Project: Chickamauga Lock Approach Wall and Block 14 (Description of Amendment/Modification):
Decommissioning The purpose of this amendment is to:
1) Update DFARS Clause 252.236-7001, Contract Drawings and Specifications to add FIO drawings and instrumentation inventory report and remove FIO miscellaneous drawings and specifications appendix not used.
2) In accordance with Class Deviation 2025-O0002, remove PLA requirement from Section 00 21 00, Instructions to Offerors and Procedures for Submittal of Offers and Proposal Evaluation Approach, and Section 00 73 00, Supplementary Conditions.
3) Remove FAR Provision 52.222-33, Notice of Project Labor Agreement, and FAR Clause 52.222-34, Project Labor Agreement.
4) Provide updated Price Schedule.
5) Update FAR 52.236-27, Site Visit - Construction, Alternate I to provide the new site visit date of 04 March 2025. Due to inclement weather, a "virtual" Pre-proposal meeting is scheduled for 20 February 2025. All other pertinent information remains the same.
6) Provide the slide presentation and attendance list from the "virtual" pre-proposal meeting.
7) Update FAR Provision 52.252-3, Alterations in Solicitation.

As prescribed in 236.570(a), use the following clause:
CONTRACT DRAWINGS AND SPECIFICATIONS (AUG 2000)
(a) The Government will provide to the Contractor, without charge, one set of contract drawings and specifications, except publications incorporated into the technical provisions by reference, in electronic or paper media as chosen by the Contracting Officer.
(b) The Contractor shall-
(1) Check all drawings furnished immediately upon receipt;
(2) Compare all drawings and verify the figures before laying out the work;
(3) Promptly notify the Contracting Officer of any discrepancies;
(4) Be responsible for any errors that might have been avoided by complying with this paragraph (b); and
(5) Reproduce and print contract drawings and specifications as needed.
(c) In general--
(1) Large-scale drawings shall govern small-scale drawings; and
(2) The Contractor shall follow figures marked on drawings in preference to scale measurements.
(d) Omissions from the drawings or specifications or the misdescription of details of work that are manifestly necessary to carry out the intent of the drawings and specifications, or that are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work. The Contractor shall perform such details as if fully and correctly set forth and described in the drawings and specifications.
(e) The work shall conform to the specifications and the contract drawings identified on the following index of drawings:

Supplementary Conditions
1. SCHEDULE OF INSURANCE:
The Corps shall require all its contractors to procure and maintain a policy or policies of Commercial General Liability insurance and if applicable, Umbrella or Excess Liability policies of at least One Million Dollars ($1,000,000) per occurrence, Automobile general liability insurance with combined single limits of at least One Million Dollars ($1,000,000) per occurrence, and Workmen's Compensation and Employer's Liability Insurance of at least One Hundred Thousand ($100,000) per occurrence.
The policies of insurance shall be written by an insurance company or companies which shall be rated "A" or Better by A.M. Best Company and are licensed to do business in the State of Tennessee, or which are an accepted surplus lines carrier. The above requested commercial general liability coverage and any umbrella coverage shall be "Occurrence" form policies. USACE contractors shall require its insurer(s) to amend the above liability policies to provide that:
(a) TVA, the U.S., their directors, officers, agents, and employees are Additional Insureds under this policy; and
(b) It states that it is primary, noncontributory insurance; and
(c) It includes an insurer's waiver of rights of subrogation in favor of TVA, The U.S., their directors, officers, agents and employees; and
(d) It contains a cross liability or severability of interest clause; and
(e) It states the policy may not be canceled, non-renewed, or materially changed by the insurer without giving thirty (30) days prior written notice to TVA (except that notice of cancellation for nonpayment of premium may be ten (10) days).
If requested by TVA, the Corps shall promptly provide or cause its contractors to provide a certified copy of the insurance policy. The Corps will promptly notify TVA of any accidents on and /or damage to the licensed premises or the facilities thereon. TVA may require the Corps to require its contractors at any time to obtain and maintain increased minimum amounts of insurance coverage to the extent it reasonably believes such increased minimum amounts of insurance coverage are necessary in accordance with standard insurance industry practice or to cover changes caused by inflation.
Before commencing work under this contract, the contractor shall certify to the Contracting Officer in writing that the required insurance has been obtained.
The contractor shall insert the substance of the clause entitled "Insurance-Work on a Government Installation (FAR 52.228-5), "in subcontracts under this contract that require work on a Government Installation and shall require subcontractors to provide and maintain the insurance required above.
2. TIME EXTENSION FOR UNUSUALLY SEVERE WEATHER:
a. This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with FAR clause 52.249-10, "Default (Fixed Price Construction)". In order for the Contracting Officer to award a time extension the following conditions must be satisfied.
1) The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
2) The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the contractor. See FAR clause 52.236-4, "Physical Data", for the typical number of anticipated adverse weather days. The number of days shall be exceeded for a given month before a time extension is granted.
b. Upon acknowledgement of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily contractor's quality control (CQC) report, the occurrence of adverse weather and resultant impact to the normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the contractor's scheduled workday. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in a previous month), be calculated chronologically from the first to the last day of each month and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in FAR clause 52.236-4, the Contracting Officer will convert any qualifying days to calendar days, giving full consideration for equivalent fair-weather workdays, and issue a modification in accordance with FAR clause 52.249-10.
3. ADMINISTRATIVE DISPUTE RESOLUTION:
In furtherance of Federal policy and the Administrative Dispute Resolution Act of 1990, ADR Act, Pub.
L. 101-552, the Contracting Officer will try to resolve all post award acquisition issues in controversy by mutual agreement of the parties. Interested parties are encouraged to use alternative resolution procedures to the maximum extent practicable in accordance with the authority and the requirement of ADR ACT.
