About this file

This is a Pre-Proposal Inquiries (PPI) document containing Questions and Answers for solicitation W912PF26RA011, a Design-Bid-Build (DBB) storm and sanitary sewer repair project at Caserma Miotto in Italy.

The solicitation is for a standalone federal construction contract (not part of a larger MATOC) with a new contract award, with design already completed. The Government set a funding constraint deadline of 30 September 2026 due to critical infrastructure repair needs. Key project requirements include: (1) performance and payment security established at 10% of total contract award price as an alternative to standard U.S. forms; (2) corporate experience recency requirement extended from five years to eight years for qualifying projects; (3) mandatory minimum of three baseline projects meeting primary attributes ($6,000,000+ construction cost with core sewer/sanitary basin scope), with option to submit up to two additional projects demonstrating specialized secondary attributes (naturalistic hydraulic/landslide remediation, synthetic turf fields, lamination tanks) exempt from the $6,000,000 size threshold; and (4) prime contractor must directly possess specialized experience and capability for active project oversight, though subcontracting is permitted. The geotechnical reports and utility information in contract documents establish the contractual baseline for differing site conditions under FAR 52.236-2. Construction sequencing is mandatory but subject to modification if post-award field conditions warrant, with Contracting Officer approval. Pre-construction condition surveys will be jointly conducted with Government representatives to establish baseline for existing conditions, with the Contractor not responsible for pre-existing damages properly documented. Prime contractor/subcontractor teaming arrangements are not permitted; Joint Venture structures satisfying qualification requirements are required. The Government rejected requests to extend proposal preparation timelines beyond August 2026 despite Italian summer holiday constraints and acknowledged challenges in establishing Joint Ventures and securing U.S.-standard bonding from Italian contractors.

4 21-Jul-26 Draft RFP General

We kindly request that the Government take into consideration the Italian holiday period when issuing this solicitation.

Due to the size and complexity of this project, offerors require sufficient time to identify and coordinate resources, engage teaming partners, and thoroughly review and evaluate the solicitation requirements in order to prepare a complete and competitive proposal.

In Italy, the month of August is the primary holiday period, during which many businesses, suppliers, subcontractors, and public offices are closed or operate with significantly reduced staffing. Consequently, obtaining quotations, technical information, and other necessary feedback from suppliers and subcontractors is often delayed, making it difficult to complete pricing evaluations and proposal development within a shortened solicitation period.

To promote full and fair competition and allow offerors adequate time to develop responsive proposals, we respectfully request that the Government consider issuing the solicitation at the end of August or after the conclusion of the Italian summer holiday period. This would provide offerors with greater access to key personnel, suppliers, and subcontractors necessary to prepare accurate and competitive proposals.

The Government acknowledges the challenges of the traditional Italian summer holiday period (Ferragosto); however, due to strict U.S. federal fiscal year-end funding constraints (30 September 2026) and the critical nature of the infrastructure repairs, the solicitation release and proposal due dates cannot be delayed. To maximize preparation time, the Government has proactively released draft documents early, and offerors are strongly encouraged to begin immediate coordination with key suppliers and subcontractors. The solicitation schedule remains unchanged

RFP

With reference to the Performance Bond requirement, we note that the solicitation requires the use of U.S.

Standard Forms, which are typically supported by U.S. sureties and financial institutions.

For local Italian contractors, obtaining these instruments through U.S. banks or sureties can be difficult and may unnecessarily restrict competition.

We respectfully request that the Government consider accepting, as an alternative, a 10% Performance Guarantee issued by a recognized financial institution or bank, in accordance with standard Italian and European commercial practices. Acceptance of this form of guarantee would facilitate broader participation while continuing to provide adequate financial security for contract performance.

The performance and payment security requirements of RFO FAR 52.228-15 have been tailored for this Outside the Continental United States (OCONUS) acquisition. The successful Offeror has been afforded two options: the U.S.

Standard Form providing 100% bonding requirement or a performance guarantee equal to ten percent (10%) of the total contract award price. See Section 00 73 00, para. 8.1 - 8.4, for performance and payment security for details. See issued

Experien ce

Due to the size, complexity, and unique combination of disciplines required under this solicitation, we respectfully request that the Government extend the experience recency requirement from five (5) years to ten (10) years.

Projects of this nature are not frequently procured, and limiting qualifying experience to the past five years may unnecessarily restrict competition by excluding otherwise highly qualified contractors with relevant and successful past performance.

Partially concur. The Government agrees to revise the experience recency requirement from five (5) years to eight (8). See amendment 01, Section 4.2.1.1.1(e).

RFP 13 1.9

Upon reviewing the draft solicitation, we note that the current qualification requirements appear highly prescriptive and may limit competition to a relatively small number of highly specialized firms. While these firms may possess the required technical expertise, they may not necessarily have experience performing work on military installations under the unique contractual, quality control, safety, security, and FAR requirements associated with U.S. Government construction projects.

We understand that the draft solicitation permits the use of Joint Ventures to satisfy these requirements. However, based on our experience, the period between anticipated solicitation issuance and proposal submission is unlikely to provide sufficient time to establish a compliant Joint Venture. Forming a JV requires significant legal and administrative effort, including preparation of JV agreements, notarization, company registration, SAM registration, NCAGE assignment, and other compliance actions necessary to compete for a U.S. Government contract.

These challenges are further compounded by the European summer holiday period, during which the availability of key personnel, legal advisors, registrars, and notary services is often significantly reduced.

As part of our market outreach, we have engaged several highly specialized firms regarding this opportunity.

While these firms possess the required technical capabilities, many have indicated reluctance to participate through a Joint Venture structure because the establishment of a new legal entity is not aligned with their normal business model, long-term business strategy, or administrative constraints resulting from the summer holiday season.

Given these considerations, will the Government consider allowing Offerors to satisfy the qualification requirements through a Prime Contractor/Subcontractor teaming arrangement? We believe a Prime/subcontractor relationship would increase competition while providing the Government with the combined benefits of a Prime Contractor experienced in executing projects on military installations and complying with FAR, quality control, safety, security, and installation access requirements, together with specialized subcontractors possessing the required technical expertise. This structure would maintain clear contractual accountability, simplify contract administration, reduce performance risk, and help ensure successful project execution without limiting participation from otherwise highly qualified teams.

The Government has reviewed the request; however, the requirement remains unchanged.

To clarify, the solicitation's baseline relevancy criteria established in Section

4.2.1.1.1 do not require prior experience contracting with the U.S. Government or performing work specifically on military installations.

Due to the technical complexity of this project, the Prime Contractor (or formal JV members) must possess this specialized experience directly. While subcontracting for this work is permitted, the Prime Contractor must have the inherent technical expertise to provide active oversight, proactively identify and resolve issues before they impact performance, and intelligently manage the project without merely relaying unverified subcontractor updates.

Maintaining this capability at the prime level ensures direct contractual accountability and mitigates critical performance risks. Government market research confirms a sufficient pool of qualified Prime/JV sources exists to ensure robust competition

Joint Pre- Constru ction Survey 54 00 72 00

FAR

52.236-

Will the Government conduct and jointly document a pre-construction condition survey of existing pavements, buildings, utilities, fences, and adjacent facilities prior to commencement of construction? If so, please confirm that the Contractor will not be held responsible for pre-existing damage identified during that survey.

In accordance with standard construction best practices and the requirements of Section 01 11 00 of the Statement of Work, the Contractor is responsible for documenting existing site conditions prior to commencing work. The Government's representatives (e.g., the Contracting Officer's Representative and DPW personnel) will participate in the pre-construction site walk-down to verify the contractor's initial survey. The resulting, mutually verified survey report will serve as the official baseline for existing conditions. The Contractor will not be held responsible for pre-existing damages that are properly identified and documented in this verified report; however, in accordance Part 3, Section 3.1, the Contractor remains fully responsible for repairing any damages to Government or private property resulting from its own operations or negligence during contract performance. -

RFP

20-21 4.2.1 4.2.1.1.

1 /

4.2.1.1.

Sections 4.2.1.1.1 and 4.2.1.1.2 (Subfactor 2.1, Corporate Experience): Section 4.2.1.1.1 establishes Primary Attributes a project must meet to be evaluated as relevant, including a final construction cost of $6,000,000 or greater. Section 4.2.1.1.2 identifies Secondary Attributes (naturalistic hydraulic/landslide remediation in wooded or sensitive areas, synthetic turf fields, and lamination tanks) for which a project may be assessed a Strength. The specialized scopes identified as Secondary Attributes are, by their nature, frequently performed as standalone contracts of modest dollar value, often well below the $6,000,000 threshold, even when performed successfully and at meaningful scale. As drafted, an offeror with directly applicable specialized experience can only receive evaluation credit for Secondary Attributes if that experience happens to occur within a project that also meets all Primary Attributes.

QUESTION: Will the Government consider amending the solicitation to permit offerors to demonstrate Secondary Attribute experience through a limited number of additional projects (e.g., up to two or three supplemental project data sheets) that are separate from, and in addition to, the three-to-five projects meeting the Primary Attributes, with such supplemental projects exempt from the $6,000,000 size threshold but subject to the same recency, role, and location requirements? Alternatively, will the Government confirm whether Secondary Attribute experience may be credited only when demonstrated within a project meeting all Primary Attributes in Section 4.2.1.1.1? This approach would allow the Government full visibility into offerors' specialized experience in the discriminating scopes it has identified, while preserving the baseline relevancy standard for corporate experience.

The Government will not accept additional or supplemental project data sheets beyond the five (5) maximum limit of projects established under Subfactor 2.1.

RFP Sections 4.2.1.1.1(a) and 4.2.1.2. of the solicitation have been amended to clarify Secondary Attribute experience does NOT need to be demonstrated within a project meeting the size and core sewer/basin scope relevancy requirements to be credited.

While the mandatory minimum of three (3) baseline projects must meet all Primary Attributes, if an Offeror chooses to submit a fourth or fifth project, those projects are exempt from the size and the core sewer/basin scope relevancy requirements, provided they are submitted specifically to demonstrate experience in one of the Secondary Attributes (naturalistic hydraulic/landslide remediation, synthetic turf fields, or lamination tanks) and otherwise meet the recency, role, and location requirements of the solicitation. The overall project submission limit remains five

(5) total projects.

52.228-

FAR 52.228-15, Performance and Payment Bonds - Construction (incorporated by reference); SF 1442 Blocks 12a/12b: The draft RFP requires performance and payment bonds, each in a penal amount of 100% of the contract price, furnished within ten (10) calendar days after award. This project will be performed entirely in Italy, and the field of contractors with the specialized experience sought under Factor 2 is composed substantially of Italian construction firms. U.S. Treasury-listed (Circular 570) corporate sureties rarely underwrite bonds for non- U.S. contractors, and while FAR 52.228-14 permits an irrevocable letter of credit as an alternative, an ILC at 100%/100% of a contract in the disclosed magnitude range ($10,000,000-$25,000,000) encumbers a contractor's bank credit lines for the full contract value plus the warranty period - a burden that may deter otherwise highly qualified firms from competing, or inflate proposed prices to carry that cost. We note that the Contracting Officer has discretion under FAR 28.102-2(a) and (b) to establish penal amounts of less than 100% upon a determination that a lesser amount is adequate for the protection of the Government, and that 40 U.S.C. 3131(d) and FAR 28.102- 1 further authorize waiver of bonding requirements for contracts performed in a foreign country where furnishing bonds is impracticable. Italian public-works practice (garanzia definitiva under the Codice dei Contratti Pubblici) typically requires guarantees of approximately 10% of the contract value, and Italian banks and insurers routinely issue instruments at that level.

QUESTION: Does the Contracting Office anticipate amending the solicitation to tailor the bonding requirements of FAR 52.228-15 for performance in Italy - for example, by establishing reduced penal amounts pursuant to FAR 28.102-2, expanding the acceptable forms of security, or extending the ten (10) calendar-day furnishing period?

Reduced penal amounts, consistent with the Government's actual risk exposure, would materially broaden the field of qualified competitors, benefiting the Government through increased competition and more favorable pricing, while progress-payment retainage and the Government's other contractual remedies continue to protect its interests.
