The following items are applicable to this modification:
AMENDMENT PARTICULARS
A. BID OPENING DATE: The bid opening date is NOT EXTENDED by this Amendment; therefore, the bids are due by 3:00 p.m. CST on September 21, 2015. Detailed information regarding the submission of bids is located in SECTION 00100 of the Solicitation document.
B. AMENDED SOLICITATION SECTIONS:
(1) At SECTION 00100, “BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS,” the following subparagraph d. is hereby added to Paragraph 1. “BID CONDITIONS:”
“d. SMALL BUSINESS SUBCONTRACTING PLAN.
This provision does not apply to Small Business Concerns.
Prior to the Contracting Officer awarding the contract, the successful bidder, if a large business, will be required to submit a Small Business Subcontracting Plan in accordance with the provision of FAR Clause 52.2199, "Small Business Subcontracting Plan." This requirement applies to all business concerns other than small businesses. The Contracting Officer must approve the Plan before an award can be made; the Plan will be made a part of the resultant contract. Bidders “shall not” include a small business subcontracting plan with its bid package. Below are the goals for the Department of Defense of which the successful bidder will need to apply to its Plan and as based upon a good faith effort of satisfying.
Small Business (SB): 36.00%
Small Disadvantaged Business: 5%
WomanOwned SB: 5%
Service Disabled Veteran SB: 3%
Historically Underutilized Business Zone (HubZONE): 3%”
(2) At SECTION 00700 - CONTRACT CLAUSES, the following Federal Acquisition Regulation (FAR) Clauses were inadvertently omitted from the Solicitation and are hereby added by reference:
52.219-9 Small Business Subcontracting Plan – Alternate I (Oct 2001)
OCT 2014
52.248-3 Value Engineering-Construction OCT 2010
(3) At SECTION 00700 - CONTRACT CLAUSES, the following FAR Clause is hereby deleted from the Solicitation; it is replaced by the correct Value Engineering Clause - see the aforementioned paragraph:
52.248-3 Alt I Value Engineering-Construction (Oct 2010) - Alternate I APR 1984
C. USACE RESPONSES TO CONTRACTOR’S QUESTIONS
Provided below are the USACE’s responses to questions submitted by Contractor’s since the issuance of the Solicitation.
QUESTION 1: On the printed page 74, under Notice of Requirement for Affirmative Action to Ensure Equal Employment Opp for Construction: it states in paragraph (b), “The goals for minority and female participation expressed in percentage terms for the Contracto4r’s aggregate workforce in each trade on all construction work in the covered are, are as Follows, Minority, 19.6% and Female, 6.9%.
‐‐‐For clarification, does this mean “boots on the ground” workforce on field working days must meet these goals? If so, how do you account for replacement workers on “sick days”?
USACE RESPONSE 1: Per the clause provision at paragraph (c), the hours of minority and female employment must be “substantially uniform” throughout the length of the contract, and in each trade. Therefore, the Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. If an individual is on a sick day, we assume they are still gainfully employed. Thus, unless the contractor plans to fire a person calling off sick, the goals haven’t been compromised because the individual is merely on a sick day, but still under employment. (Re:
52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL
EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999))
QUESTION 2: On printed page 82, Hub Zone SB concerns are discussed. If a team does not have a Hub Zone teaming partner, will that count against a team’s evaluation?
USACE RESPONSE 2:
Per the clause provision at (b) (1) (i) and (ii), Bids will be evaluated by adding a factor of 10 percent to the price of all bids, except from HUBZone Small Business (SB) concerns that have not waived the evaluation preference; and from otherwise successful bids of small business concerns.
In other words, if a HUBZONE SB or SB concern is the successful bidder, the 10% “will not” be added to their bid. However, if the successful bid is from a large business, the 10% will be added to its bid and it could very well make it the second low bid when adding the 10%.
With respect to teaming, to be eligible for the preference, businesses must be “certified as a HUBZone Small Business.”
(Re: 52.219‐4 NOTICE OF PRICE EVALUATION PREFERENCE FOR HUBZONE SMALL BUSINESS
CONCERNS (OCT 2014))
QUESTION 3: I have a question regarding the above solicitation. In Box 10 of the Solicitation Form (1442) it states "competition for this acquisition is full and open unrestricted to business size" but the below that states "the NAICS code is 237990 with a small business size standard of $36.5M." So is this solicitation unrestricted or a SB set‐aside?
USACE RESPONSE 3: A SB set‐aside is no where mentioned in Block 10 or elsewhere in the Solicitation. As clearly and explicitly stated at Block 10, COMPETITION FOR THIS ACQUISITION IS “UNRESTRICTED” TO BUSINESS SIZE, meaning any size business may compete for this acquisition.
The NAICS code and size standards are provided in accordance with the Federal Acquisition Regulation, which serves as a tool for determining whether or not a business is considered small for this procurement. Contractor’s are required to certify to their business sizes per Section 00600 of the Solicitation (Representatives & Certifications). This aids when evaluating bids, e.g. whether or not to employ the HUBZone price evaluation preference or require a small business subcontracting plan.
