PROPOSAL INSTRUCTIONS
Basis for Award:
Award will be made to the responsible Offeror offering the Lowest-Priced, Technically Acceptable (LPTA) proposal. Each technical evaluation factor must be found to be “ACCEPTABLE” in order for the proposal to be found technically acceptable. Proposals will not be technically ranked.
It is the Offeror’s responsibility to ensure the completeness of the proposal. The Government may evaluate solely on the information provided in the initial proposal and not assume that an Offeror possesses any capability that is not specifically identified in the proposal.
Failure to submit mandatory information for a factor, indicated by the word “shall”, will result in a rating of “unacceptable” for that factor, and the Offeror will be ineligible for award unless the Contracting Officer decides to hold discussions, and includes the Offeror in the competitive range.
Solicitation Submittal Requirements:
The proposal shall be submitted in two sections, a Technical Proposal and a Price Proposal.
All pages containing text shall be consecutively numbered, type-written on 8½ x 11 inch paper with margins of at least one inch, and created using a font no smaller than 12. Proposals shall not be permanently bound (in order to facilitate incorporation of portions of the proposal into the final contract document if necessary).
Technical Proposal: Offerors shall submit (1) hardcopy single-sided original or an emailed version of the proposal. The Technical Proposal shall include the following characteristics:
• The Solicitation number (“W912EQ-16-R-0010”)
• The Offeror’s name, address, telephone and facsimile numbers, and email address
• Names, titles, telephone and facsimile numbers, and email addresses of persons authorized to negotiate on the Offeror’s behalf with the Government in connection with this solicitation
• Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent’s authority
• Responses to all technical evaluation factors. The format used for the areas and factors below should be strictly adhered to. All responses in the Offeror’s package must clearly indicate the applicable evaluation factors:
Part I: Schedule and Work Plan Part II: Key Personnel Part III: Stafford Act Eligibility Part IV: Past Performance
• The Technical Proposal shall not include pricing information and is limited to no more than 20 pages.
Price Proposal: Offerors shall submit (1) hardcopy single-sided original Price Proposal or an emailed version of the proposal. The Price Proposal shall include the following:
• Completed Standard Form (SF) 1442, including acknowledgement of Amendments
• Completed Pricing Schedule (Section 00 01 00).
• Proof of Central Contractor Registration (CCR) and ORCA registration and any other applicable representations (Section 00 60 00)
• If applicable, a copy of any Teaming, Joint Venture or Mentor-Protégé
Agreement
EVALUATION FACTORS
The evaluation factors are listed below. It is intended that proposals be evaluated, and award made, without discussions with the Offerors. If necessary, the Government may contact Offerors for the purpose of minor clarifications(s). If discussions are determined to be necessary, discussions will occur with all Offerors unless a competitive range has been established.
Failure to submit mandatory information for a factor, indicated by the word “shall” or “must”, will result in a rating of “unacceptable” for that factor, and the Offeror will be ineligible for award unless the Contracting Officer decides to hold discussions, and includes the Offeror in the competitive range. Technical evaluation factors (Part I: Schedule, Part II: Key Personnel, Part III: Stafford Act Eligibility, Part IV: Past Performance) will be evaluated first. Price will be evaluated last.
An offeror that wishes to submit a proposal must propose on all of the work. Award will be made on an “All or None” basis to the lowest priced, technically acceptable proposal. Each non-price evaluation factor must be found to be technically acceptable in order for the proposal to be found technically acceptable.
Proposals will not be technically ranked. Only one technical proposal will be evaluated for each offeror.
A. Technical Evaluation Factors
Part I: Schedule and Work Plan
Schedule Requirements: Offerors shall submit a project schedule listing at minimum each phase of construction. The schedule must provide enough information such that the technical evaluation team is able to determine the reasonableness of the schedule in comparison to the Specification requirements and the clause FAR 52.211-10, Commencement, Prosecution, and Completion of Work.
Work Plan Requirements: The offeror’s work plan must adequately demonstrates how offeror proposes to staff/organize the required effort by providing a realistic approach to meeting the requirements of hauling, installing (comprised of performing all the site preparation and tradeswork needed to achieve RFE of the unit), and delivering up to 25 MHUs per day that have been “licensed in” as RFO within 72 hours from task order issuance. For purposes of the work plan only, and not as a contractually-binding requirement, Offeror shall assume that it receives daily a task order for 25 units at different sites in the declared disaster area until 500 trailers have been ordered. The plan should demonstrate:
a. Offeror’s ability to properly staff/organize/subcontract the required effort by providing a realistic management structure from general staff/subcontractor oversight. Offeror shall detail its chain of command structure and methodology, internal controls for problem resolution and plan for identifying and resolving safety issues.
b. Offeror’s rationale for its proposed number of crews available per task and staffing levels per skill set by trade and/or functional area. Rationale adequately describes the methodology for determining how many crews per day is necessary to ensure proper execution and delivery of up to 25 MHUs deemed RFO per day.
c. Flexible staffing/subcontracting approach – the offeror adequately demonstrates ability to cross-utilize, temporarily reallocate, and rapidly increase and decrease its workforce. The offeror adequately identifies how this approach will be executed during surges in effort and during periods of protracted reductions in workload without sacrificing quality or timeliness of production. Offeror adequately demonstrates its ability to effectively and efficiently cross utilize personnel when possible to better support short term requirement changes; emergency requirements where RFO is requested faster than 72 hours from issuance of task order; and during periods of protracted reductions in workload without sacrificing capacity to perform work.
d. Mobilization approach – the offeror adequately identifies a realistic and feasible approach to have a sufficient number of subcontractors and workforce mobilized to begin work within 48 hours of award.
The Schedule and Work Plan will receive a combined rating of “acceptable” or “unacceptable” based upon its entirety. In order to receive an “acceptable” rating, the proposed schedule and Work Plan shall contain each construction phase, must be considered feasible by the government, and shall meet all schedule requirements specified in the solicitation. Noncompliant, missing, incomplete, or ambiguous information may result in a rating of “unacceptable”.
Part II: Key Personnel
Submittal Requirements: Key personnel are defined as the offeror’s proposed full-time employees and/or subcontractor employees responsible for directing operations at the construction sites.
Offerors shall submit a one-page resume for each of the three (3) key personnel listed below:
• Site Safety and Health Officer. The Site Safety and Health Officer shall meet the qualification requirements stated in scope of work paragraph 13.3.
• Contractor Quality Control (CQC) System Manager: The CQC System Manager shall meet the qualification requirements stated in specification paragraph 13.3.
• Site Project Superintendent: The on‐site Project Superintendent shall have experience as a Project Superintendent on projects similar in monetary size and/or scope to the project described in this solicitation.
Three resumes indicating three separate people must be submitted for all three roles. Duplication of personnel for these three positions is deemed Unacceptable for purposes of this RFP. If personnel presented here are later replaced for the execution of this project, replacement personnel must have equal or better qualifications as those proposed and must be approved by the contracting officer before they perform work at the project site.
The Key Personnel factor will receive a rating of “acceptable” or “unacceptable” based on its entirety.
In order to receive an “acceptable” rating, the proposal must demonstrate that all key personnel proposed comply with the minimum requirements stated in the specifications and have sufficient relevant experience and education to indicate that they have the knowledge and capability to successfully perform their assigned roles. Missing, incomplete, or ambiguous information could result in a rating of “unacceptable”.
Part III: Stafford Act Eligibility
Submittal Requirements: The offeror shall complete and submit the provision at 52.226-3, Disaster or Emergency Area Representation (NOV 2007) and provide documentation to support the representation.
The Stafford Act Eligibility factor will receive a rating of “acceptable” only if the offeror represents that it meets all of the criteria as stated in the provision and provides sufficient evidence to establish that the offeror meets the criteria. Offerors that do not represent they meet the criteria stated in the provision will receive an “unacceptable” rating. Missing, incomplete, or ambiguous information could result in a rating of “unacceptable”.
Part IV: Past Performance
Submittal Requirements: Offerors shall provide past performance information for at least (2) projects for completed work by the Offeror within the past thirty-six (36) months. For each project, offerors shall provide the following information:
• Reference (Name, title, company, phone, email)
• Project Title and Description
• Contract or Subcontract number
• Date of Award
• Contract Value
If less than two past performance references are submitted, the submitted project will be evaluated, and the lack of the requested number of projects will not affect the rating for this factor, provided the Offeror certifies that additional past performance information is not available and provides an acceptable explanation as to why additional past performance is not available.
In the case of an Offeror with no relevant performance history, or for whom information on past performance is not available, the Offeror will be evaluated as acceptable provided the Offeror certifies that additional past performance information is not available and provides an acceptable explanation as to why past performance information is not available.
The past performance reference must have been a client, or client representative, with whom the Offeror had a contract, or subcontract (if applicable) for one or more projects. The reference must hold, or have held at the time, a senior position in the client organization with responsibilities of contract administration, quality control, engineering, or technical supervision, or was otherwise in a position to evaluate the Offeror’s performance in executing the contract or subcontract. The past performance reference must have first-hand knowledge of the Offeror’s performance. The reference must have a current, valid phone number at which they can be reached during normal business hours, a fax number, and must be able to speak, read, and write in the English language.
The Government’s assessment of past performance will be based mainly on the Offeror’s reputations with customers and other sources. The Government will consider the currency and relevance of past performance information, source of the information, context of the data, and general trends in the contractor’s performance. The Government may contact any or all of the past performance references provided by the Offeror in response to this solicitation, and may also use information obtained from any other sources when evaluating past performance of the Offeror and major subcontractors. Other sources may include, but are not limited to, the Past Performance Information Retrieval System (PPIRS). While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance rests with the Offeror.
The evaluation will take into account relevant past performance information regarding predecessor companies or subcontractors that will perform major or critical aspects of the requirements when such information is available and relevant to the instant acquisition. If necessary during the evaluation process, any adverse information received regarding subcontractor past performance may be shared with Offerors during clarifications or discussions if held.
The past performance factor will receive a rating of “acceptable” or “unacceptable” based on its entirety. Past performance will be rated “unacceptable” if the contractor receives an unsatisfactory rating for any of the factors identified on the Government’s past performance questionnaire unless the offeror can demonstrate that adequate corrective actions were taken.
B. Price
Submittal Requirements: Offerors shall complete and submit the pricing schedule in Section 00 01 00 with its proposal and include a price for each line item, including subtotals and totals.
The Government will evaluate price based on the total proposed price. The Contracting Officer, or the Contracting Officer’s designee, will evaluate the Offeror’s price for unbalancing and other potential performance risks. Price reasonableness will be determined in accordance with FAR 15.404-1. In this context, reasonableness may be determined by comparing offered prices to one another, to the government estimate, and to pricing for previous work of a similar nature.
EVALUATION PROCESS
1. After receipt of proposals, the Contract Specialist will separate the Technical Proposals from the Price Proposals. Technical Proposals will be provided to the technical evaluation team.
2. The technical evaluation team will convene and independently evaluate the submitted proposals according to the evaluation factors. After concluding the evaluations, the technical evaluation team will provide the evaluation worksheets documenting their evaluation to the SSA. The technical evaluation team will make no recommendation as to which firm should receive the award and additionally shall not establish a rank order or order of merit list pertaining to the offers being evaluated.
3. After receiving the evaluation documentation, the SSA, independently exercising prudent business judgment, will make a source selection decision on the basis of the lowest priced proposal meeting or exceeding the acceptability standards for non-price factors. While the SSA may use reports and analyses prepared by others, the source selection decision shall represent the SSA's independent judgment. The source selection decision shall be documented, and the documentation shall include the rationale for any business judgments made or relied on by the
SSA.
4. If, during the evaluation process, any Offerors are eliminated from the competitive range, the Offerors excluded from the competitive range shall be promptly notified in writing. The notice shall state the basis for the determination and that a proposal revision will not be considered.
The contracting officer shall award a contract to the successful Offeror by furnishing the executed contract or other notice of the award to that Offeror. Each Offeror whose proposal was in the competitive range, but was not selected for award, will be notified in writing within three days after the date of the contract award. Debriefings will be provided to unsuccessful Offerors who submit timely requests.
