill, plan view contours are sufficient, and sections are not required.
The backfill materials will be regular fill except within Area “D” where the backfill shall be ZVI blended with regular fill from bedrock up to the elevation indicated in the notes on Drawing C-16.

SECTION H - SPECIAL CONTRACT REQUIREMENTS
CPARS
CONTRACTOR PERFORMANCE EVALUATIONS (CPARS)
In accordance with the provisions the Federal Acquisition Regulation (FAR), service Contractor'sperformance shall be evaluated throughout the performance of the contract.
The UnitedStates Army Corps of Engineers (USACE) follows the procedures outlined in Engineering Regulation 415-1-17 to fulfill this FAR requirement.
For service contracts awarded at or above $1M, the USACE will evaluate contractor's performance annually and at completion and prepare a performance report using the Contractor Performance Assessment Reporting System (CPARS), which is now a web based system. After an evaluation (interim or final) is written up by the USACE, the Contractor will have the ability to access, review and comment on the evaluation for a period of 60 days.
Accessing and using CPARS typically requires specific software, called PKI certification, which is installed on the user's computer. However, although users are encouraged to use PKI certificates whenever possible, a waiver has been approved to allow industry users to access the system without a PKI certificate. Contractors wishing to log on without a PKI certificate should select the "Contractor (pending PKI)" logon option. The certification is a Department of Defense item and was implemented to provide security in electronic transactions.
The certification software could cost approximately $110 - $125 per certificate per year and is purchased from an External Certificate Authorities (ECA) vendor. Current information about the PKI certification process and for contacting vendors can be found on the web site: http://www.cpars.gov/ . If the Contractor wishes to participate in the performance evaluation process, access to CPARS and PKI certification is the sole responsibility of the Contractor.

SECTION I - CONTRACT CLAUSES
The following have been added by full text:
52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (SEP 2021)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern--
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13
CFR 121.103.
(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract.
(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table-size-standards.
(e) The small business size standard for a Contractor providing an end item that it does not manufacture, process, or produce itself, for a contract other than a construction or service contract, is 500 employees if the acquisition--
(1) Was set aside for small business and has a value above the simplified acquisition threshold;
(2) Used the HUBZone price evaluation preference regardless of dollar value, unless the Contractor waived the price evaluation preference; or
(3) Was an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.
(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraph (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.
(g) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (f) or (h) of this clause.

The Offeror’s proposal shall consist of two volumes. The first volume shall address all non-cost factors and shall be titled “Volume I: Technical Information.” A second volume shall be titled “Volume II: Cost" and shall address Factor 4: Cost, the solicitation acknowledgement of amendments, offer and award documents, and certifications/representations.
(1) Instructions for Submitting Electronic Proposals
ALL SUBMISSIONS TO THIS ANNOUNCEMENT SHALL BE SUBMITTED ELECTRONICALLY
THROUGH PIEE (Solicitation Module). No paper copies, CD-ROMs, email, or facsimile submissions will be accepted. Electronic Proposal Submission is required through the Army’s Electronic File Sharing Service, Procurement Integrated Enterprise Environment (PIEE) (https://piee.eb.mil/) (Solicitation Module). The PIEE Application is used to send large files to individuals that would normally be too large to send via email. Information regarding how to set up a vendor registration is included in this link-https://wawf.eb.mil/xhtml/unauth/web/homepage/vendorGettingStartedHelp.xhtml
File Size Limitations: Offerors are advised to follow the PIEE instructions for uploading files. PIEE supports delivery up to 1.9 GB per file, with no limit on the number of files, as well as multiple file formats.
If needed, Offerors are advised to break the files down into smaller sections in order to upload it to the system. In such cases, please divide the sections as logically as possible and be sure to clearly name the files as specified below.
File Naming Convention: To ensure your submission is received and processed appropriately, it is important that interested parties CAREFULLY ensure their electronic files adhere to the following naming convention:
• W912WJR22R0014-FIRMNAME-VOLUME I
• W912WJR22R0014-FIRMNAME-VOLUME II
Each file name shall begin with the solicitation number followed by the firm’s name and a brief file description. Please see examples above.
Upload Completion and Deadline: Interested parties shall submit responses no later than the date and time specified on the solicitation document. The time and date of proposal receipt will be the upload completion/delivery time and date recorded within the PIEE site. Do not assume that electronic submission will occur instantaneously. Large files (e.g., 10MB or more) will take some time to upload.
Offerors should time their upload effort with prudence by not waiting until the last few minutes—this will allow for unexpected delays in the transmittal process. Offerors are encouraged to keep a copy of the PIEE upload confirmation for their records.
Proposals sent through proprietary or third-party File Transfer sites, email, or DoD SAFE WILL NOT be retrieved and evaluated. It is the responsibility of the Offeror to confirm timely receipt of proposals. All proposals received, as confirmed by the date/time recorded within the PIEE site, after the exact time specified for receipt on the solicitation document shall be treated as late submissions and will not be considered.
