About this file

This is Amendment 0002 to Solicitation W912PB26RA011, issued by the U.S. Army Corps of Engineers (0409 AQ HQ Contract KO Directorate, Unit 28130, APO AE 09114) with an effective date of June 19, 2026. The amendment revises the evaluation criteria text for FAR 52.212-2 (Evaluation - Commercial Products and Commercial Services), specifically updating the Supplier Performance Risk System (SPRS) requirements under Evaluation Factor 2. All other terms and conditions of the original solicitation remain unchanged and in full effect. Offers must acknowledge receipt of this amendment prior to the submission deadline through completion of the amendment form, acknowledgment on each copy of the offer, or separate written communication referencing the solicitation and amendment numbers.

The evaluation will be conducted on three factors: Technical (comprising Site Foreman Certification and Prime Contractor Experience), Supplier Performance Risk, and Price. Award will be made to the lowest evaluated price among proposals meeting acceptability standards for nonprice factors. Technical acceptability requires all three proposed Site Foremen (for Grafenwoehr/Vilseck, Hohenfels, and Garmisch locations) to possess electrician or plumber journeyman certification plus VdS-approved training certifications for sprinkler system maintenance and gas extinguishing system operation per German standards. Prime contractors must demonstrate a minimum of one year of relevant experience within the last five years totaling at least $500,000 annually in fire extinguisher system maintenance, inspection, and repair services. For Supplier Performance Risk evaluation, offerors with Green, Purple, Blue, or Black SPRS scores are acceptable; those with Yellow or Red scores must submit an acceptable Risk Mitigation Plan; Grey scores render offers unacceptable. Price evaluation includes total evaluated price (TEP) for base year and all ordering periods in local currency or U.S. Dollars, fully loaded with all costs, with fairness and reasonableness assessment per FAR 15.404-1b (price realism will NOT be evaluated). The contract specialist point of contact is Yvonne Schmalzreich.

52.212-2 Evaluation-Commercial Products and Commercial Services. (Deviation) Feb 2026 hereby reads as follows:

Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

1. Technical

2. Supplier Performance Risk

3. Price

W912PB26RA0110002

Award will be made on the basis of the lowest evaluated price of proposals meeting the acceptability standards for nonprice factors.

FACTOR 1: TECHNICAL

Subfactor 1: Site Foreman Certification

To be deemed "Acceptable", the offeror shall submit verifiable supporting documentation establishing that all three proposed Site Foreman (one for each designated location: Grafenwoehr /Vilseck, Hohenfels and Garmisch) meet the following qualification (PWS, para 2.4.3.1.2):

a) Successfully completed apprenticeship as electrician or plumber journeymen, certified by the chamber of craft or equivalent.

b) A certificate from an authorized training institute approved by the prevailing Association of Property Insurers; in German: Verband der Schadenversicherer (VdS) (Association of damage insurers) demonstrating the following:

1. Verified specialized sprinkler attendant per German Industrial Safety Ordinance and in accordance with VdS guideline 6007: Qualified person in accordance with BetrSichV for testing automatic stationary fire extinguishing systems.

In German: Befahigte Personen nach BetrSichV und Sprinklerwart nach VdS 6007 zur Prufung von automatischen, ortsfesten Feuerloschanlagen.

2. Verified specialized Gas extinguishing system maintainer in accordance with VdS guideline 6007 Qualified person in accordance with BetrSichV for testing automatic stationary fire extinguishing systems

In German: Befahigte Personen nach BetrSichV und Gasloschanlagenwart nach VdS 6007 zur Prufung von automatischen, ortsfesten Feuerloschanlagen.

An offer is considered "UNACCEPTABLE" if the proposal fails to satisfy the minimum requirements established in Subfactor 1 or if the submitted information lacks sufficient details for verification.

Subfactor 2: Prime Contractor Experience

The offeror will be acceptable if it provides supporting documentation that the prime offeror has a minimum of one (1) year of relevant experience within the last five (5) years preceding the date of issuance of this solicitation. Proof must be provided with the proposal.

"Relevant" experience is defined as performance of efforts involving requirements that are similar in scope (for the types of services identified and defined in the PWS requirements: Maintenance, Inspection and Repair of Fire Extinguisher Systems) and Magnitude of Effort a contract for at least one (1) year within the five-year time period totaling at least $500,000 per year. The US Government reserves the right to research the contracts provided by the offeror in determining relevancy.

At a minimum, an offeror shall provide the following information for each contract that it relies upon to meet the relevant professional experience requirements:

(a) Location and customer name;

(b) Contract number (if such a designation exists);

(c) A narrative explaining the requirement and how it is relevant to the requirements of this solicitation;

(d) Contract performance dates; and

(e) Total contract value.

An offer is considered "UNACCEPTABLE" if either all the documentation as required above for Subfactor 2 is not provided or if our evaluation determines that the documentation provided is not valid or relevant.

FACTOR 2: SUPPLIER PERFORMANCE RISK

The Government will consider Risk in accordance with the provision at 252.204-7024, Notice on the Use of the Supplier Performance Risk System as supplemented by this criterion. The Government will NOT consider Item Risk or Price Risk as described in provision. For purposes of this Risk assessment, the Government will consider information contained in the Supplier Performance Risk System (SPRS). Furthermore, in accordance with DFARS 252.204-7024(e), the Contracting Officer may consider any other available and relevant information when evaluating an offer, which includes Offeror-submitted Risk Mitigation Plans. Any questions or concerns the offeror has concerning its SPRS risk assessments should be addressed as described in paragraph

(d) of DFARS 252.204-7024. To be eligible for award, the offeror must be considered Acceptable as described below. Offerors without a Supplier Risk assessment in SPRS shall be deemed Acceptable. Using the SPRS Supplier Risk Report and any submitted Risk Mitigation Plans, Offerors will be rated based on the following definitions:

Acceptable: Offeror has a Supplier Risk Score of Green, Purple, Blue, or Black; OR Offeror has a Supplier Risk Score of Yellow or Red AND has submitted a Risk Mitigation Plan that the Government determines adequately addresses the underlying SPRS data, demonstrating sufficient corrective actions to lower the anticipated risk of unsuccessful performance to an acceptable level.

Unacceptable: Offeror has a Supplier Risk Score of Grey; OR the Offeror has a Supplier Risk Score of Yellow / Red AND either failed to submit a Risk Mitigation Plan or submitted a Risk Mitigation Plan that the Government determines does not adequately mitigate the risk of unsuccessful performance.

FACTOR 3: PRICE

a. The total evaluated price (TEP) shall be the sum of all CLIN prices listed in the schedule for the base year and all ordering periods. In the event there is a difference between a unit price and the total amount, the unit price will be held to be the intended offer and the total of the CLIN and/or ELIN will be recomputed accordingly. The CLIN will also be recomputed to take into account the change in the contract ELINs. If the Offeror provides a total amount for an ELIN, but fails to enter the unit price, the total amount divided by the ELIN quantity will be held to be the intended unit price. In the event there is a discrepancy between the ELIN pricing and the CLIN price, the ELIN will be held to be the intended offer.

b. Currency: Offers submitted in response to this solicitation shall be in terms of local currency or U.S. Dollars. Offers shall be provided with only 2- digits after the decimal point.

Prices provided shall be fully loaded, inclusive of all fees, overheads, G&A, insurance, profits, or any other markups. Failure to do so may cause the offer to not be considered for award. If the Government receives offers in more than one currency, the Government shall use the method described in Provision 52.225-17, Evaluation of Foreign Currency Offers, to convert local currency offers into U.S. Dollar for evaluation purposes. All supporting documentation shall reflect the same currency established in the price proposal.

c. Each offeror's proposed price will be evaluated to determine whether it is fair and reasonable as per FAR 15.404-1b.

d. The Government WILL NOT evaluate proposed prices for realism.

(b) Ordering Periods:

The Government will evaluate offers for award purposes by adding the total price for all ordering periods to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the ordering periods are significantly unbalanced. Evaluation of ordering periods shall not obligate the Government to exercise the ordering period(s).

(c) . A written notice of award or acceptance of an offer furnished to the successful Notice of award Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The Government will evaluate the reasonableness of the offered prices. The Government will NOT evaluate the realism of offered prices. Normally, adequate price competition establishes a fair and reasonable price. Analytical techniques and procedures described in FAR 15.4 be used, singly or in combination with others, to ensure that the price is fair and reasonable.
