AMENDMENT 0004
Requests for Information
1. Please confirm what portion of the Francis Earle Korn property will be allowed for project support. Can an updated figure be provided to show these limits?
See Fran Korn Consent Agreement attachment to Amendment 0003. The access agreement is still under negotiation with the property owner. However, a draft figure with the expected access area boundary indicated was included with Amendment 0003.
2. Section L, Factor 4, Subcontracts: Solicitation states that Major Subcontractors shall provide cost information equivalent to that of the Prime Offeror. If the Major Subcontractor will be a firm-fixed price subcontract, is the subcontractor required to provide details of overhead/indirect cost rates for labor, materials, and equipment?
If there are Major Subcontractors, cost information from those subcontractors is to be submitted equivalent to that of the prime.
3. Section L, Factor 4, Subcontracts: Solicitation states that Major Subcontractors shall provide cost information equivalent to that of the Prime Offeror. If the Major Subcontractor will be a firm-fixed price subcontract, is the subcontractor required to provide a description of each labor category used?
If subcontractor is a Major Subcontractor, a description for each labor category used is required to be included in the
BOE.
4. Regarding Additional Information, Subcontracts, Page 54 of 64 of the Solicitation states, “Major Subcontracts (10% or greater of the prime contractor’s total contract value). If there are Major Subcontractors (those whose total cost for all CLINs is expected to be 10% or greater of the prime contractor’s total contract value), provide cost information from the subcontractor equivalent to that of the Prime Offeror. Segregate the subcontractor cost information by CLIN.”
For subcontracts identified as a Major Subcontract and that will provide labor and/or material but the resulting contract with the subcontractor will be firm fixed price, please confirm that their quotes can be provided in lieu of their detailed cost breakdown as required of the prime offeror?
Cost information from Major Subcontractors is to be submitted equivalent to that of the Prime Offeror. Quotes may be submitted for non-Major Subcontractors.
5. Please provide limits of disturbance for the property, including grassy area north of DMC building for laydown area. Confirm use of that grassy area for laydown area, as stated by government during site visit.
See 215 Main Street Access Requirements attachment to Amendment 0003 for expected acceptable laydown area.
6. The specification says the Contractor shall furnish a discharge pump with sufficient flows and pressures to achieve the maximum discharge rate of 100 gallons per minute. Please clarify if the contractor can propose a different size system once all data are evaluated.
The requirement remains unchanged. Offerors shall propose a system based on specifications.
7. The limits of work are not clearly identified on the Drawings. Can any of the eastern portion of the neighboring property (the Korn property) located north and outside of the limits of the temporary construction fencing shown on Drawing C-09 be used for laydown (e.g., stockpiles) and/or temporary facilities (e.g., office trailers, storage containers )?
See Fran Korn Consent Agreement and 215 Main Street Access Requirements attachment to Amendment 0003 for references to laydown and temporary facility areas.
8. Please confirm that the field behind the Korn residence can be used for a laydown and construction staging area during the project as discussed during the pre-bid meeting.
See response to Question 7.
9. Can you provide guidance for the replacement of the trees that will be removed on the Korn property during the excavation of Phase 1A? What size do the replacement trees need to be?
See response to Question 9 of Amendment 0003.
10. During Phase 1B excavation work, will the contractor be able to interrupt the water service during the excavation process or will the contractor be required to install new water lines outside of the excavation area and connect them prior to the excavation work beginning?
The Contractor should ensure that any impacts the facility’s water service last less than one hour and any interruption is coordinated in advance with the facility to minimize impact on the facility operations. The Government will not require the Contractor to install new water lines outside the excavation area.
11. Box 4 of the Solicitation, Offer and Award sheet indicates that this is a Negotiated (RFP) Type of Solicitation and Section M of the Evaluation Factors for Award, Item C indicates the resulting award will be a Cost-Plus-Fixed- Fee (CPFF) contract. The solicitation however includes a Bid Schedule with unit and lump sum payment items.
Please clarify the contracting mechanism for this project (negotiated CPFF or unit/lump sum rates) and whether Offerors are required to submit the Bid Schedule or a CPFF amount with the supporting workbook information.
The award for this solicitation will be a cost-plus-fixed-fee contract. Offerors shall provide a top-level spreadsheet for the bid schedule and organized by cost element (i.e. Direct Labor, Subcontracts, Direct Material, Other Direct Costs, Overhead/Indirect costs, FCCM, Fixed Fee) which supports the Offeror's proposed (unit or total) price. See Sections L and M, Factor 4 – Cost for additional information that must be submitted to supplement the bid schedule.
12. Section 52.216-1 Type of Contract states “The Government contemplates award of a Cost Plus Fixed Fee contract resulting from this solicitation.” Also on page 58 of 64 in the solicitation, Section B Factors to be Evaluated it states “The resulting award will be a Cost Plus Fixed-Fee (CPFF) contract.”
Section B – Supplies or Services and Prices has a bid schedule that contains Job and Unit Price items. Specification 01 22 00, Measurement and Payment describes the methods for payment for Job Payment Items and Unit Price Payment Items. These descriptions imply the execution of the work is to be paid by either lump sum or fixed unit prices. This appears to be a conflict with the type of contract as listed above. Please clarify the type of contract and the method of payment.
See response to Question 11.
