About this file
This document contains an amendment to a solicitation and responses to requests for information related to a federal contract opportunity for transformer replacement at the Fox Point Hurricane Barrier in Providence, Rhode Island. The U.S. Army Corps of Engineers, New England District is seeking proposals to replace two original oil filled power transformers and manually operated disconnect switches. The NAICS code is 238210, the period of performance is 540 calendar days, and the estimated value is between $1,000,000 to $5,000,000. Questions were answered clarifying transformer assembly methods, PCB waste disposal requirements, fastening materials, structural base details, and confirming no additional site visits will be allowed prior to submission. The Buy American Act applies without exceptions.

SUMMARY OF CHANGES
SECTION SF 30 - BLOCK 14 CONTINUATION PAGE
The following have been added by full text:
REQUESTS FOR INFORMATION
1. Referring to Specification section 48 20 00 3.8.1a. The section states: The transformer will require reassembly prior to moving into position, due to the presence of the takeoff tower restricting crane movement at the permanent operating location. We don't see a takeoff tower shown on any of the drawings. Please clarify the location of the takeoff tower and confirm that the transformers will require reassembly prior to moving into position as Section 48 19 23 3.6 seems to suggest the transformers will be re-assembled after being moved into their final operating locations.
Response: “Takeoff tower” is a misnomer. This references the final exterior location of each transformer. It is the Contractor’s determination of means and methods to reassemble the transformers in a construction staging area or in the permanent location.
2. Please confirm the expectation is that once the PCB oil is drained from the transformers, the transformers will be considered PCB Containing Waste and disposed of with an appropriate waste management company.
Response: Yes, specification section 02 84 33 references drained PCB contaminated electrical equipment. Per the specification, disposal must comply with EPA, Federal, State, and local regulations.
3. Please confirm that the Code and Facility Code blocks on Form SF 1442 both refer to the bidder’s CAGE code.
Response: Yes, the Code and Facility Code blocks on Form SF 1442 both refer to the bidder’s CAGE Code.
4. Specification Section 48 19 23 2.5.1 Windings-General states that if transformer is of a core-form design, windings, “…shall be of a circular coil construction.” Please confirm if rectangular coil construction would be an acceptable alternative.
Response: Provide circular coil construction as stated in the specifications.
5. Specification 48 19 23 Section 2.1.3 states that transformers shall not exceed the limiting dimensions as shown on drawings E-201. Drawing E-201 does not provide any dimensions, please provide.
Response: Physical dimensions of the transformers are not indicated on E-201. Please refer to note 3 on E-201 in which one sentence which reads, “all dimensions must be field verified prior to commencement of all work and ordering all equipment.” Building space dimensions where the transformers are to be installed are noted on ED-101 and E-101 to include walking space around the equipment. The dimensions must also be field verified.
6. Specification Section 03 60 00 3.4 states new steel anchor bolts shall be of galvanized finished whereas Section 26 05 00 1.5.3.1 states fastenings and fittings exposed directly to the weather must be stainless steel. Please clarify.
Response: The anchorage of the steel base to the concrete pad below shall be steel, conforming to ASTM F1554 and shall be of galvanized finish, whereas the fastenings and fittings associated with all of the transformer connections itself shall be all stainless steel.
7. Transformer Specification Section 48 19 23 2.7.6 states transformers shall be provided with steel supporting base designed for pad mounting and anchoring, designed to withstand seismic forces. Transformer Shipment Specification 48 20 00 1.2 describes welding the transformer base to a steel support mounting pad for seismic anchoring, indicating a separate steel base. Please confirm the structural steel base designed and delivered welded to transformer as described in the Transformer Specification is the only structural support required to be anchored to the concrete pad.
Response: Correct. The structural steel base designed, delivered, and welded to transformer as described in the Specification is the only structural support required to be anchored to the concrete pad.
8. The contract requires “Buy American” and there are some caveats for Canadian manufacturers to satisfy that requirement. The two possibilities are:
A) Is the project funded by the recovery act?
Recovery Act Buy American Exemptions
The temporary part of the Agreement exempts Canadian companies from the Buy American requirements for a number of infrastructure projects (but not all) funded under the Recovery Act. The seven programs covered under the Agreement are:
1) U.S. Department of Agriculture, Rural Utilities Services, Water and Waste Disposal Programs
2) U.S. Department of Agriculture, Rural Housing Service, Community Facilities Program
3) U.S. Department of Energy, Office of Energy Efficiency and Renewable Energy, Energy
Efficiency and Conservation Block Grants
4) U.S. Department of Energy, Office of Energy Efficiency and Renewable Energy, State Energy
Program
5) U.S. Department of Housing and Urban Development, Office of Community Planning and
Planning and Development, Community Development Block Grants Recovery (CDBG-R)
6) U.S. Department of Housing and Urban Development, Office of Public and Indian Housing, Public
Housing Capital Fund
7) U.S. Environmental Protection Agency, Clean Water and Drinking Water State Revolving Funds, for projects funded by reallocated ARRA funds where the contracts are signed after February 17, 2010
B) GPA Commitments There are 37 states that are subject to the WTO GPA, specifically: Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Hawaii, Idaho, Illinois, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, New York, Nebraska, New Hampshire, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Dakota, Tennessee, Texas, Utah, Vermont, Washington, Wisconsin, and Wyoming.
These commitments extend to the procurement of goods, services and infrastructure construction projects (including non-Recovery Act). However, consistent with WTO GPA general rules, the commitments only apply to procurement by U.S. states above certain defined value thresholds:
For goods and services, the value of the procurement must equal or exceed: US$522,000 For construction projects, the value of the project must equal or exceed: US$7,358,000
In addition, most states have imposed some limitations on procurements that are covered by these commitments, although in many cases all procurement by state executive agencies is covered. However, limitations may exclude construction-grade steel, motor vehicles and coal. Visit the WTO website for information on the Sub-Central Government Entities which Procure in Accordance With the Provisions of this Agreement (DOC, 80 KB, 6 pages). Pre-existing Buy America requirements (i.e. transportation) attached to transfers from the federal government to state governments for mass transit, highway projects, and other transportation still apply.
Rhode Island Executive branch agencies, excluding boats, automobiles, buses and related equipment.
Any info you can provide would be immensely appreciated.
Response: A. This project is not funded by the Recovery Act.
B. There are no exceptions at this time to the Buy American Act. Please see provision 52.225-10 and Clause 52.225-9 for additional information.
9. Is it possible visit the site again prior to the submission of proposals?
Response: An additional site visit is not possible prior to the submission of proposals.
